Felons should always be honest applying for jobs

Tight job market is good for felons, people with disabilities

and others who are hard to employ

I was arrested in May of 2008 for the charge of burglary. I took a plea agreement that lessened the conviction to Felony Trespassing (3rd degree) in New Jersey. My question is if potential employers will see something like Trespassing as just as bad as any other felony or if I am worrying too much and thinking I will be constantly passed over for jobs because I am grouped in the same "Felony" category as people who have committed violent crimes, robbery, and etc. I have a college degree and 2 years work experience in a media-related field but keep applying to jobs with the notion that my charges are always going to hold me back from getting a job within the field of media, marketing, and promotion. With so many employers conducting background checks, I just want to see how a Felony Trespassing charge looks to them and if I am still hireable. Hello A,

I encourage all ex-offenders and felons to always be honest when applying for jobs.  Your situation isn't as bad as it seems. Trespassing is a relatively minor offense and there are no integrity questions surrounding it. Whenever the question comes up on an application or on an interview, be honest. Typically on an application, the question will be, "Have you been convicted of a crime other than a traffic violation?" You will answer honestly.

In reference to convictions, it is necessary to list all relative information. Include the name of
the conviction, date, location, and the disposition (time served, fine and/or probation.)

Example:

Trespassing (isolated incident) 8/12/08 Newark, NJ Probation 6 mos

I used the notation "isolated incident." It gives the impression that you are not a criminal, but a person that just found himself in a bad situation...something that can happen to anyone. If the question comes up, don't go into detail, just give an answer just like that.

The most important thing I suggest to all ex-offenders and felons looking for jobs is to be honest. there no sense in being dishonest only to lose a job when a background check is done.

Hello, my name is Michael and I am an ex felon. I served 2 years for manufacturing with intent and theft of under $20,000. I was curious as to if I can apply for this bond and if so how do I go about doing it?

With the economy as it is I am having a real hard time finding a job where I live even at Mc Donalds .

A bond is an insurance policy issued by an agency that protects an employer against money or property loss due to employee dishonesty. Certain convictions make many ex-felons ineligible for private bonding.

The Federal Bonding Program is sponsored by the Department of Labor and issued for those who are unable to be bonded privately. The bond is issued at no cost to the employer and may be an incentive to hire an applicant. Criminal records become less of a concern to employers if they know that they are protected from loss of money or property due to theft. An applicant can be bonded the same day the job offer is made. Federal Bonding Program can help felon get a job

I was convicted of 2nd degree felony securities fraud in Salt Lake City Utah. My background is in financial services (mortgage lending specifically). My felony conviction obviously limits me greatly as far as my ability to license etc. and provide for myself and my family.

Is there a fidelity bond or some other type of program that I could participate in that would allow me to work in financial services again? A fidelity bond would need to be for a higher dollar amount than the 25k currently offered.

I have contacts at a bank who are willing to consider me if I can provide some sort of fidelity bond to mitigate the risks. Any suggestions would be greatly appreciated?

Take the completed form to your local One-stop Career Center. Ask for the person that handles requests for federal bonding. That person will be able to explain the bonding process in further detail.

Are employers finally giving felons a second chance?

I'm a felon, convicted of mortgage fraud in 2005. My charge stems from a 1998 business deal and resulted in 5 years probation. I've accepted my situation and remained gainfully employed through my small business until 2009. Now, small business owners are subject to background checks before being awarded government contract. All small business certifications require background checks on the owner before the certification is granted.

Needless to say, my contracting career is over even though I have 13 years of outstanding references from government agencies. Every contact I have will say their hands are tied when it comes to hiring a company whose owner has a felony conviction. I had to shut down my business (53 employees) and look for work. I hold a master of science in technology management and a master of business administration and I have over 20 years of IT experience.

I have been looking for a job since February 2009. After posting my resume online, I get 4 to 5 responses a week. I disclose my situation during the telephone interview and it goes not further. Most companies will say it's their policy not to hire anyone with a felony conviction. Unfortunately, in the Washington DC area, every job now requires a background check - even McDonalds.

 

After much research, I found the Second Chance Act of 2007. The Second Chance Act is designed to improve outcomes for felons returning to communities from prisons and jails via employment assistance, housing, mentoring, etc. Well, the Second Chance Act does not apply to felons that received probation. As a felon that has paid my debt, improved myself through education, and function as a law abiding citizen, I am not given a second chance. I currently receive unemployment compensation, which is 1/3 of what I need to cover mortgage, electricity, water, phone and food. I am absolutely one step from homeless and hungry (with 2 masters degrees). Any suggestions?

Hello Homeless,

Ex-offenders and felons with skills and experience are in far better shape than those without. You simply have to be more creative about how to employ your skills.

Firstly, I suggest contacting smaller independent IT contractors. You could subcontract through them and not be subject to the same scrutiny as primary contractors. Get the telephone book and get to work. There has to be at least a few that could have a job for you.

Companies are given a $2400 tax credit for hiring felons and there is a Federal Bonding Program for at-risk (felon) employees.  See the link below for information about the Work Opportunity Tax Credit

Secondly, I suggest considering starting a small business setting up home computers and networks. In this day and age, people buy computers (often more than one,) but don't how to set them up or connect them to each other. you could start with just a few flyers. Just a 
suggestion.

I am currently seeking my Bachelors and soon to be my Masters in the Field of Psychology. I was hoping to become a Clinical Psychologist however I was wondering if there are any laws that prohibit a felon that was convicted of a Violent crime (Vehicular Homicide Disregard to the safety of others) from working in this field. If I can not do Clinical Psychology is there a possibility in the Research side of Psychology. I am currently living out of the country but hope to be moving back with my husband as I begin my masters in 2011. I know that Medical field is generally out for violent criminals but it has been 7 years since I was convicted and 5 years since I finished all my Probation and jail time. Do I have any hope of finding a position in Clinical Psychology in the United States or should I focus on Research Psychology...?

Hello,

Obtaining a job in your field depends on whether you can be licensed or certified. I suggest you contact the licensing board in your state to see if your conviction will be an obstacle.

Often ex-offenders and felons need a little legal assistance in their search for jobs. I have had students with Vehicular Homicide convictions downgraded to Aggravated Assault which is a lot easier to work with. Contact an attorney to see if this is an option in your state.

Do felons list “Deferred Probation” on Job Applications?

I have a previous misdemeanor assault on a family member on my record. I currently on probation deferred for assault on a family member that is classifies as a felony. Do I list the felony on an application, even though I am on deferred probation? I read somewhere that the felony charge will not show up on a background check. How accurate is that? I reside in Houston, Texas. I do have an advantage, I served honorable in the military for six years. I am now in the Inactive Ready Reserve. My obligation will end in two years. I need advice on what to put on an application. How do I explain myself while in an interview?

Hello Ramiro,

Your question not easily answered and I can see how that can affect a felon job search. Deferred adjudication, withheld adjudication, deferred probation all fall into the same basic category.  In most cases, adjudication is withheld pending some other action, usually successful completion of the terms. These terms are typically a fine and probation.  If you successfully complete the terms, in most cases the charges are dismissed. When you complete the terms you will be given a document declaring the charges dismissed.

My suggestion to you is to contact the prosecutor or court officer that is assigned to to your case and inquire if the charge was indeed dismissed.  If it was dismissed, you can answer "no" to the conviction question. This is not intended as legal advice, just information.  For more detailed information as it relates to deferment in your state, you should get help from a qualified legal professional.  I suggest your local legal aid office.  You should be able to get low-cost, probably no-cost assistance.

Hi my son was charged with 5 counts of grand theft.  He happened to have drug problems.  He went through a court options program and completed.  I am in process of getting charges expunged.   In the meantime can't get job.  All places check records. He is 22 and now is very sad we put him in rehab and is drug free for 7 months now don't want this to head him back to drugs! Any suggestions?

Your son should be proud that he has the kind of family who is strong enough to exhibit the type of tough love that he needs. Many of the felons and ex-offenders I deal with do not have that type of support.

In relation to his convictions, five counts of grand theft is not the worst case I've had to deal with. He probably will not have a chance at jobs that any kind of valuables will be at risk. I suggest he try getting a job through a temporary agency. Temporary agencies are a great way to quickly get back into the working world. Many employers use agencies to try out new employees before hiring them. Good workers are hard to find. If an employer sees that he is hard working, punctual and fit in well, he may offer the job permanently. Some other advantages to using a temporary employment service:

He can try different types of work and develop new skills which can be used later.

He can make new contacts.

Build a work history.

Earn a wage until you can find permanent employment.

He probably will have better success looking for small independent agencies that have fewer hiring restrictions than larger national companies and are free to hire anyone they choose. He will be able to get a list of these agencies in your local phone directory.

He can also go to your local One-Stop Career Center.   Each state has a network of centers that offer a variety of free services that can get him ready for work and assist him in finding employment. In addition, these centers offer training programs that may prepare him for a career.

Some services available are:

Career planning and counseling (often counselors have experience in assisting ex-offenders and felons)

Resume Writing, Interviewing Skills

Computers with internet access and word processing

Daily access to thousands of job listings Job postings and referrals Printers, fax machines, phones, and copiers for job search use

I just stumbled upon your blog and I think its a really great thing you have here. I have some convictions from back when I was a teenager. Three drug charges, which were all at the same time, one of which is a felony. And also I simple larceny charge. I got caught steeling glow sticks at the grocery store when I was 18. All my mistakes I made when I was a teenager haunt my everyday now that I'm an adult. Recently I moved to Florida from Michigan. And I'm finding it very hard to find a job here. I was interested in possibly working in the medical field, however, every time I go to apply for one they seem very strict about having a criminal background. 

I know that anything is possible when I comes to being motivated. Do you think I'm wasting my time with the medical field? Sometimes I feel like I'm getting nowhere. I spent over 300 dollars on a Certified Nursing Assistant prep class and now I'm about to take my CNA test, that is if the state allows me to after they check me out. I'm preparing myself for a big let down even though I feel I've learned a lot and gained much out the experience. If they don't allow me to take the test should I take a different direction other than the medical field? After I quit drugs and everything 6 years ago I went back to school got my diploma and then continued on to college. I felt like I could do anything that I set my mind to. My dream is to be an art teacher. However, I keep getting people telling me I cant do things because of my past. I have even had people tell me not to go to college because I'm wasting my time. What do you think about that? Am I going to be making minimum wage for the rest of my life even if I'm lucky enough to get hired at that?!

They will be able to advise you of licensing restrictions relating to your conviction. Also don't give your dream of being an art teacher. Too many ex-offenders and felons believe having a criminal record eliminates them from good jobs.  Considering your background, you may not be eligible to teach in public schools but there are other options. Community colleges adult learning annexes, private and charter schools are great places to start. They usually have fewer regulatory restrictions than public school systems.

Hello,

I was reading your blog about jobs for ex felons and was curious if you could provide some information. A little information about my history, in April 1982 I was charged with a 1st degree felony charge of aggravated burglary and was told to plead guilty by a court appointed attorney even though I wanted to plead not guilty he said I would be punished for taking it to trial and the judge agreed to probation so I plead guilty and was sentenced to a term of 2 - 15 in Ohio State Reformatory. Well I spent 9 months there and my family got another attorney and he got it reduced to a felony 2 and I was released. I only spent a year on Parole and was released on good behavior so that is 1 felony against me.

I can get a job almost anywhere but I cannot keep it because of the 911 terrorist attacks. everyone now does background checks and asks if you have ever been convicted of a felony
which should not be allowed. Since then I was terminated from a job for no reason and have been charged with unauthorized use of property and it is pending felony 5 but the judge agreed to probation and this happened all because I helped the HR manager with her email and the company found out I did this after I was terminated so they called the FBI and that is how I was charged.

I have a bachelor of science in health administration and an extensive background in information technology but there is no way I will ever work legally again. Any advice or know any companies who hire felons? I am working with state senators to get the expungement laws changed in Ohio but this could take years and the money I have saved up I have been living on is all but gone so I need a job.

That's quite a story. My suggestion to you is to only apply for jobs with cover letters and resumes. Often when ex-offenders and felons apply this way, the question about criminal background never comes up. If it ever does, be honest. Don't focus on your past.  Shift the attention to the things you have done since your mistakes onto what you have done to improve yourself.  Check out the videos below.  It may give a few ideas that could lead to a felon getting a job.

Should You Hire Someone

with a Criminal Record?

Many felons turn to the newspaper help-wanted to find jobs. Help wanted ads are a good sources of listings, especial for jobs listed by local employers who don't advertise nationally. Though there are often many jobs listed there, the odds of getting a job this way is against them .

Consider this:

A typical want ad will get between 200 and 500 responses. There will a lot of competition for each job.

Jobs listed in the newspaper account for less than 10% of all available jobs. Some advertised jobs don’t exist. In some cases, the opening may have already been filled but
the company must advertise it because of some requirement.

A job that is constantly advertised may be so bad or pay so poorly that the employer may have trouble keeping employees.

Want ads are not a total waste of your time and energy. There are a few advantages to using the want ads to find a job.

Job advertisements are fast. Respond to an ad right away, and you could be hired rather quickly.

For many felons, using the want ads to find openings is less stressful than asking others for help finding a job.

Newspaper want ads easily let you know what the job qualifications are. The qualifications are in the ad so you can tailor your resume, cover letter and interview to what the employer is looking for.
Search  for “entry-level” positions. Entry-level jobs generally don’t pay a lot but they offer the opportunity to work on building an employment history and get valuable experience.

Go through all the ads, not just those in the category for which you're interested. Sometimes job openings will be in a completely different section than where you'd expect. For instance, if you're looking for a job driving a truck, you should look in the "transportation" section.

The odds are against you getting a job this way, but a little hard work will increase your chances of getting a job.

Even though there are many listings in the newspaper, for felons, the want-ads may not be the best choice to find the next job opportunity but it is worth a look.

Greetings,

I was able to read your website, and I am interested in your philosophy. I am a 28 year old felon in Alabama. My crime was credit card fraud and ID theft. Since it was my first conviction, I was granted 1 year parole with court costs. Even though the punishment is light, I am unable to find a job to help pay off the dues and support my family.

I have learned of the Federal Bonding Program, but it doesn't seem to be getting me anywhere. I have been on many interviews where I have put the crimes on the application, but they insist on running a background check, which of course comes up with the convictions. Then they say that I cannot be hired, even though it was on the application before you ran the social security number through. 

I keep trying somehow, someway everyday; and, I am not picky about jobs. I apply for general labor positions as well as a way to get on my feet. I apply with resumes and cover letters. Is there something else I am missing? Any advice would be welcome.

Job Opportunities for Felons

Hello Jay,

I'm sorry you are having so much trouble. Finding a job unfortunately is not an exact science. Finding a job with a criminal record is even tougher.

I suggest to all ex-offenders and felons looking for jobs to tell everyone they know that are looking for employment. Many people got their job leads from people they know. This is called networking. Networking is the most effective method of finding employment leads. Most jobs are never advertised because they are usually filled by personal contacts. In fact, employers would rather hire someone referred to them by people they know rather than to painfully sort through resumes and applications. How many people do you know? Each one of them could potentially help a felon get a job.

• Friends
• Relatives
• Neighbors
• Parole/probation officers
• Members of your religious group (especially ministers, priests, imams, etc.)
• Former teachers
• Former co- workers
• Former employers
• Classmates
• Casual acquaintances
• People you do business with (Hairstylists, barbers, doctors)

Look at the list above. In each group, list five people that you can contact. That is at least 55
people that could help you in your job search. Let each person know that you are looking for a job
and that any information they have for you would be helpful. Have copies of your resume handy
for your contacts to give to other people.

Another suggestion is to locate your local Goodwill. Goodwill hires ex-offenders and ex felons everyday giving them an opportunity to re-enter society.

I suggest to all felons looking for jobs to visit their local One-stop Career Center.  At the center you will find services than can help you find a job including resume preparation, interviewing skills and lists of available jobs in your area.  The center has counselors that provide one-on-one  assistance to get you on your way.  The counselors can also put you in contact with resources that could help you with your growing family.

Mom wants to help felon get a job

Locked Up, Then Locked Out

My son is 20 and he made a bad choice by hanging out with the wrong crowd and was arrested for possession of a stolen firearm, did a couple of days in jail for ignoring house arrest one day for not coming home on time. My husband has been offered a transfer to Europe and my son's probation is for 5 years.

Is my son allowed to leave the state to go with us to Europe and seek employment there, should this be brought up to his P.O.

Also, will he be able to find a job in Minnesota in the meantime until our move which is at the end of this year? Any suggestions on job searching would be greatly appreciated.

Hoping you can help me, he's our son and I love him so much and want only the best for him.

Hello Mom,

Felons with probation usually have to finish the terms of probation before they can leave the state. I am guessing that he will be in violation of his probation if he leaves before it is finished. To be sure, contact his probation officer.

Possession of a stolen firearm is not the worst charge in the world. Hopefully, it will not hinder him too much.
