In 2007 I was charged with two separate DUI offenses. The first one that I had ever received was in March and I got a second one in October. I received these charges during my own personal time off from work. At the time I was a driver for a beer distributor, ironically. I didn't report back to work because I was certain that I would be fired, after all I was unable to perform the job for which I was initially hired. Since then, I have had much difficulty finding a job, and it is extremely depressing. I have a family to support, and I am desperately seeking any help that I can get.

I'm guessing that your license has been taken away. Your career may be over and it may not be. I'm going to suggest two things. First, I suggest that look into a Certificate of Rehabilitation.  A Certificate of Rehabilitation is a court order, which declares that a person who has been convicted of a felony is rehabilitated. If a petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the granting court and constitutes an application for a pardon.

Then you want to look into a Certificate of Good Conduct. The purpose of is is to provide evidence that you have been rehabilitated for employment and other purposes. It shows you are a law-abiding citizen and fully rehabilitated. It has no other legal effect.


These certificates are not available in all states. it would be a good idea to contact your local legal aid office where you may get assistance at a low cost or even no cost.

Felon seeks jobs in Nursing

 Can a felon hold a nursing license?

To Whom It May Concern,

I am a convicted felon. On March 13th, 2003 I was convicted of felony theft scheme in the state of Maryland. I was 20 years old at the time. I am not 27 soon to be 28 years old. I just finished my associate's degree in nursing. I applied to the Maryland Board of Nursing to sit for the NCLEX RN examination. Within the application I was honest about my conviction and included a cover letter explaining the nature of the incidence. I explained in the letter that since the conviction I have been an honest and trustworthy person and have worked hard at my job and had managed to start and finish a college degree in a very tough and competitive nursing program. I was given my authorization to test, I sat for the NCLEX RN exam and passed. I have yet to be granted a license number.

People in my class that have taken the NCLEX RN exam after me, have already received their license numbers. Would they have allowed me to sit for the exam even if I then were not going to be eligible for licensing? I'm worried that I have gotten this far through this and will then not be granted a license. Do I have any rights here? Why would they take my money and authorize me to test then to tell me "NO" you can't be an RN.
Also, if they do decide to finally give me a license number... Do you have any suggestions on how to go about getting a job?

I'm not sure what the licensing procedure is in Maryland, but if you have not heard from them yet, I would place a call to the Maryland Board of Nursing.

"Breaking the Cycle" helps felons get jobs

TO ALL INTERESTED PARTIES:

My name is Michael Jones and I represent Breaking The Cycle Inc., an ex-offender program located in Northeast Ohio. I have first hand knowledge of the barriers and struggles ex-offenders encounter because I myself am an ex-offender. Many years ago I committed a felony and have since spent my life devoting my time and energy into assisting others find work and overcome the consequences of their mistakes. Thus Breaking The Cycle Inc. was born.

Last year on Wednesday September 30, 2009, Breaking The Cycle Inc. hosted their 1st Annual Ex-Offender Resource and Job Fair at 5615 Chevrolet Blvd located in Parma, Ohio. It was a GREAT success as over 850 formerly incarcerated individuals (153 of which became employed as a direct result of the services provided), as well as 49 Resources and Jobs attended. The MASSIVE attendance, it speaks volumes to the real NEED for more events like these in the near future. We are a community worthy of receiving a 2nd chance.


How can you become a part of this POSITIVE change within YOUR community, you ask?
On Tuesday November 9, 2010, Breaking The Cycle Inc., is bringing forth the 2nd ANNUAL EX-OFFENDER Career Fair to Northeast Ohio. It will be at Zelma George Recreation Center located at 3165 MLK Blvd. Enclosed is a flyer & registration form. We ask that we either receive an email confirmation or a fax confirming whether or not you will be a returning or 1st time vendor to this great event by Friday October 15, 2010 (you may also include your business logo if you want to be recognized as a vendor or supporter of this GREAT event .

Felon helps other felons without jobs

From time to time, I meet people who sincerely want to help felons. I'm sharing a note that was sent to me recently from one who calls himself Trashisfree.



I have personally done quite well post prison, buying a new house 35 days out. Without a regular job I have survived quite well, and in another 2.5 years my house is payed off. Eventually I need to finish a book that I started "The Frugal Felon - Surviving Hard Times Without A Job. How to cut your expenses and make a living when you do not have a job". I have been exploring the possibility of class action lawsuits against both state governments and the federal government. After release, former male inmates work nine fewer weeks annually and take home 40 percent less in annual earnings, making $23,500 instead of $39,100. That amounts to an expected earnings loss of nearly $179,000 through age 48 for men who have been incarcerated.

Of former inmates who were in the bottom of the earnings distribution in 1986, two-thirds remained there in 2006, twice the number of non-incarcerated men.
Incarceration reduces former inmates’ earnings by 40 percent and limits their future economic mobility, according to a new Pew report. www.pewtrusts.org/news_room_detail.aspx?id=60964
The class action is based on lifetime economic damage far beyond the original sentence. This is double jeopardy, punishing someone 2 times for the same crime. An unsealable felony is effectively a lifetime sentence.

I feel that facing such expensive lawsuits, allowing people to let people seal their records after 7 years as a settlement would be reasonable and fair. That is 7 years after completely discharging their sentence, no additional felony convictions. Your criminal record would still visible to the criminal court system. I came up with 7 years, since that is the same amount of time as a bankruptcy. It is also a reasonable amount of time to show that you are no longer a danger to society.

An additional provision would be when an employer submits a background check, there would be a check box that for jobs that include working with children. Anyone with certain crimes against children would not be allowed to work that job, forever. However they would be able to find employment at any job that does not include working with children, after the 7 year period without anything showing up on their background check.

Felon wants jobs and an education

 Educated Felon looking for a Job

I moved back to New Jersey 6 months ago after living in BEAUTIFUL Oregon for 9 years. I haven't gotten a job yet. I have 2 felonies that are drug related. I also want to go to school to become a Certified Public Accountant and I am wondering if I am able to get financial aid?

Hello Pam,

I have many students who are felons have gone on to academic careers. Regarding receiving federal financial aid for college, I know of felons and ex-offenders who were able to obtain grants and loans for education and subsequently jobs. Unfortunately not everyone convicted of a felony is eligible. Certain drug convictions require that you complete an accepted drug rehabilitation program in order to be eligible for federal financial aid.

I suggest you contact the financial aid office of the school you wish to attend. The school wants you as a student and will do everything they can to assist you. They will also help you complete the FAFSA (Free Application for Federal Student Aid.)

I recently was hired at a nursing home and was railed through all the pre employment paper work everyone goes threw these days. I had a drug test, back ground check and had to submit my fingerprints. Well I got a call that something was found in my back ground that has to be looked into further. All they information I was given was that the incident occurred in 2003 making me 16 and I of course knew right away what it was. I was charged with a misdemeanor and did 1 year probation. I like many other people had it seal away because I was a juvenile. Can they not hire me because of this? This is the only thing I have ever done in my entire 23 year life. I have never been arrested nor even gotten pulled over. My adult record is clean.

I'm not sure where you live but most states seal juvenile records from the public. In most cases they are only visible to law enforcement, the court system and government agencies. The one instance that it would not be sealed is the case of a sexual offense. If that is not your situation, you should seek legal advice as to why your offense is visible.

Many ex-offenders and felons looking for jobs often need legal advice. I suggest your local legal; aid office.

FelonEach state has a network of centers that offer a variety of free services that can get you ready for work and assist a felon in finding employment. In addition, these centers offer training programs that may prepare you for a career or even start a business. My name is Angel and I'm having a really hard time. I am a felon and I can't seem to get a job anywhere. Nobody wants to deal with me . My parent agreed to help me get back on my feet. Now my parent is going back on their word so I'm all alone in a rough city trying to make it but nobody wants to give me a second chance.

I'm the mother of 4 and I can't get any help. I never went to jail I got probation and house arrest. I have finished house arrest but I have another year of probation and nobody is trying to give me the time of day. I'm about to be in the street and I have nothing to fall back on. No money, no car, and no home. I feel like I can't go on but I can't give up. Is there somebody, anybody out there I can go to.

I'm in Chicago and wow its hard here if u aren't a felon. I committed a white collar crime, conspiracy to commit fraud that seems to be the worst crime. Nobody wants to give u another chance. I messed up and I know I did and I don't ever wanna do anything illegal ever again. I was trying to feed my family. Being a single mom is a very challenging job but I know I don't have to commit a crime to survive but nobody will even give me a chance to prove that or myself. What do I do?

My suggestion to you is to contact your local United Way office. The United Way could guide you to any number of services they support that may be able to help you and your family. You may also ask about services that assist ex-offenders and felons.

Just recently my husband applied through a staffing agency called Staffmark trying to find some kind of employment. He has 3 more years on parole and has been out of prison for over 2 years. He and I have been married for a year this November and altogether have 3 children between us both. I am the only one working, supporting my 2 children and his biological child. He has full custody of her and can't find work anywhere. Staffmark actually called him back after he applied... went to the Tennessee Career Center in McMinnville,TN. for an interview. Did the entire hiring process for a temporary service... drug-screen, orientation... They gave him a tag-out badge, bank card to activate after his first check, and all the insurance information he needed to be able to decide what plans he wanted. As of yesterday, his brother, who is a supervisor at this company, Yorozu Automotive (has been trying to help get him in the door) , called yesterday informing him they are not going to hire him. The brother didn't know the reason, but told him to call the agency so they could explain why. He didn't lie on his application, I completed it for him online, his charges was for drugs... and it has been 7 years this coming February since his last arrest. So where do we go from here???



Felons JobsYour husband is on the right track. One-stop Career Centers are under-utilized resources. continue to use it. In relation to applying at temporary agencies, that is a good strategy. I often encourage ex-offenders and felons looking for jobs to Consider working as a temporary as a way of getting a permanent job. Temporary agencies are a great way to quickly get back into the working world. Many employers use agencies to try out new employees before hiring them. Good workers are hard to find. If an employer sees that you are hard working, punctual and fit in well, he may offer the job permanently. The key to applying for temporary employment for ex-offenders and felons is to apply at smaller independent agencies rather than large national companies. Small independent agencies have fewer hiring restrictions than larger national companies and are free to hire anyone they choose. He will be able to get a list of these agencies in your local phone directory.
