Felon with Withheld Adjudication seeks Trucking Jobs

Felon with Withheld Adjudication seeks Trucking Jobs

Felon with Withheld Adjudication seeks Trucking JobsHello, I was reading your site and have a question. I have a felony that was withheld adjudication on a constructive possession (a passenger in my car had drugs) a little over 4 yrs ago and that's it. But I can't get a job anywhere I've looked. I also don't have a CDL but can get one either through job training or school. I know about Carolina Cargo but that's it. Do you have any info on any other companies out there who will take a non experienced driver or newly trained driver with a background showing I plead guilty  but was with held? I was unaware at the time that this was pretty much no different than pleading guilty and being adjudicated with a sentence.

 Thanks.

Felon with Withheld Adjudication seeks Trucking Jobs

Hello,

Withheld Adjudication is not necessarily a terrible thing.  I get a number of inquiries regarding withheld adjudication / deferred judgement /deferred adjudication. Ex-offenders and felons looking for jobs should understand what it means because it could affect their ability to be hired for some jobs. Withheld adjudication / deferred judgement/deferred adjudication generally relates to a determination by a judge to place a person on probation without a judgement of guilt. There will be terms set by the court, usually a fine and a period of probation. Once the conditions are fulfilled, the charges are normally dismissed. There will be no conviction related with that offense. If conditions are not met, a finding of guilty may be entered and the person may be sentenced according to the penalties specified for the offense.

So when completing an application that asks if you "Have you ever been convicted of a crime, you can answer "no" and rightly so because you haven't. The original charge will appear on a background check simply as a charge and not a conviction.  To absolutely certain of the status, you should check with the prosecutor or your probation officer associated with your case.  This is not intended as legal advice, simply general information. If you really concerned about the charge itself (employers are rarely concerned with charges.  They care more about convictions) you may look into having your charges sealed by the court.  Sealing is a legal process that conceals the charges from public view.  The charge will only be visible to the court system, law enforcement and government agencies.

Felon with Withheld Adjudication seeks Trucking Jobs
As for trucking jobs for felons, the site below has a good list of trucking companies. A large number of them have hired ex-offenders and felons. Some have their hiring policies as they relate to ex-offenders and felons included.

Each of the companies listed makes its own rules regarding felony convictions and the hiring of felons. Some will employ a driver after 5 years or longer since the conviction. Other companies won't hire felons, regardless. You must contact each carrier to find out exactly what their policy is concerning the hiring of felons.

I hope this helps.

Ex-offender in need of help and a job

Ex-offender in need of help and a job

Ex-offender in need of help and a job
Hello, I came across your site and thought I'd ask for advice. I have a petit theft charge from 2008, ever since then I have not been able to find a job. Went into a huge depression for 2 years because my relationship was heading south and I was unable to find work. I actively searched, landed a few jobs, lost them due to my charge. Since 2007 I have been in a serious relationship. I'm in love but it's affected us. In order for us to be together I chose to live in his mom's house where I felt ostracized. She had an abusive relationship with her partner and I wanted us out. I landed a job and we saved our money for an apartment (which was also hard to find because of my record), and we moved out. two weeks later I lost my job. I am unable to find another job and I don't know what to do, I can't receive unemployment I haven't worked. I am ineligible for assistance. We have no car. I don't have money to take the bus to look for a job. I am lost and I will lose everything if I don't fix this fast. I am lost.

Ex-offender in need of help and a job

I'm sorry you are having so much trouble. It seems to me that you are in need of social services as well as a job. Often ex-offenders and felons need other forms of assistance as much as they need jobs. My suggestion is for you to contact your local Salvation Army office. You may find services that can help you until you get on your feet. You can get more information here:

I would also contact the United Way office in your area. The United Way supports a number of community services. Ex-offenders and felons may receive direct assistance or referral for jobs.

You can find a United way office near you. Follow the link below:

Felon with federal conviction needs employment

Felon with federal conviction needs employment

Felon
I was sent the following link http://www.howfelonscangetjobs.com/, so this is how I got your email address. I have a federal felony for marijuana from 2001. I am finding it really hard to get a job. I have had a few since I was convicted and served my time ten years ago. With the economy being what it is I was laid off from a steel company 12/08. I have had once job since and that didn't work out. So here I am once again looking for a job. My unemployment is almost expired and I'm finding it very difficult to find companies who don't do background checks. I don't think I can have this taken off my record due to it being federal. If you have any suggestions or help to offer please do so. I love office work and it's what I'm good at. I recently went to dental assisting school and graduated only to find out it isn't for me, so now the $10,000.00 I borrowed for school will be coming due soon.

I'm really frustrated...I understand I made a mistake back in 1998 and did my time and probation and I still have a black cloud over my head.

Please let me know if you have any suggestions.

Thank you

~Kat~

Felon with federal conviction needs employment

Hello Kat,

Felon with federal conviction needs employment
You are correct you have little or no chance of having this conviction removed. Expungement is not an option for federal convictions. As I mentioned in a previous post, often I suggest to ex-offenders and felons looking for employment is to apply at smaller independent temporary employment agencies. Often companies end up hiring their temporary help. Independent agencies don't have to deal with restrictions larger agencies may have placed on them by their parent companies as they relate to hiring ex-offenders and felons. They are free to hire anyone they choose. You can find listing in your local telephone directory and apply as you would any other job.

I also suggest that you apply for jobs using your resume and a well written cover letter. Often when you apply for jobs this way, your record may never come up.

I hope this helps

Felons, jobs and Deferred Adjudication

Felons, jobs and Deferred Adjudication

Felons, jobs and Deferred Adjudication  Please help! I found your blog online.

I'm currently serving 5yrs of probation for deferred adjudication (for felony case). I feel that I should contact the attorney that handled my case - because I recall my attorney saying that I either pay off my debt and be done with everything or pay while serving the whole 5 yrs of probation. I am still having a hard time finding a job. The majority of my work experience is in an office environment, with that in mind - no one will hire me! I have had tons of interviews, and I've been let down. I have some production/warehouse experience, but that's still not helping. I was told by my PO that I have the right to choose "No" when it comes to the question on any application asking "Have you ever been convicted of a felony?" And, I choose "Yes" when it asks me "Have you ever been convicted and/or deferred adjudication." My background check comes up showing my felony. I'm still serving this probation until 2014, and my PO told me I have to wait until 2014 to try to remove this thing off my record. Now there was an increase in my probation fees from the original judgement. I could barely afford it much less paying more. I'm still not working. I moved back to Texas recently and started working for a small business (attorney's office) that didn't do background checks. So, I was with that office shortly while looking for another job, and then I had an excellent opportunity through an agency that paid more money, and I was guaranteed the pay rate increase and filled out the paperwork and I went through the interview. Everything went through and I was chosen for the position. And, the day I was going to start was the same day I received a call that my background disqualifies me from the job offer. I have not been convicted of any offense. I have already been to the Texas Workforce Center, and applied through them. Had more interviews, and continued to be rejected for numerous positions that I would qualify for - but it's the background check that hurts my job search. Please advise!
Felons, jobs and Deferred Adjudication

Thank you,

Bess

Felons, jobs and Deferred Adjudication

Hello Bess,

For those unfamiliar with Deferred Adjudication, in most cases, adjudication is withheld pending some other action, usually successful completion of the terms ( usually a fine and probation,) dismisses the case. If you successfully complete the terms, in most cases the charges are dismissed. When you complete the terms you will be given a document declaring the charges dismissed. In your case, the probation period is five years and that may present a problem until probation is complete. This will appear on background checks as a pending charge that sometimes will turn an employer off.

Felons jobs
As I often suggest to ex-offenders and felons looking for jobs to consider working as a temporary employee as a way of getting a permanent job. Temporary agencies are a great way to quickly get back into the working world. Many employers use agencies to try out new employees before hiring them. Good workers are hard to find. If an employer sees that you are hard working, punctual and fit in well, he may offer the job permanently.

The key to applying for temporary jobs for ex-offenders and felons is to apply at smaller independent agencies rather than large national companies. Small independent agencies have fewer hiring restrictions than larger national companies and are free to hire anyone they feel that can help them. You can get a list of these agencies in your local phone directory.

Once your probation is finished I suggest that you apply for expungement. This may help when it comes to background checks. Since expungement is a legal process, I strongly urge you to get professional assistance.

I hope this helps.

Educated felon in N.C. in search of job

Educated felon in N.C. in search of job

Educated felon in N.C. in search of jobOn June 3, 2010 accepted a plea bargain and I now have a c felony and an e felony on my record (c felony: attempting to manufacture schedule I / e felony manufacturing schedule VI ) I have been put on probation for eight years and I assume I am not eligible for expungement until after the probation. I am 56 years old, I have a PhD in psychology. Since almost all employers do criminal background checks, I also assume that my former career as a college professor is over. I am pursuing a Masters degree in addiction counseling but I can't live on just my student loans with court fines and probation fees added to my cost of living.

The one-stop center in Asheville, NC has not been helpful. they referred me to Goodwill who only help ex-convicts coming out of prison. The probation office is not very helpful - they consider it my responsibility to be gainfully employed - which is extremely hard to do under the circumstances. The federal bonding program sounds good, but the Fidelity Bond Certificate requires an employer - so you have to be employed or offered employment before the bond is issued! - I would appreciate any advice you can give me.

Educated felon in N.C. in search of job

Hello M.T.,

Please don't give up on the One-stop. Just because they were not able to help you that one time, doesn't mean they won't be able to help you in the future. Don't forget they have access to the bank of available jobs in your state.  As far the Federal Bonding Program being useless, it is always a powerful selling point on interviews.  It may make an employer more at ease about hiring a felon if he knows you can be bonded.

With your background, you may also want to contact your local United Way. The United Way supports a number of non-profit social service organizations that may be able to use someone with your extensive qualifications as well as agencies that help convicted felons You can find information about the United Way in the Asheville area here:

I hope this helps.

Felon in Texas has a job but needs advice

Felon in Texas has a job but needs advice

Felon in Texas has a job but needs advice
Hi,

I am a convicted felon with several charges I received with in a 5 month period between Dec '02 to April '03 . These were mostly all drug trafficking charges. There were several, and I was arrested two 3 times in total between these 5 months. I was 22 at the time. I did 3 yrs in prison and got out in 8/2006. I then moved from Florida where I lived my entire life to Texas and hopes of starting a new life. Till now I was very successful in do this. I currently work for a Wireless Provider as a Store Manager over two stores with an excellent track record.

When hired for this company start up company they only did background checks in Texas. All my charges were in Florida. Now because of the companies success we being bought out, or merging with a bigger wireless provider. The merger will take place by the end of September 2010.

Since we are merging the new company is asking us all to fill out applications, and sign off on National background checks. I'm very concern with this and I don't what the outcome will be.

I guess my question were can someone with my get find a career. And in your opinion what do you think will happened to me?

Regards,

Steven

Felon in Texas has a job but needs advice

Hello Steven,

As I always advise ex-offenders and felons looking for jobs is to Always be Honest! Never take the risk of non-disclosure only to found out later. Most employers won't fault you for being a felon but will for being a liar.

In your case, you are a valued employee, which are hard to come by. What you do have in your favor is that your past convictions have nothing to do with theft which is important in retail and they had nothing to do with a former employer.

Tell the truth, which is your part and hope that your new employer will do the right thing
