Hi,

I am 26 years old and have never been arrested and I am currently in college pursuing a diploma in Allied Health and I was arrested in October for a felony under the wrong title of Unemployment Compensation Fraud even though I tried to explain that I never received any unemployment and showed letter stated the same stating ineligible it didn't matter. So when I went to court I was unable to afford a lawyer and had to settle for a public offender explained that the case was in reference to public assistance which I agreed to make payments because of a simple mistake of reporting a beginning date of employment. I was back and forth with communication with DCF explaining to them that I was no longer employed and a full time student but DCF reported not receiving payments and I was arrested. At court the defender told me State Attorney wanted to make a deal that I have no conviction, plead guilty but be withheld, pay restitution, and no parole and that it would not be on my record but I found out the hard way that it was because of my apartment complex that charge is showing as a FELONY..so my question is will I still be able to obtain employment even though I wasn't convicted but arrested because employers will only see FELONY.

Can felons with Withheld Adjudication get jobs?
I'm not an attorney but it sounds like you have what is known as a Withheld Adjudication. In that case you may have to find out exactly what the conditions are. In most instances, once the conditions are met (typically a fine and probation,) the charges are dismissed. They will however appear on background checks as charges but not convictions. Anybody doing a background check (other than law enforcement,the court system, and government agencies) will only see the charges. Typically employers are only concerned with convictions and not charges. To be absolutely sure, contact the prosecutor associated with your case.

If you are still concerned with the charge, you may look into expungement. Many ex-offenders and felons looking for jobs seek legal assistance. I suggest contacting your local legal aid office to see if expungement is an option for you.

Does expungement help ex-offenders and felons looking for jobs?Hello,

I am writing to find out is there any professional job that I can obtain because of the felony that I have from 2007? I have a Domestic Violence felony that I was convicted of in 2007 due to the fact that it was a dispute between me and my first wife. I am located in Texas and wanted to know, is it possible for me to get it expunge or sealed? Because I am relocating to Florida with my current wife and I have one course to finish to have my nursing licenses....I wanted to know if I get it sealed or expunge in Texas,. could I obtain my license in Florida? Or if I cannot get it sealed or expunge in Texas can I still obtain my license in Florida since it is a Texas Felony? I don't know how long I have to wait to get it expunge or sealed in Texas....I don't know the process to even start.

Hello,

If your conviction is in Texas, a Texas court would have to expunge or seal it. There is a twist to expungementExpungement or sealing does not erase records but hides them from public view. If an expungement is granted the conviction will always be visible to government agencies, the court system and law enforcement. Licenses are granted by some level of government.

Many ex-offenders and felons looking for jobs seek legal assistance. I suggest contacting your local legal aid office first to see if expungement or sealing are viable options and then to get help applying for it. I would never try to do it alone.

I was convicted in the state of Florida for 5 counts of fraud I did my probation 2.5 (was given 5) paid restitution and now looking for work why is is that when an employer does a background check on me the status says active? Next I am in the process of trying to get this sealed/expunged. When that is settled will I be able to get a security license so I can work as a security guard or how about my RN license as I am currently in school working on that, am I wasting my time?

Unfortunately many people believe that sealing or expungement of records will erase their criminal records. In most cases and in most states, expungement means that their convictions will invisible to the public. The will always be visible to law enforcement, the court system and government agencies. Since most licensing is done through state agencies, expungement will not help them.

Many ex-offenders and felons looking for jobs seek legal counsel before the can start an effect job search just to see how their records will impact their ability to get jobs. I suggest contacting your local legal aid office to see just how viable an option expungement is for you. Next I would contact the agencies that issue the licenses you want to see if you are eligible.

My husband just relocated here to Atlanta to be with his family. He is a convicted felon. It has been hard for him to find a job for many reasons. For one, I work two jobs to support us and he stays home with our two youngest children (we have 5) during the day. Secondly, we do not know a lot of people here in Atlanta,GA to network with. And of course....its hard to get a job period, add a felony to it and it is even harder!

We are searching for possible job search programs that will help us get childcare and help him be able to look for employment. I am on waiting list for assistance for childcare but I have been waiting for months. We can not afford childcare without him working. It is only by Gods grace that we have made it this far. Any advice or suggestions would be great!!!!

There he will find a variety of services that can not only help him find a job but perhaps training for a new career. These centers are underutilized resources for ex-offenders and felons looking for jobs.  Among the resources you will find are current lists of job openings in your area.

Another great resource for ex-offenders and felons is Goodwill of North Georgia. Goodwill operates a computerized training center that provides career alternatives for unemployed and underemployed people.  Your husband can get specialized training to be certified in the following trades:

I bumped into this article on line. I'm from Sarasota Florida. I have two felony charges for drug possession. One is thirteen years the other eight years old. Will I be able to get my certification, or will I be denied because of these charges. I have completed all terms of probation years ago and have since turned my life around. Still I have much anxiety and guilt when I have to apply to any situation. I'm a wonderful person and have been in the home health business for a few years as a companion caregiver. Anything I can do?

Hello my name is Shantell and I'd REALLY appreciate any help at all that you can possibly provide me. My man is a felon he is currently in work release in Steelton, Pa. The rules there are extremely strict. It's hard for him to go out and look for a job. He is a good man even though he is a felon. His crimes are not violent they're mostly drug related. I have been trying so hard searching the net for jobs for him and I keep coming up with dead ends. So I was wondering if you could possibly help me in any way possible. Maybe you know some companies in Steelton, Pa. or Harrisburg, Pa. He is a very hard and devoted working man he has just made some mistakes but who hasn't you know. There are a lot of people without criminal records out of work. As I suggest to a lot of ex-offenders and felons looking for jobs, the first stop should be your local One-stop Career center. there are a lot of service that can help him get on the right trackCounselors at the center can help him with resources that can help him get a job or even get training to start a new career.  many counselors have experience working with people with criminal records.  You can find the nearest career center here:

Found your website while searching "felon" info and thought I would take a chance.

When my son was 19, he had come home from college for the summer, earned his black belt in Tae kwon Do, and made the mistake of having a relationship with a 15 year old girl in his karate class. She was working on her black belt and had an immense crush on my son...and vice versa. They had known each other for several years--and were both very talented "karate kids."
Anyway, they broke it off when he went back to school--but remained friends.

The young lady went to counseling a year later for some unrelated family issues and revealed that she had a boyfriend a year ago and they had sex. Bingo...the therapist calls the state, the state arrests my son, who is now 20 almost 21, and presses charges...4 counts of sex with a minor. Neither girl nor her family pressed charges against my son. In addition, we were told that because he had recently earned his black belt degree that he was considered "someone of higher responsibility" and that is why the state decided to prosecute. I might add that he was in the process of applying for the Indiana State Trooper program--was almost there! BIG NIGHTMARE for our family since this son was the one who never drank, partied, smoked...just a good, sweet, loving kid and born again Christain... who did something really dumb based on emotion.

The deal was this, 6 months house arrest and 3 years probation which we have almost completed...without grumbling I might add. Felony reduced to misdemeanor as soon as probation ends actually on 9/16/10. He has been planning to join the military... to do good in the world and serve the country he loves. What are his chances? He talked to an recruiter (about 6 months ago) about Indiana air guard and was told not just no-- but never.

 I know quite a few young men in your son's same situation. The good news is that his charge will be downgraded to a misdemeanor.  From time to time the military grants waivers to recruits who have criminal records.  Most are moral waivers, which include some felonies and misdemeanors.

The only military branch offering waivers to ex-offenders is the Army. He may find more success there.  The Army recruiter will tell him exactly what to do to get the process started.  It is totally up to the Army to grant the waiver.
