I get many questions from ex-offenders and felons concerning getting jobs.  Sometimes getting jobs is not the best choice for ex-offenders and felons. Starting a business has advantages that traditional jobs do not.  You may have skills that could turn into a successful career or be the start of a great new business. Ex-offenders and felons must weigh the options to determine what is best for them.

There are pros and cons to both choices.

Having a Job 

Benefits - Many full-time and some part-time jobs offer company-sponsored benefits. Frequently, the combined value of these benefits is worth a third or more of the dollar figure salary. Some of these benefits include 401(k) retirement plans,  Health/Dental Care and and paid sick and vacation days.  These are very valuable reasons to have a job.

Skill Building - Most jobs are valuable opportunities to learn skills that can be used to advance at the place you are working or take advantage of opportunities later.

It Creates a Routine - Regular jobs create routines that could be valuable to ex-offenders and felons.  A regular routine makes it easier to plan one's personal life and leaves less time for the types of things that led to trouble in the past.

Steady Income - I job provides a steady income you can count on.  Over time there may be raises and opportunity for growth.

Starting a Business

Be Your Own Boss - With your own business, you are the boss.  Some people really dislike following the orders of other people. 

Unlimited Income - With a job, you are limited to your hourly wage.  Having your own business, your income is determined by your success.  Your future is in your own hands

Make Your Own Hours - Your own business would allow you to set your own hours and work whenever you wish.  You decide how much work you do, when you go to work, when you quit for the day, when you take a vacation, and how long the lunch break will be.

Personal Satisfaction - A sense of accomplishment that comes with starting and building a business from the ground up is wonderful thing. Self-employed people take pride in the services and products they offer and being able to create the living they want.

For a better understanding of what it would take and the pros and cons of business ownership, ex-offenders and felons should speak to people who have done it.  There are benefits to both working at a job and owning a business.  Find out what is best for you.

Hello,

I was convicted of felony DUI in 2008. It cost me an excellent job at Pacific Life. I went to alcohol treatment on my own accord, 6 months prior to sentencing. December of 2008 I landed a systems tech job at First Data Corporation. I worked there for over 11 months before being downsized November 2009. FDC was aware of my record, and the downsizing had nothing to do with it, it was just a numbers game. I have been unemployed since.

I understand the market is tough, and friends and relatives who work for large companies say that employers can be extremely picky in the hiring process now. I'm running out of hope that anyone will hire me. I haven't been able to land a job at a grocery store, fast food, anything. I do a lot of online applications, and wonder if the disclosure regarding felonies automatically flags the app and disqualifies me.

The felony DUI is the only thing I have on my record. I had a couple speeding tickets in high school and college. I've never stolen anything, or assaulted anyone, or committed fraud. I don't know what to do and the situation is getting very grim. My credit is shot because of the gaps in employment, and that has to hinder my job search as well. My resume is attached, just for the heck of it. It shows that I've always been employed, for long periods of time, with some good companies. I'm currently on unemployment, which I absolutely hate having to do, and that will run out by the end of July. I have barely been able to make it, and once that runs out, it's curtains. My father suffered a heart attack a month ago, and his medical bills are piling up. I need to be able to help my family but I cannot. I'll also be in danger of losing my house. If that happens then I am done for, as my credit is so bad I won't be able to get an apartment, let alone another house.

Is there anything I can do to get past this felony and land a solid job? I've had offers to work at bars/restaurants as either a cook or door man, but cannot accept those because my probation does not allow me to go to bars or be around alcohol. Even a job at a convenience store is not possible, because I would be handling alcohol. Lawn services won't hire me because they require a clean driving record. I have a lot to offer, and am the best teammate, worker, whatever, a business could ask for. In 9 months I've had one face to face interview and 3 phone interviews, nothing worked out. I'm on Career Builder, CareerLink, and Monster, all my information is out there and I apply for jobs daily. All I need is a chance. Any information, advice, would be greatly appreciated.

I have a few suggestions for you. First of all I suggest that you contact an attorney. Try legal aid. You should look into perhaps having your original conviction downgraded if possible. I'm not sure what state you live in but you can also look into a Certificate of Rehabilitation. A Certificate of Rehabilitation is a court order, which declares that a person who has been convicted of a felony is rehabilitated. If a petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the granting court and constitutes an application for a pardon. Often a little legal assistance makes it easier for convicted felons to get jobs.

There you will find a variety of service that can help you get a job including referrals for open position in your area. One-stop career centers are under-utilized resources that can really help. You can the center nearest to you here:

Thirdly, I suggest contacting your local United Way office. United Way supports a number of social service agencies that offer assistance to ex-offenders and felons some with DUI.  A person with your education and experience may even be of service to one of the many organization it serves.

Hello,

I am on probation for misusing my expense account and accepted a plea bargain that gave me a Suspended Imposition of Sentence for : Felony Theft Class B. This SIS technically is not a conviction. However, it comes up in background checks and I can't pass the check. Consequently, I can't get a second chance.



Most of the programs that I find are not for people on probation. Do you have any suggestions? I have a degree and 7 years of high level medical sales experience ranging from medical devices to pharmaceuticals?

Your conviction is probably dependent on the completion of the terms of your deferment. Once the terms are completed, the original charges will be dropped. When this is done, you should try to get the charges expunged. I'm not sure how expungement works in your state. In most cases it means having the charges hidden from public view.  The charges will always be visible however to law enforcement, the court system and any government agency.  You should get legal help getting this done.

There are attorneys that make their livings getting expungements done for their clients.  You may be able to get help from your local legal aid office.    If expungement is an option for you, legal aid may offer low-cost or no-cost assistance with this process.  You can find your local legal aid office in your telephone directory or by contacting your state's bar association.

Hello,

I was reading your blog about jobs for ex felons and was curious if you could provide some information. A little information about my history, in April 1982 I was charged with a 1st degree felony charge of aggravated burglary and was told to plead guilty by a court appointed attorney even though I wanted to plead not guilty he said I would be punished for taking it to trial and the judge agreed to probation so I plead guilty and was sentenced to a term of 2 - 15 in Ohio State Reformatory. Well I spent 9 months there and my family got another attorney and he got it reduced to a felony 2 and I was released. I only spent a year on Parole and was released on good behavior so that is 1 felony against me.

I can get a job almost anywhere but I cannot keep it because of the 911 terrorist attacks. everyone now does background checks and asks if you have ever been convicted of a felony
which should not be allowed. Since then I was terminated from a job for no reason and have been charged with unauthorized use of property and it is pending felony 5 but the judge agreed to probation and this happened all because I helped the HR manager with her email and the company found out I did this after I was terminated so they called the FBI and that is how I was charged.

I have a bachelor of science in health administration and an extensive background in information technology but there is no way I will ever work legally again. Any advice or know any companies who hire felons? I am working with state senators to get the expungement laws changed in Ohio but this could take years and the money I have saved up I have been living on is all but gone so I need a job.

That's quite a story. My suggestion to you is to only apply for jobs with cover letters and resumes. Often when ex-offenders and felons apply this way, the question about criminal background never comes up. If it ever does, be honest. Don't focus on your past.  Shift the attention to the things you have done since your mistakes onto what you have done to improve yourself.  Check out the videos below.  It may give a few ideas that could lead to a felon getting a job.

Locked Up, Then Locked Out
My son is 20 and he made a bad choice by hanging out with the wrong crowd and was arrested for possession of a stolen firearm, did a couple of days in jail for ignoring house arrest one day for not coming home on time. My husband has been offered a transfer to Europe and my son's probation is for 5 years.

Is my son allowed to leave the state to go with us to Europe and seek employment there, should this be brought up to his P.O.

Also, will he be able to find a job in Minnesota in the meantime until our move which is at the end of this year? Any suggestions on job searching would be greatly appreciated.

Hoping you can help me, he's our son and I love him so much and want only the best for him.

Hello Mom,

Felons with probation usually have to finish the terms of probation before they can leave the state. I am guessing that he will be in violation of his probation if he leaves before it is finished. To be sure, contact his probation officer.

Possession of a stolen firearm is not the worst charge in the world. Hopefully, it will not hinder him too much.

He can get help on his job search at the nearest One-stop Career center. You can the center nearest you at this link:

On the Rise Bakery gives felons, addicts second chance

I have a 22 year old daughter that is very intelligent, (which upsets me more about what she did) and a dedicated worker who knew she wanted to be a cook since 8th grade. Over the past year, she was dating a whack job that threatened her with a gun. One day while he was working, she went to his apartment and took his gun. Not a bad idea if she threw it in the river; however, stupidly she hocked it using her friends ID. the felony charge is not for taking the gun but using false id to hock it. She graduates the end of the month and cannot find work. 

This is kickoff time for AZ but the big hotels that doing the hiring are doing thorough background checks. She had a great job lined up with Wigwam. In fact, the HR director told her--this is a great company and a ache to work any where in the world. That Friday she was supposed to go to orientation. Unfortunately, the HR Dir. called her and said because of her felony change they cannot hire her. She did a stupid thing--no question there; I told the judge that regardless that we are from New Jersey the closest she had come to seeing a gun was by a policeman and not Tony Soprano. She is really in the dumps. She is seeing a psychiatrist and works with a psychologist.
Do you have any suggestions to help her get her career going?

Felon wants Job as ChefAll is not lost. As I often suggest to ex-offenders and felons who seek jobs in the culinary arts, large corporate outlets may not be the best choice. They often have hiring practices that are determined at the corporate level. She may be better off looking for jobs at independent restaurants and catering companies. Check your local telephone directory and start calling.

Also she may seek assistance from independent temporary employment agencies. Often temporary assignments turn into full time jobs. There are temporary agencies that primarily work with the service industry. Smaller independent temporary staffing agencies are not bound by discriminatory hiring guidelines as larger nation-wide agencies and can hire anyone they choose.

Ex-offenders and felons looking for jobs may have to put in extra work to get hired.

How to Get a Job After You Commit a Felony

Hello,

I would like to ask a question about trying to find a job for someone who is a Grand Larceny offender. I have found it to be very hard in these days and times trying to find a job when you have convicted of a charge such as Grand Larceny. No one want to hire you or even give you a chance. I was convicted 5 years ago. I was able to find a job after I was convicted. But due to the economy right now I was laid off over a year and a half ago where I was a manger at a Bookstore. Since that time I have been blessed to be on unemployment. The unemployment will soon run out and I don't know what I am going to do. It's not hard for me to get a job I just know when they say that they are going to do a background check they will always re-track their offer. So how do I find a job that will work with my charge. I have over 10 years to management and I can't even get a job sweeping the floor. I would take that job if offered, I would like to add. I would like your input if you have the time.

I encourage ex-offenders and felons to apply for jobs using resumes with well written cover letters. Often this will help them get around the application process.  Also, Getting a job with a criminal record is truly a numbers game.  You should apply for every job you feel you are qualified for.  Apply, apply, apply until you find an employer who will give you a shot.

I also suggest contacting your local United Way office. The United Way supports various social service organizations some of which provide services for ex-offenders and felons looking for jobs.

Want to keep ex-criminals on the straight and narrow?

Make it easier to get a job

I have a previous drug charge which I am sealing. Can I still get a good corporate job?

Back in 2016 I was charged with a possession charge which I am not to proud of. I later successfully completed all necessary requirements and now qualify for the option to seal my record. My question is can I still graduate from college and get a good corporate job? I am currently studying to become an administrator in business. Do you know of any personal stories or people with good jobs that have sealed records?

Hello sir,

You are in a better position than most convicted felons looking for jobs. Once your case is sealed, it will only be visible to law enforcement agencies, the court system and government agencies.

I know of many felons who have put their criminal records behind them and gone on to successful corporate careers.  Many companies hire ex-offenders and felons. I tell all of my students not to exclude yourself from any jobs.  Apply for all jobs you feel you qualify for.

One suggestion I have for you is, whenever possible, apply for jobs using you resume and a well written cover letter.  Often when felons apply this way, the question of criminal records do not come up.  If it does come up, talk about the mistakes of your youth and how hard you have worked to overcome that mistake.

I got out Feb. '16 and went and talked to my old boss. I worked for a paving company and it was the the wrong time of year to put me on so I started to draw unemployment and thinking about how to get out of doing labor work. I paved for 2 yrs but I'm a 17 yr journeyman roofer that's another part maybe will talk about that later. The long and short is I have my CDL (Commercial Driver License) with all my endorsements. If I can just get a shot who ever I work for will love me. I've never been fired and have good references but they won't even talk to me can you help me my school sure ain't. I really want to long haul but ain't choosy. I'm 48. The kids are grown and the ex is gone. It's perfect for me. I've always wanted to see the states. Please help if you can or point me in the right direction. I think I've applied on most of the sights.

Your situation may be perfect for a trucking career. Often I meet ex-offenders and felons who have opted for driving jobs.

Here is a page with a good list of trucking companies. A large number of them hire ex-offenders and felons. There are even notations regarding their hiring policies.

Each trucking company makes its own rules regarding felony convictions. Some will employ a driver after 5 years or longer since the conviction. Other companies won't hire felons, regardless. You just need to get on the phone and start contacting carriers.

Without experience you are somewhat limited as to will hire you. Having the felony conviction reduces your pool of companies further. The best thing you can do is make some phone calls.

How to Get a Job With a DUI Record

Three years ago, I was arrested for a DWI with child under 15. It was a difficult case because there was a lot of circumstances surrounding the case. Gastric bypass, anxiety meds consumed, etc. Anyhow, DA pursued prosecution but found a loophole for Deferred for me on this felony. Just in time before legislation closed. Three months before they did actually. Anyhow, I served my two years probation and it ended without incident. I was able to find a great job while on Deferred but only because I knew the person. I had to quit my job due to personality conflict and now I cannot find work anywhere. It is already embarrassing enough to have this charge on my record being a mother, a college student, a respected individual. But now I can’t seem to find work. I’ve applied everywhere and most places tell me I’m overqualified. I can’t get it non-disclosed because it’s an enhanced form of child endangerment. That’s what SOME lawyers say. SOME lawyers say I can. NO lawyer has EVER had a case like this so they don’t know how it would go down. Afraid to waste my money over and over again while lawyers make mistakes trying to figure it out.
I tell the truth on application with the first line stating DEFERRED ADJUDICATION: FINAL FINDING- NO CONVICTION

And then I input the details it asks to explain.  Why IS it so hard to find work for a woman with a DWI? Especially a felony? If it was a man, they would just shrug it off like no big deal and hire them up and shake hands and head out to the bar for a drink. It’s such a double standard. I’m a good person. I work hard. I’m dedicated to what I do. I made a mistake. Even the justice system saw that there was circumstances surrounding what happened and gave me a break. They could have thrown the book at me, but didn’t. Why won’t employers cut me some slack.

For each application you complete, pay careful attention to the wording. Most applications ask about convictions and not arrests. In reference to your deferred adjudication, you must consider the conditions of your deferment. In most cases, when the conditions are fulfilled (usually a fine and probation,) the original charges are dismissed but they remain as charges not convictions. Anyone accessing your record (other than law enforcement, the court system, and government agencies) will only see the charges. For more clarification, contact the prosecutor in your case.

I am a felon, with a drug trafficking charges, just got out of prison a month ago. I was locked up for 5 years. I was interested in a career in Medical Billing and Coding. I applied at the local community college and got accepted. When I was ready to register for classes the head of the program said that I won't be employable. I chose that program because there is no clinical involved and he thinks the record will be a problem. I am from Pensacola Fa. What do you think?

Hello,

My personal feeling is that everyone is employable. The question is will your legal status prohibit you from being licensed or certified in your chosen field. Just a little insight, to my knowledge there are few positions offered as Medical Biller/Coder. The Medical biller compiles and tracks the outstanding balances owed to medical facilities. The function of billing and coding is often part of other positions. It may be a function of a medical assistant or some other position. It often isn't a stand-alone position. I could be wrong, so get some clarification from the school you wish to attend. Also find out if there are any certification or licensing requirements.  If there are restrictions based on your record, ask the placement office if there are any types of jobs where your record won't be as big a problem.  I encourage anyone who is thinking about career training to ask for the placement record.  These schools have placement offices so you can ask what percentage of their graduates get jobs and where.  I would definitely ask these questions before I invest any time or money.

The good news is, medical assistants work in doctors' offices.  Private doctors are free to hire anyone they choose.  Make a good impression and you will get a job.  Never let your past dictate your future.  I encourage every felon to apply for every job they feel they qualify for.  Apply for as many jobs as you can and never give up!

Hello Mr. Mayo,

I love reading your blog.  Thank you for this information.  I have been looking for a job but I have a very serious charge and it is making it very hard for me to get a job.  In 2002, I got into a fight with a guy.  I didn't start it but the guy got beat up pretty bad and later died.  I was charged with assault and involuntary manslaughter.  I have done my time but I feel that this black mark is keeping me from getting a job.

I am not a violent person but this thing makes me look like a monster.  What can I do?

Hello Henry,

That is quite a story.  It's unfortunate that hings turned out the way they did.  It certainly could have been a lot worse.  You could have been the other guy.  Your charge is serious but it is not the end of the world.  I work with ex-offenders and felons everyday and I have had students with similar felonies and they are working to this day.  To employers, theft, robbery and other crimes involving integrity are looked down far more than offenses like yours.

When you apply for jobs you should respond to the "Have you been convicted of a crime..." question this way.  When answering this question you must list four things.  You must list the location of the conviction (County, State,) the conviction, the date of the conviction and the disposition ( final outcome.)  It should look

like this:

Cook County, Illinois,   Involuntary Manslaughter (Isolated Incident,) June 2005, Time served, 13 years.

Notice the notation after the conviction "Isolated Incident."  This tells the employer that this was something that was not planned, it was circumstantial. You will be surprised how well this works.  When you get an interview, the charge will probably come up.  You should begin your explanation of the incident with "I'm glad you asked that question because I want you to be comfortable hiring me......."  then, most humbly explain what happened.

I tell every felon I work with that finding a job is a numbers game.  The more jobs you apply for, the more interviews you will get.  The more interviews you get, the more opportunities you will get to get hired.  Apply for every job you feel you qualify for.  Never eliminate yourself by not applying.

Hello,

I am contacting you after perusing the Jail to Jobs website and the How Felons Can Get Jobs blog.  I am originally from Philadelphia and am planning on returning there after my time at college (out-of-state). I am a convicted felon (over seven years) and will actively be seeking employment in Philadelphia in the coming year. I would like to know if you have any recommendations for re-entry programs or job placement. While it has been eight years since my last arrest, I am sure that I will still find the same difficulty gaining employment as a recently released ex-offender.

Aside from the past two years (enrolled in college since ‘08), I have maintained full-time employment since 2003. Although I have previously worked with various ministries and organizations, because most of the establishments have primarily focused their programming on adjudicated youth and ex-offenders, my past criminal history has not been a concern. However, as a soon to be college graduate with a great deal of life experience, I am looking to possibly expand my horizons.
