Facing a stigma, many ex-convicts in the U.S. struggle to find work




Nearly 80 million Americans, or about one-third of the total U.S. adult population, are living with some kind of criminal record.

For more than 19 million Americans, that conviction has led to a felony on their permanent record. And in states like Virginia, that is a stain some are forced to live with for the rest of their lives.

"Are we giving out the potential for someone to reform their life and change, or are we giving them consequences that will prevent them from ever having a life that they never imagined having?" Melod Teymorian, 35, told CBS News. 

Teymorian was convicted of a felony in 2016 for a non-violent drug offense: possession of a controlled substance. He believes the punishment nowhere near fit the crime. Although he has been sober ever since, he said he has been denied numerous employment opportunities and housing.  

"As if you didn't feel bad enough, and you haven't been trying to destroy your life on your own, let's help you," Teymorian said. 

With a sincere and engaging style, Teymorian said he believed that, after each interview, the job was his. 

"They liked who I was and they thought I was a good fit for the job," Teymorian said. "And despite that, because of this possession, as a result of a drug charge, they couldn't move forward."

As luck would have it, Teymorian met David Engwall, executive director for Recovery Unplugged, a rehabilitation center in Northern Virginia. What every employer before him saw as something negative they could not look past, Engwall looked at as a bonus. 

"You see, with a person like Melod, you know, if given the opportunity, and I know there's plenty of people that are like Melod out there, what they will produce will be incredible. They just need to have the opportunity," Engwall proclaimed. 

Engwall has numerous employees with felonies on their records, and believes the term "felon" has been overly stigmatized. When asked what he would say to people who believe felons deserve to be punished their entire lives, his response was simple. 

"I'd say life is incredibly complex," Engwall said. "It's very hard to know the circumstances that lead a person…to how these felonies happen."

"We're allowing this enormous group of people to just sort of waste away and continue to persist in these same issues of employment and housing and access," Engwall added.   

In 2025, Virginia is slated to re-examine its felony law, and look at whether convicted felons will be allowed to expunge that stain from their records. But as it stands today, they cannot be erased. 

"I'm resilient," Melod said. "And I believe that. And that same resiliency that I had to face before I had the job helped when I had the opportunity. I will solve the problem."

I have a criminal record and I can't find a job. I have been filling out applications everywhere. Do you have any advice for someone who has made some mistakes?

I hear this from felons all the time. Please don’t quit. You get nothing when you give up. You may just have to change your strategy. If I am an employer, I probably want to hire someone without a record before I hire someone without one. Most applications will ask about criminal convictions. If you are honest, as I recommend, an employer may not want to hire you.


Felons Should Try Smaller Companies to get JobsA good strategy for finding job openings is to apply to employers directly. Once you have decided on the type of work you would like to do, the next step is to choose employers that could use your services. Felons stand a better chance of being hired by smaller companies rather than larger ones. The owners or managers of smaller companies usually make the hiring decisions. Make a list of employers in your chosen field. Contact each one of them to see if there are positions available and how to apply. The telephone is the best method of contacting employers. You may even get job leads from people you know. Another advantage to applying to small companies is they are less likely to run background checks because they can be expensive.

If you get an interview, make a point to mention the Work Opportunity Tax Credit. To a small business, this may be an incentive to hire a person with a criminal record. The Work Opportunity Tax Credit is offered to employers as an incentive to hire any one of nine targeted groups with barriers to employment, felons included. An employer may receive a credit of as much as $2,400 for hiring a felon. You can find more information here:

I get a lot of questions from ex-offenders and felons regarding expungement.  It is a common belief that getting an expungement is the answer to their employment woes.  Some believe that if they can only get one, they can have their criminal record erased and they can get jobs to move on with their
Ex-offenders, Felons, Expungement and Jobs lives.  There are lawyers who make lots of money from felons and their families hoping to have some miracle worked and their records will gone forever.  Since most employers do background checks, having a clean record will make getting a job easier.  Having certain convictions on your record may be the difference between getting hired for a job or not.  Lets explore some common myths and uncover the facts about expungement.


Myth #1:  Criminal Records are Automatically Erased After a Certain Number of Years


I am not aware of any state that erases records after automatically.  In fact no records are ever removed, they may be made inaccessible to the public.  There must be legal action taken if there any sealing of records.  There is an application process that completed for any type of action to be considered.  Nothing happens automatically.

Myth #2:  Any Records can be Expunged


Expungement is a legal process that not available in all states.  These processes will vary from state to state as to which records can be sealed or expunged.  For example, in NJ where I am, only one felony can be expunged and the waiting period is ten years from the completion of the sentence.  In some states no records can expunged and in others only arrests not convictions can be sealed.

Myth #3:  An Attorney is not Needed 


Never attempt any legal procedure by yourself.  To be certain that any legal  process is done properly, You should always seek the help of a qualified  professional with experience in this field.

Myth #4:  Federal Convictions can be Expunged


Federal convictions can in no way shape or form be expunged or sealed.  The only action that can be taken is to seek a presidential pardon and very few are granted. 


Myth #5:  Expungement Erases Criminal Records


With expungement, sealing or any other process, records will never be erased or destroyed.  Even though certain records will be hidden from the public, they will always be visible to the court system, government agencies and law enforcement.

This a brief list of common myths associated with the the expungement or sealing of recordsBear in mind that these processes are not available in every state.  Every state has its own statutes regarding the treatment of criminal records.  If you are interested in finding out if you are a candidate for expungement, I suggest speaking to an attorney about availability in your state.  I also suggest that you contact your local legal aid office where you may qualify for free advice about this or even help getting it done.  Most legal aid offices are staffed by young attorneys who are anxious to help and gain valuable experience.  To find your local legal aid office, check your telephone directory or contact the bar association in your state.

The Job Market is Cold Blooded out here. I need help I have lost my Job, my Apartment. When people know that you have a record they will not respect you as a working class person. I was fired so a Chef could get my job. I had been there almost one month. I told the Chef about my record he was like can you pass a Drug test I was sure. I passed. I told him my charge was over 20 years old he was like don't worry about that. The Sous Chef wanted my job for his friend so he had the Chef's boss do a background check and the fired me saying I was not doing my job. Two months later I run into a old co - worker they said I was fired because of my record. It's hard out here.

I have good news and bad news. You may have a possibility of having your state record expunged. Often ex-offender and felon job searches begin with some legal assistance. Check with your local legal aid office to see if you are eligible in your state. There you can get the best information on the expungement process as it relates to your state. If possible, you may also get help getting that done there. As far as your federal charges, there is no such thing as the expungement of federal records. You may apply for a federal pardon, but they are rarely given.

Be tough in your job search. Apply to every restaurant you can think of. Even a blind man will hit something if he throws enough rocks.

Felon with college education needs a job
My husband has a felony, the charge is lewd and lascivious. It was an incident that happened about 6 years ago before we met. He had a drinking problem at the time and has not drank any alcohol in the past 5 years. After serving 7 months in prison for this crime he got out and went back to school.

He started at a community college and went on to be accepted to the Kansas University school of business and graduated with a degree in accounting with distinction which is no small feat! He graduated in December of '16 and has since been unable to find a job in his field.

He has had one offer that was later taken back after seeing his charge on paper and several interviews for jobs where I know he would have got them if it weren't for this charge. We tried to get it expunged but were unsuccessful. The judge did say we should try again later as he wasn't saying no forever. My husband is becoming increasingly disappointed and losing hope. He is a great, intelligent and changed man.

What more can we do?

My suggestion is to apply for jobs by letter of application. By applying for jobs this way often allows ex-offenders and felons to get around the application process and never have to mention that he has a criminal record.  Many professional job seekers never fill out applications.  They send application letters to employers.  Take a look at the sample letter below.  It will give you an idea of how to put an application letter together.






































Perhaps the best advice I can give anyone looking for a job, is to apply for all jobs you are qualified for.  Often felons will not apply for jobs because they feel that they will be rejected.  That is not a good practice.  Never eliminate yourself from jobs by not applying.  The more jobs you apply for, the better your opportunity to get interviews.

As far as applying for expungement,  this a legal process that I advise that you don't try without assistance.  I suggest contacting your local legal aid office.  you will find attorneys that can offer low cost and often even no cost assistance with getting this process done in an effective way.

Hello, 


My name is Eric Mayo.  Welcome to my blog.  I have helping ex-offenders and felons get jobs for many years.  Many people with criminal records feel they have no chance at getting jobs. That is far from the truth. Though it may be a bit more challenging to ex-offenders and felons, it is possible to to compete for jobs. To do this, felons must construct a plan to neutralize the effects of having a criminal record. It is definitely going to be more challenging, but the challenges can be overcome by hard work, planning and creativity. I started this blog to offer ex-offenders and felons practical advice and other useful information that can help them get jobs

What I want everyone to understand that jobs are not going to come to you.  You are going to have to go and get them.  Getting a job is tough.  Getting a job with a criminal record is even tougher.  You are have to work harder, smarter and longer than the average job seeker because your record has put you in somewhat of a handicapped position.  No one is going to feel sorry for you.  The only thing that is going to work is hard work.

I will be updating this blog often so make it a point to stop by from time to time to see what questions have been asked and answered here.  If after a while a questions similar to your situation has not been asked, feel free to send me an email with your question.  I may not be able to answer your question right away, so look through the available responses.  Maybe you will find some information that will help you.

The Truth About Felons, Ex-offenders, Expungement and Jobs



Three years ago at the age of 22, I was arrested and charged with Burglary/With Assault or Battery (FL Statute 810.02-2a) and received a third degree felony. At the time I was in school to pursue my nursing degree; however, at this time I am unable to complete it because of my charge. I am soon to complete my probation and although I am currently working in a restaurant, I don't want that to be the end. I would actually like to find a career and not just any job I could take. Would you happen to know about sealed/expunging that would suit me? If I am unable to get it sealed, is there any professional careers that I may enter? I know this question has been brought up many of times, but I am looking for a second chance at restarting my life and being able to live independently.

The Truth About Felons, Ex-offenders, Expungement and Jobs

There are two points that I would like to make. First Sealing / Expungement is not the cure all many ex-offenders and felons believe it is. Every state has its own statutes regarding the sealing or expungement of records. Some believe that arrest and conviction records are totally erased and will never erased and will never be seen again.  In no case will that happen. Some states hide records from public view. Records will always be available to court systems, law enforcement and government agencies.  You will have to find out if expungement is available in your state and if so, how would it affect your convictions and how you could take advantage of these processes. I suggest you contact your local legal aid office. You may find low-cost or even no cost assistance. Once you find out that information, your second question will be a lot easier to answer.

Since records will always be available to government agencies, ex-offenders and felons may find it difficult to pursue careers that require licensing or certification. You may have to to do a little research to find out if your conviction will prohibit you from being licensed or certified in your state. In all other cases, I suggest that you apply for every job you feel otherwise qualified for.

Hi,

My name is Anita, I was convicted of involuntary manslaughter in February of 2003, It was a death by motor vehicle, and there were no drugs or alcohol that contributed to the accident. I received a three years probation, the accident actually occurred on October 2001, I just had to wait for a court date because it was tried by a jury.



On April 2005, I was charged with a misdemeanor for which I received a 1 year probation or until my fines were paid. I received unemployment from the job because they found that I wasn't responsible for the money being missing. I just was too afraid to take it to court because I was afraid of the outcome. My lawyer told me to plead no contest, I didn't want to but I didn't have the $5000.00 it would cost for a proper defense.
Lady Felon Searching for a JobAnyway, I was working for Moore County Schools, and I disclosed my criminal record before I was hired, but they can't find the application. I hadn't been convicted at the time I had started substituting for the school, and at that time it wasn't required unless you have been convicted. However, when I was asked to take on a Teacher's Assistant position in 2004, I had been convicted, and I filled out the criminal record part on the computer at the school. I thought that I was not going to be able to get the job because of my record. To make a long story short, someone called a T.V. station and told them that I had a criminal record. I was then asked to resign from my position.

Right now I have been unable to get a job, and I thought since the involuntary manslaughter charge was an accident that it didn't matter, and the misdemeanor charge wouldn't have any bearing on my job because I didn't work with money. I never got reprimanded for my work performance, and in fact I received great evaluations. I tried to go to a place that helped people with records get a job, but it was limited to those that actually went to prison, or those that had a drug problem. Is there any organizations out there that could help me find a job?

Hello Anita,

I'm sorry your situation is causing you so much stress. As I often suggest to certain people who want to work in schools, try private or charter schools whose hiring practices are more liberal than public school systems.

Often ex-offender and felon job searches require some help from an attorney. Contact your local legal aid
office to seek assistance in getting your criminal record sealed or expunged since they are non-violent offenses. I should make getting a job easier.

I also suggest applying for temporary jobs. Often if temporary employees are good, they are hired on a permanent basis. When applying for temporary employment, it is better to apply at small independent agencies rather than larger national companies. Smaller agencies are free to hire anyone they choose. You do have marketable skills, so you are in a better position than most ex-offenders and felons job 
searching.

with a Criminal Record?

Many felons turn to the newspaper help-wanted to find jobs. Help wanted ads are a good sources of listings, especial for jobs listed by local employers who don't advertise nationally. Though there are often many jobs listed there, the odds of getting a job this way is against them .

Consider this:

A typical want ad will get between 200 and 500 responses. There will a lot of competition for each job.

Jobs listed in the newspaper account for less than 10% of all available jobs. Some advertised jobs don’t exist. In some cases, the opening may have already been filled but
the company must advertise it because of some requirement.

A job that is constantly advertised may be so bad or pay so poorly that the employer may have trouble keeping employees.

Want ads are not a total waste of your time and energy. There are a few advantages to using the want ads to find a job.

Felons can use Newspaper Want Ads to get JobsJob advertisements are fast. Respond to an ad right away, and you could be hired rather quickly.

For many felons, using the want ads to find openings is less stressful than asking others for help finding a job.

Newspaper want ads easily let you know what the job qualifications are. The qualifications are in the ad so you can tailor your resume, cover letter and interview to what the employer is looking for.
Search  for “entry-level” positions. Entry-level jobs generally don’t pay a lot but they offer the opportunity to work on building an employment history and get valuable experience.

Go through all the ads, not just those in the category for which you're interested. Sometimes job openings will be in a completely different section than where you'd expect. For instance, if you're looking for a job driving a truck, you should look in the "transportation" section.

The odds are against you getting a job this way, but a little hard work will increase your chances of getting a job.

Even though there are many listings in the newspaper, for felons, the want-ads may not be the best choice to find the next job opportunity but it is worth a look.

My friend has been out of prison for over 15 years and is losing hope of finding substantial work help maintain his home. Does this Act really work or is this another G. W. Bush "Smoke Screen".

I always tell ex-offenders and felons looking for jobs to depend on their will to work hard. It would be foolish to wait for any program or legislation to solve a problem for you. With or without social programs, felons can only hope to get jobs by making themselves employable enough to compete for jobs on the open market.  This will take a definite plan of action that includes a well written resume, job search and interview skills to start.  It will take hours of hard work.

He can get a head start on his job search by making a visit to the local One-stop Career Center.  This should be the first stop for anyone looking for jobs especially those with criminal records.  He will find a number of valuable services that could get him ready to compete for jobs.  He may also find opportunities for training that could mean a new career.  You can find the closest One-stop Career Center as well as all of the available services here:
