President Trump's State of the Union address highlights that being tough on crime is
perfectly  compatible with wanting individuals with records to find work and become
independent instead of falling into government dependency.

In his 2018 State of the Union address, President Trump said that “we will embark on reforming our prisons to help former inmates who have served their time get a second chance.”

This sentiment directly follows what Trump promised during his inaugural address, that “we will get our people off of welfare and back to work.” People coming out of incarceration face two distinct paths—they can either find a job, or they will fall into government dependency. Beyond being the main predictor of whether someone is living in poverty, not having a job is the clearest indicator of how likely someone is to re-offend.

Yet one year after their release from incarceration, between 60 percent and 75 percent of ex-offenders remain unemployed. Rather than promoting rehabilitation and independence, states across the country severely limit the work prospects of ex-offenders through occupational licensing laws.

Most states have little oversight over how licensing agencies can treat those with criminal records, meaning agencies can consider old convictions or convictions that are unrelated to the occupation. Even worse, boards can require that applicants meet vague standards such as having “good character” or not showing “moral turpitude.” These unclear requirements give licensing boards broad discretion to prevent ex-offenders from getting work.

With the devastating opioid crisis leaving tens of thousands of individuals across the country with records, vague standards that allow boards to judge applicants’ character can serve as a major obstacle for those recovering from addiction who are seeking work in licensed occupations. Because work is a core component of recovery and has the largest positive effect of any indicator on overcoming drug addiction, states should be promoting work for these individuals, not adding barriers to recovery.

Given that there are 2.3 million people incarcerated in America—at least 95 percent of whom, or 600,000 people each year, will re-enter the general population at some point—excessive licensing regulations for those with records pose a major problem to people like Texas resident Christopher Owen.

After finding work at a home security company, Owen was denied a fire alarm installer license because of a felony burglary on his record. His offense? He had stolen a $5 pair of socks from a Goodwill drop-off trailer in 2014. This incident happened right after Owen’s home had burned down and his mother had passed away. In a brief period, he had gone from owning his own oil and gas company to being homeless. Yet none of these mitigating circumstances were considered by the Texas Department of Public Safety. A crime of $5 cost Owen a career.

There are countless other stories similar to Owen’s—each more unbelievable than the last. Perhaps the least-defensible example of overreach from licensing authorities can be found in Calvert County, Md., where a misdemeanor or a felony can automatically disqualify someone from working as a licensed fortune-teller. Many of these licensing restrictions have nothing to do with protecting public safety. And paradoxically, research has shown that broad licensing restrictions against ex-offenders endanger the public more than they protect it.

Thankfully, states are acting to lower the barriers faced by those with records. Florida State Sen. Jeff Brandes and State Rep. Scott Plakon (both Republicans) introduced a bill that would allow those in prison to apply for licenses before their release date. The reform also allows those with records to petition licensing boards to ensure that they will be approved before they invest substantial amounts of time completing government-required training. And boards for certain occupations will no longer be able to consider convictions from more than five years ago, which will no doubt help the thousands of people recovering from opioid addictions and related offenses move on from their pasts.

In Nebraska, State Sen. Laura Ebke (a Libertarian) introduced a comprehensive licensing reform bill making clear that criminal histories alone should not disqualify people from work. If this bill becomes law, Nebraska boards will no longer be allowed to consider offenses that are unrelated to safely working in a licensed occupation. This highlights another kind of overreach where licensing boards impose blanket bans, which are occupational bans for any kind of felony or misdemeanor, even when the offense is unrelated to the job. One example of this can be found in Nebraska, where those with any criminal record can be denied a massage therapy license. Similar bills to get rid of blanket bans are moving through the legislatures in Wisconsin, the District of Columbia, and New Hampshire.

President Trump’s State of the Union address highlights that being tough on crime is perfectly compatible with wanting individuals with records to find work and become independent instead of falling into government dependency, whether through welfare or re-incarceration. Work keeps ex-offenders out of poverty, allows them to gain valuable skills and experience, moves them off welfare, and helps them avoid reoffending—those are more than enough reasons for states to give them a chance at a fresh start.

Initiative to get ex-offenders back to work soars through the Senate

My husband was convicted of a felony 10 yrs ago. He just recently received an associates degree as well as his FCC and A&P licenses to become an avionics technician. I have been kind of resistant towards his degree path because it seems like such a restricted field for someone with a felony. I noticed you had a couple airlines listed on your list of people who hire felons. Do you think he has a chance with these companies to become a technician? Also, do you know anything about getting felonies removed from your record?

We do list airline on our list of companies that hire ex-offenders and felons.  The nature of the conviction in relation to the position applied for will come into play.  My suggestion is to apply to airlines using well written cover letters introducing the prospective employee's resume and the position desired.  Hopefully one will get an interview where he can meet someone with the power to make a decision.  At sometime during this process, the issue of the criminal record will come up and can be discussed.

Felon wants Job with an AirlineAs far as having felonies removed,  many people are a little confused when it comes to this issue no one can remove a criminal conviction.  The most that one can hope for is to have it removed from public view.  Many lawyers will advertise that they can erase criminal records.  Through processes like sealing or expungement they can get them hidden, but they will always be available to the court system, law enforcement and government agencies.  My suggestion to your husband is save himself a ton of money by contacting your local legal aid office.  Legal aid offices are usually staffed with young, hungry attorneys who are willing to work hard to get things done.  Statutes governing sealing and expungement of criminal records vary from state to state.  Legal aid will be able to tell him what options he has and what the impact will be on his record.  He may qualify for free or low-cost assistance.

Felon Wants to Become a BarberIf he wants to be a barber that is great.  I know of many ex-offenders and felons who have chosen to be barbers and hairstylists.  Every community welcomes good barbers.  I have been to many prisons and found that barber/cosmetology instruction is offered as vocational training within the prisons themselves.  If that is
the case where your boyfriend is, he will be ahead of the game.  What you may want to do first is contact the cosmetology board in your state to see if his convictions make him ineligible to be certified or licensed.  If not, he could still turn it into a profitable "hobby."  He could make house calls and cut hair.

Always a strong suggestion I make to all felons looking for jobs is to make a trip to the local One-stop Career Center.  Once know as the "employment office," the local one-stop offers many services like resume preparation, interviewing skills and other resources to help citizens get jobs.  There are also computers available for job search use.  Every center has lists of available jobs in the immediate area.  He will also find counselors that offer personal assistance to those looking for jobs.  If barber training is not offered at your boyfriend's facility, there may be funding available for training at a barber school.  The counselor will be able to tell you if funding is available.  The counselors also may know employers that have hired ex-offenders or felons in the past.

I have a job interview next week and I am very nervous about it.  I have an interview for a job as a clerk in a title office.  I have done this kind of work before but not since my legal troubles.  I was involved with a guy who was selling drugs.  There were some in my apartment when he was arrested.  Because the lease was in my name, I was charged with possession. I wasn't selling but I was charged anyway.  I know this will come up on a background check.

Hi Candy,

You don't know how often I hear stories like this.  Too many people get dragged down by people around them and often there are lasting effects.  I'm not going into a lecture about choosing better friends, but you knew he was selling, and there are certain risks involved associating with people and their criminal activities.

Hopefully you were honest on your application and you got an interview anyway.  If that is the case,

somewhere in the interview, the question is going to come up. You can handle it in three steps.

Own your Mistake - Never blame anyone else for your mistake.  Acknowledge your role in your troubles.  You could start by saying something like this, "I'm glad you asked me that because I want you to feel comfortable about hiring me. I’ll be honest with you because you have the right to know.  I have been in trouble but it didn’t have anything to do with any of my previous employers.  I was involved with someone who was into some bad things and I was arrested along with him.  I am proud to say that I have put that all behind me.

Focus on the Positive - Shift the conversation away from your problem and on to the things you have done to improve yourself and how you now only associate with people who are doing positive things.  Talk about what you have learned through this bad experience.

Talk about your Goals - Without being specific, tell the interviewer that you have goals and this job will help you put your mistake behind you.

Sell your Skills - Talk about your skills, training, education and how they make you an ideal candidate for the job.

Don't forget to be personable and friendly.  Get the interviewer to focus on your skills and personality instead of the fact that have a criminal record.  Stick to the formula above and you will do well.  Remind the interviewer that you can be bonded.  Get information about the Federal Bonding Program and how it can help felons get jobs here:

I often hear of people using Indeed to look for jobs.  In fact, Indeed says that it gets 140 million unique visitors to its website every month.  Out of that number, I wonder how many real job leads are found there and out of that number, how many people actually get jobs.  When you click on the "apply" links on the Indeed website, what happens?  When you click the "apply" link you are asked for your personal information but I'm not really sure if the application actually reaches the employer.

My experience is that when you sign up with Indeed your email address is sold  and you will get tons of emails from career schools, how to make money at home schemes and other things that have nothing to do with getting jobs.  I never encourage the ex-offenders and felons I work with to use Indeed.  A lot of the job listings are stale and the jobs are no longer there.  I have also seen instances where the job didn't even exist.  For instance, I saw one job listed that I always see in my area here in southern New Jersey.  I mean that I see the same job listed all the time.  It was for a job at a nationwide retailer.  It was one of the companies on my list of companies that hire ex-offenders and felons.  So, I went to the store to talk to the manager, who I have known for years to see if the job was actually open.  The manger told me that he had no openings and that Indeed has had that job posted for months.

I Never Use Indeed To Help Felons Get JobsCan Indeed be valuable in any way?  I teach my students that if they must use Indeed,  never sign up for their website so they don't get bombarded with a bunch of spam emails.  Secondly search for jobs their area but don't click the links on the Indeed website.  Instead of clicking the link, look up the company on your own.  For example, if Indeed lists a job at XYZ company, don't click the link on Indeed, go directly to the XYZ website.   Once you get there look for the link to the company's own employment section.  It often is at the very bottom in small print and it may say "Employment" or "Careers."  Click on the link.  You will be surprised at what you will find.  You will find all of the actual open positions along with the job descriptions, requirement and how to apply.  If the company is nation-wide the job listings will be listed by geographical location.  You will often find more jobs than are listed on Indeed.

You will find that this will result in more and better job leads.

Dear Mr. Mayo,

This letter is finding it's way to you today because thru out this journey I've been venturing alone I fortunately asked Google the right question, browsed the Internet tapping in the direction to find you, or possibly just a higher power. Whatever it was that has lead me to this path I'm taking my opportunity to finally find someone who can guide me in the direction I needed to be in months possibly years ago.

My name is Kandy, I am as of 01/06/2015 convicted felon ×7, I by the grace of God was fortunate enough to be blessed to keep my nursing license. Yes, I am a licensed practical nurse 10 years, 11 years 03/09/2016. & was a nursing assistant 12 years before that. My license is under suspension at least until March 15, 2017. But thru all the court proceedings, separation from my husband of 18 years, 2 kids then 12y/o & 4y/o, losing our home, cars, dignity,  job, income,  I mean literally losing everything besides the ability to breathe.

So I have only worked about 3 months in the past 2 years. I'm desperate to learn all I can to just make some kind of progress towards employment.  Still legally married, my husband in his trade 15 years making $38.74 hourly, now about to take his journey man's test making about $45-$50 an hour and have to beg for $20  fir gas to get his children across town to school.  I could go on and on. What is most important is I'm hard working, dedicated,  always give 110% even in chaotic/stressful/basic events.  I believe strongly in working as a team, doing whatever it takes to get the job done, I'm humble and learn quickly,  if I don't know something I'll bust my tail to figure it out,  compassionate,  silly, friendly,  outgoing, energetic,  intelligent,  professional.  100% adult /woman enough to admit that I admit only naming my hood qualities but know that I have many bad as does the rest of the human race, but I conduct myself in a respectful professional manner.  I know there's a time and an place for everything and can admit when I'm wrong,  as well as right my wrongs proudly.  Lastly I'm genuinely a good person that made mistakes,  who's life got the best of for a minute,  but I am sober 4 years & 79 days since 11/01/11.   I will help any and everyone I can always have everyday of my life. Before this letter I had been do ashamed and humiliated that I fell off from heart ache, too proud to ask for help, & wanted to fix my life quickly & quietly before it all came out. However,  I'm broke and struggling while bringing my children to suffer with me.

So my story doesn't end here, this is one step towards my success story no matter the outcome. Your an amazing man to do any of this, from my travels down this path I now have a desire and passion to do what you are doing,  to help change things to where a mistake doesn't mean a life sentence no matter what your actual sentence was. To help show that of you give incentives, rewards, & just give a chance not taking an Ex-Offenders rights/privileges & commodities away even after their debt is paid, sentence maxed out, or  they do any and every thing they are offered to rehabilitate themselves.  Maybe one day they will see its the struggle,  the difficulty,  the failure time & time again, constant disappointment, the prejudicial preconceived notions of who or what a person is only because they got caught while everyone commits some kind of crime breaking the  law as we are not perfect it's enviable doesn't give the right to judge, revoke all amenities and then wonder why there's drug epidemics,  and why people re-offend causing revolving doors. I'm sorry you are having so much trouble.  I hear time and time again that society should be more forgiving in its treatment of ex-offenders and felons looking for jobs.  While this may be true, most of the people I meet consciously committed the crimes they were convicted of and they know of the penalties that come along with getting caught.  That is the risk they take when they choose to play the game.  The rules are clear, if you get caught, you will probably get some time, you will be an outcast of society and it will be difficult to get a job.  Everyone know this, so I have to remind them that they are not victims.  They must accept the fact that they screwed up their lives so they are responsible to for fixing it.  Will it be hard? Yes!  Will they need help? Yes,  all they can get.

My first suggestion is for you to contact the nearest United Way Office.  The United way supports a number of social service agencies that may be able to help your family.  There may also be services that aid ex-offenders and felons looking for jobs and organizations that advocate for them.

Next, you will have to build a job search plan.  First decide what type of work you are qualified to do.  You will then need a resume.  If you do not have one, You may be able to get help at your nearest One-stop Career Center.

Each state has a network of centers that offer a variety of free services that can help prepare you for a job and assist you in finding employment. In addition, these centers offer aid for career training.  You may be able to get training for a career that may not be impacted by your record.

Hello. I was looking online and came across your page. I'm a black female age 34. Two years ago I was 8 months pregnant and the father of my child decided to beat me up right in his front doorway. To get away I broke the living room window right next to his doorway and got away as quick as I could. He called the police I assume because he knew if I beat him to it it would fall on him. I wasn't arrested but had to go back and fourth to court and the stress was causing issues with my pregnancy because I was due to have my daughter. My lawyer told me my options. He said if I wanted to get it over with I could plea guilty and just get a misdemeanor which wouldn't affect me going back to work.  Evidently it has because I'm emailing you. I'm getting turned down left and right because I have a misdemeanor in criminal mischief 4th degree. I have been working since I was 13 and not being able to find a job is taking a toll on me. Any advice you could give would be greatly appreciated.

Hello Roxie,

Not to diminish how you feel, but there are ex-offenders and felons being hired everyday with far worse convictions than yours.  Your lack of success may be more attributed to your approach than your conviction.

Many ex-offenders and felons do not get interviews because they make mistakes on applications.  Your first contact with an employer may be filling out an application.  Employers use applications to decide who to interview and who not to interview. 

Ex-offenders and felons often have a dilemma. "Do I tell the truth and risk not getting an interview?" "Do I lie and hope that no one finds out?" I advise my students to always be honest.  If you are dishonest about having a criminal record, you risk having the truth exposed later.  You may get a job only to lose it after the

employer finds out the truth through a background check or some other means.  You will be fired for being dishonest and falsifying your application not because you have a criminal record.

To give yourself the best chance of getting an interview, you must understand how applications work.  Here are tips to completing an application that will get you an interview.

Follow directions.  Always read the entire application before you begin.  If there is anything you do not understand, ask for an explanation.

Be neat.  Print very clearly using blue or black ink only.  If you don't print well, ask if you may take the application home and bring it back.  Get someone who has neat handwriting to help you.  Always ask for an extra application just in case something goes wrong.  Never, never, never use white out on an application.  Using White out will nullify some applications.  To be on the safe side use an erasable pen.  Never crumple or fold the application.

Answer all questions.  If there are questions that do not apply to you, use the notation “N/A” meaning “not applicable.”  This will let the employer know that you did not overlook the question.  It just did not apply to you.  Completeness counts.  If you have a resume, attach it to the application.  Do not attempt to use the resume in place of a completed application.

Be honest.  Providing false information may be grounds for dismissal later.

Name


Use your legal name.  No nicknames or aliases. 

Social Security Number

If you don't know your social security number, or don’t have the physical card, go to your local Social Security Administration office.  It is listed in the blue pages of your local telephone directory.  You will definitely need this card when you get a job offer.

Address

Use your current address.  Some applications ask for a previous address.  If you do not have a permanent address, ask to use an address of a friend or relative.

Telephone Number

The employer must have a quick and easy way of getting in touch with you.  You must have a telephone number on the application.  If you do not have access to a telephone, I suggest you make arrangements with someone to take messages for you.  Some applications have a space for a message number.  If you find one that does not, simply place the letter “M” before the telephone number.  Ex. M (555) 555-5555.  This will make it clear that the number is for messages.  If you use a cell number, be sure to have a professional sounding message.

How Did You Hear About Our Company?

The employer may want to know how you found out about the company or the opening.  Typical responses are:

Newspaper Ad

Referred by someone (give the person’s name.)

Walk-In

Position Applied For

Be precise about the position you are applying for.  Have a particular job in mind when you apply.  If you are uncertain, contact the company to ask  exactly which positions are available.

Date You Can Start

Never answer “immediately” or “ASAP.”  If you are available today, use today’s date or a date that you will be available.

Salary Desired

I encourage my students to never list a dollar figure.  Never talk about pay or benefits until someone offers you a job.  You may use a figure that is too high and may not be considered because you are asking for more than the position pays.  You may use a figure that is too low and undervalue yourself.  To be safe, use the term “negotiable.”  This means that you will discuss salary when an offer is made.

Education

Starting with your most recent training, list any courses, workshops, seminars, or employment training.

General Information/Special Skills

List any special skills you have that will be of use to an employer. 

Work History

List your past jobs in order beginning with the most recent and work you way backward.  Use the month and year that the job began for you, and the month and year the job ended for you.  If you are unsure of employers and dates, you can contact your local Social Security Administration office.  If your past jobs were on the record, the Social Security Administration should have this information.  You will also need the former employer’s address, telephone number, and supervisor’s name.  Often the application will ask for the name of the position and your pay rate for each job. 

The application will also ask for you to describe your duties, and reason for leaving.  Accepted reasons for leaving are:


Left for better position

Promoted

Layoff

Resigned

Business closed

Seasonal position

Temporary position


Never use the words “fired” or “terminated” if you left a job unfavorably.  “Released,” “involuntary separation,” or “contract ended,”  sound a whole lot better.

If you have military experience, list the branch of service, date, and rank of discharge.

Have You Ever Been Convicted of a Crime?

This question is the worst part of any ex-offender’s job hunt.  I have spoken to people who have taken classes that have instructed them to use the response “Will discuss at interview.”  In my opinion, this is not a good thing to do.  The best advice I can give is BE HONEST!  Employers have a responsibility to know as much as possible about potential employees.

Many applications have a Certification/Release Statement that the applicant must sign before the application is accepted.  You'll recognize it as a long paragraph in small print at the end of the application directly above the space for your signature. Read it carefully before you sign. This statement may also be called an Authorization.  The wording may vary but the employer is asking you to certify with your signature that all of the information you have given is correct.  The answer “Will discuss at interview,” does not answer the question.  Another part of this certification is a release that gives the employer access to information provided by past employers, law enforcement agencies, schools and other organizations that may have information about you.

In reference to criminal records, it is necessary to list all relative information.  Include the name of the conviction, date, location, and the disposition (time served, fine and/or probation.) 

Example:

Criminal Mischief 4th degree.    6/19/2011    Seattle, WA     Probation Served (6 mos.)

You may have to practice to fit your response into the space given.

Hello, my name is Kevin.  I live in New Jersey.  I've had a few drug charges in my past.  I was put on pre-trial intervention. in 2006 for possession of magic mushrooms, but towards the end of my P.T.I. I messed up again and got caught with possession of heroin (felony) in 2008.  I regret a lot of the things that I've done in my past, but people make mistakes, and I'm trying to change my life around.  People do change.  It's hard to get away from the past when it keeps coming up and haunting your future.

I've been off of probation for about 2 years, but I can't seem to land a job.  Every company I interview for asks about my criminal background, and I don't lie about it.  I thought companies like honesty.  Everyone has said they can't hire felons.  Nobody will give me a chance.  I've been on unemployment, but it's running out soon.  I don't know what to do.  If I didn't have the support of my family I don't know what I would be doing.

I've been applying to warehouse jobs, since my last job was a picker/packer at a warehouse.  I also have forklift experience, but I am not certified.  My question is how do I get a job, and down the road is it possible to get my felony charge expunged, since I have more then one charge?  Also are there any temp agencies that work to help felons get jobs?

I'm sorry you are having so much trouble.  I tell all ex-offenders and felons looking for jobs to apply for as many jobs as they feel they are qualified for.  Remember, even a blind man will hit something if he throws enough rocks.  The key is finding enough jobs to apply for.

I encourage every felon to visit your local One-stop Career center.  There you will find a lot of services that can help you land a job.  Among those services are listings of open jobs in your area.  You can get one-on-one job search assistance from trained counselors.  You can find your local One-stop Career center here:

Supermarkets may also hire ex-offenders and felons for their overnight crews.

Many companies hire ex-offenders and felons. I am in Southern New Jersey.  My students are often hired at Wal-mart, Home Depot and Lowe's.

As far as applying for employment at temporary agencies, my students have more success with smaller independent agencies as opposed to nation-wide companies.  In most cases, the large companies have regulations from their corporate offices that prohibit the hiring of ex-offenders and felons.  Independent agencies are free to hire anyone they feel would be a good employee.

Unfortunately the state of New Jersey only allows one felony expungement which one cannot even apply for until ten years has passed from the date of the completion of the sentence.

Mr. Mayo,

My sister  is a convicted felon for the 2nd time for DWI's.  She lives in Angleton, Tx.  She is a hard worker.  She has mainly done construction throughout her lifetime but she is getting too old to continue this type of work.  She has been to the WorkSource numerous times and she continues to look for employment; but she is getting really discouraged.  I have been online to find a list of company names that hire convicted felons and have now wrote them down.
Is their anything else you can think of that might help her seek gainful employment?

I'm sorry your sister is having so much trouble.  The good news is that people with DWI get hired everyday.  It is my experience that people with DWI tend to have more success finding jobs in the retail or hospitality industries.  Employers in these fields want people who will be reliable and punctual.

Hi Mr. Mayo,

My fiance is up for parole in March 2014.  His family and I are trying to find job leads and scholarship programs that will help him once he is released. He has good behavior in prison and has held a job in the prison kitchen. All this will look good to the parole board.  He is an excellent artist and wants to be a graphic artist and also learn computer animation.

He was convicted of robbery and possession of a weapon while committing a felony.  He was 18 at the time and has done six years if a 12 year sentence.  He has an excellent chance of parole if can prove he has some type of direction and goals.  What I want to know is, where can he get an education in graphics that he wants and can he get any type of scholarships or grants to do what he wants to do?  How can he do this?  What does he have to do?  I know that if he can get paroled, he will prove that he is not that same person that committed that crime when he was a kid.

 Felon wants a Career in Graphic ArtsYour fiance seems to have a good support system that he will need when he is paroled.  As far a him pursuing a career in graphics, I suggest first contacting your local community college.  Community colleges are not just for degrees anymore.  Many community colleges these days offer career training for growing
occupations.

Speak to the financial aid office at whatever college you look into.  They will be able to tell you which financial aid programs if any, your fiance may qualify for and how to apply.  It is in their best interest to give you good information.  If your local college does not offer the courses he is looking for, they will tell you who does.

Veterans looking for JobsMy husband is a retired army veteran with a few minor misdemeanors and a Wanton Endangerment charge. Any ideas of a network or job market we could job hunt in? The Wanton Endangerment is from an ex girlfriend claiming to point a gun at her. Looks ugly on paper. This was 3.5 yrs ago.

I have a question.  Is the Wanton Endangerment  a conviction or merely a charge?  I ask because employers are more interested in convictions rather than charges.  You may want to get that information.  Most applications only ask about convictions.  No need to list something that is not a conviction.

In regards to networking,  the Veterans Administration has several programs to assist veterans looking for jobs.

Many employers give veterans preference when hiring.  There are even tax incentives offered to employers for hiring veterans.  Your husband may want to point this out when interviewing for jobs.  The Work Opportunity Tax Credit offers employers tax breaks for hiring individuals that are in certain targeted segments of the population.  Veterans are one of the targeted groups.  You can get more information on the WOTC here:
