Hello,

I'm from Texas. I have a Felony/Theft charge on my background from 2008 and been on a 5yr probation about 3 years now. After about 3 weeks of job search, this past week I was hired on the spot as a sales associate at Academy. Then today, I was let go because of the felony charge, which i lied about on the application. Should I try talking to the manager and explain my situation? I know, i should just be upfront and put it down on the application, but not sure how to word it properly. What are some things to put on applications, when asked about criminal history? My degree is in Teaching and so have not tried those type of jobs. I also, have experience in, retail, food service, office. If you have other suggestions, please feel free to, share them. I'm glad I found your website. It helps having someone to share this with. Sometimes it gets very depressing. I just want to get my life moving in a positive direction. Anyway, thanks for your help. I look forward to hearing back from you.

That is a common mistake by ex-offenders and felons looking for jobs. Some believe by being honest they don’t have a chance at getting a job. The fact is an employer cannot legally refuse to hire you because you have a criminal record unless the conviction is directly related to the job for which you are applying. I have spoken with former inmates who have lied on applications and gotten jobs, only to lose them later when background checks were done. Some have been encouraged to use the response “Will discuss at interview.”  For ex-offenders and felons looking for jobs, applications present a dilemma. Lie or not to lie. I advise job seekers to always be honest. If you are dishonest about your past, you risk having the truth exposed later. You may get a job only to lose it after the employer finds out the truth through a background check. You will be fired for being deceitful, not because you have a criminal record.In my opinion, these are not good practices. The best advice I can give is BE HONEST! Employers have a responsibility to know as much as possible about prospective employees.

As for applying for other jobs, you should always apply for any job you feel you qualify for. Never talk yourself out of a job.

If you chosen profession is teaching, public schools aren't you only option. You may not be eligible to teach in public schools but there are other options. Community colleges, adult learning annexes, private and charter schools are great places to start. They usually have fewer regulatory restrictions than public school systems.

   Occupational licensing locks too many Americans out of the job market
Nearly one out of three Americans has a record in the criminal justice system and, as a result, faces a difficult road to becoming employed. Adding to their woes is the fact that many jobs — including interior designer, barber, pest control applicator and fire alarm installer — require some kind of occupational license.

Unfortunately, many states still deny licenses for individuals with criminal convictions, even when those convictions are decades old or relatively minor. The good news? Several states and cities across the country are poised to become leaders in reforming the law.

The number of jobs requiring occupational licenses has ballooned in the last 50 years. Occupational licensing has expanded from covering five percent of the workforce in the 1950s to 30 percent today. In recent years, occupational licenses have come under fire for creating unnecessary barriers to work without any measurable gains in safety or quality of services provided to the public.

Counter to what many believe, locking released individuals out of job opportunities is bad policy — it hurts returning citizens, our economy and public safety. Employment upon release is one of the key indicators in predicting whether individuals will commit another crime, and the sooner ex-offenders are employed, the less likely they will be to commit future crimes. States that consider license applications from returning citizens are demonstrably safer. In states willing to consider applications from ex-felons, the recidivism rate declined by 4.2 percent; in the 29 states where licensing boards outright reject applications from ex-felons, the recidivism rate actually rose by 9.4 percent.


Other states — such as Georgia, Illinois and Kentucky — have already passed measures to limit the consideration of criminal records in the licensing process. In Illinois, for instance, State Rep. Marcus Evans Jr. sponsored a law last year that forbade the state licensing department from disqualifying potential funeral directors, roofers, barbers, cosmetologists, hair braiders and nail technicians solely because of a criminal conviction — unless the conviction directly relates to the job.

Similarly, the D.C. Committee is currently considering an amendment to permit licensing boards to consider only convictions directly related to the job. The Removing Barriers to Occupational Licenses Amendment Act Of 2017 would also give the returning citizen an opportunity to provide mitigating evidence.

 The current language in D.C. guiding licensing boards is vague, denying any applicant whose offense “bears directly on the fitness of the person to be licensed.” As Councilman Charles Allen, one of the sponsors of the bill, pointed out at the Nov. 28 committee hearing that the law provides “no explanation of what fitness means, or how it should be determined.” Society would be better served with a narrowly tailored law that provides clarity to applicants and licensing boards alike.

Not surprisingly, professional associations are uncomfortable with licensing reforms. The Boards of Chiropractic, Medicine, Nursing, Respiratory Care and Dentistry all opposed the D.C. bill. The main argument supplied was that, without a review of an individual’s entire record, public safety would be harmed.

However, the proposed amendment would not prevent licensing boards from considering convictions directly relevant to the occupation in question. None of the professional associations opposed to the bill explained why considering irrelevant information would protect the public.

Additionally, all of the professional associations argued that very few applicants, even those who have had contact with the criminal justice system, are denied licenses. However, many individuals with criminal records do not even apply for licensure because they believe their past conviction is an immediate disqualification. This is why a key component of a law removing barriers to licensing should be education and publication — provisions that are not currently contained in the bill’s language.

The current laws are not conducive to public safety and deny returning citizens the dignity of work — the pride in making a living and providing for their family. Preventing a large swath of individuals from obtaining occupational licenses simply because of prior contact with the criminal justice system is bad policy. Those who have paid their debts to society deserve at least a fighting chance to obtain occupational licenses.

Can a Felon be a Licensed Counselor?
Hi,

My name is Kerry and I came across a blog for felons. My boyfriend is currently in prison. He wants to go to school upon being released to be a counselor for inner city teens. Is it possible to obtain a license in counseling being a convicted felony? I'm currently applying for grad school to get my LPCC in mental health and we're looking to start our own private practice. I you can give me some information that will truly be appreciated.

Hello Kerry,

The best suggestion I can give you and your husband is to contact the medical licensing board in your state. I know of felons who have jobs as certified counselors so I guess it depends on the state and the nature of the felony.  If you find out that you can be licensed, speak to a counselor.  Learn what it takes to get started.  If possible, volunteer in a treatment center to get a feel for working with people who have substance issues.

Hi,

My name is Anita, I was convicted of involuntary manslaughter in February of 2003, It was a death by motor vehicle, and there were no drugs or alcohol that contributed to the accident. I received a three years probation, the accident actually occurred on October 2001, I just had to wait for a court date because it was tried by a jury.



On April 2005, I was charged with a misdemeanor for which I received a 1 year probation or until my fines were paid. I received unemployment from the job because they found that I wasn't responsible for the money being missing. I just was too afraid to take it to court because I was afraid of the outcome. My lawyer told me to plead no contest, I didn't want to but I didn't have the $5000.00 it would cost for a proper defense.
Lady Felon Searching for a JobAnyway, I was working for Moore County Schools, and I disclosed my criminal record before I was hired, but they can't find the application. I hadn't been convicted at the time I had started substituting for the school, and at that time it wasn't required unless you have been convicted. However, when I was asked to take on a Teacher's Assistant position in 2004, I had been convicted, and I filled out the criminal record part on the computer at the school. I thought that I was not going to be able to get the job because of my record. To make a long story short, someone called a T.V. station and told them that I had a criminal record. I was then asked to resign from my position.

Right now I have been unable to get a job, and I thought since the involuntary manslaughter charge was an accident that it didn't matter, and the misdemeanor charge wouldn't have any bearing on my job because I didn't work with money. I never got reprimanded for my work performance, and in fact I received great evaluations. I tried to go to a place that helped people with records get a job, but it was limited to those that actually went to prison, or those that had a drug problem. Is there any organizations out there that could help me find a job?

Hello Anita,

I'm sorry your situation is causing you so much stress. As I often suggest to certain people who want to work in schools, try private or charter schools whose hiring practices are more liberal than public school systems.

Often ex-offender and felon job searches require some help from an attorney. Contact your local legal aid
office to seek assistance in getting your criminal record sealed or expunged since they are non-violent offenses. I should make getting a job easier.

I also suggest applying for temporary jobs. Often if temporary employees are good, they are hired on a permanent basis. When applying for temporary employment, it is better to apply at small independent agencies rather than larger national companies. Smaller agencies are free to hire anyone they choose. You do have marketable skills, so you are in a better position than most ex-offenders and felons job 
searching.

Hello,

I found your website very informative and would like to convey my story to you. I met Kurt in 2004 and we fell in love and have been living together ever since. His story began in 1978 when he held up several hotels. He served time and was paroled in 1984. He did another holdup in 1984 and served a total of 8 years for all his crimes. His most recent offense was an assault charge in 2005. That charge stemmed from my ex stalking me and threatening me with a gun. Kurt went to jail, not the gun carrying stalker. Go figure. He cannot find a job to save his life. All he wants to do is work. He's tried Goodwill. Here in Fort Worth, the job that they told him to come in for wanted a clean criminal background.

He most recently was washing cars for a valet service at DFW airport. As soon as the background report came back, he was let go.

He is one of the most intelligent and kind men I have ever met. His prospects are very limited at this time and he feels totally worthless. He has excellent computer and phone skills and has proved that when he worked with me in the oil and gas industry several years ago being a landman.

He has signed up with any and all temporary firms that are out there and they tell him that they cannot place him because of his background. He has been through Texas Workforce Commission and they are totally useless.

Hello Gwyn,

Kurt has some serious convictions to work with, armed robbery and aggravated assault. I have worked with tougher cases. He may have the best chance at employment applying for jobs that don't have much contact with others or valuables. As I always suggest for felons with similar offenses, warehouse or factory work may offer the best opportunities.

I wish there was a simple solution but there is not.  Whenever he gets an interview, he can tell the prospective employer that he can be bonded.  See the video below about The Federal Bonding Program.  Often ex-offenders and felons stand a better chance of getting hired by employers if they are bondable.

Can a Ex-offender get a job with Pre-trial Intervention?
Pre-trial intervention is usually offered to first time offenders whose offenses are not that bad.  In different states it may have different names such as, Deferred Adjudication, Deferred Judgement or Deferred Sentence. There are terms associated with pre-trial intervention, usually a fine and probation.  In most cases when the terms of pre-tral intervention are met, the charges are essentially dropped. Because the charges were dropped, there is no conviction. Record of this can only be seen by the court system, law enforcement and certain government agencies. There will always be a record of the initial charge but it will show as dropped.  With pre-trial intervention, there is an initial plea of guilty. It is my understanding, at the end of the probationary period, if you have complied with all the conditions of probation and the fine is paid, the guilty plea is considered withdrawn, the case is dismissed and no conviction enters. This is because a conviction is not final until there has been both a guilty plea or finding of guilt and the imposition of sentence. Since sentencing does not occur before the end of the probationary term, there is no conviction.  Have you been convicted of a crime?  The answer is "no".  This is not legal advice.  If you want to get the details of your case, contact the probation officer assigned to you.


 Many ex-offenders and felons looking for jobs apply for expungement which means that you can apply to have your charge hidden from public view. Both the charge and the pre-trial intervention will always be visible to the court system, law enforcement and government agencies. This may not be an option for you since most employers are only concerned with convictions

Dear Sir,

My name is Anthony, and I’m currently 49 years old. I am having severe difficulties obtaining employment due to a crime (convicted of Attempted Robbery 1) I committed when I was 16. I was convicted at 18, and served 3 years in the N.Y. penal system. I’ve worked as a machinist for over 25 years, and since 2005, in industrial sales. I was just on a 2 1/2 hour job interview today, which looked extremely promising – until I was asked if I had ever been convicted of a crime. I was informed 40 min. ago that I would not be considered due to this. What are the costs? I will pay whatever is necessary to have this sealed and get my life on track.

Your difficulty finding jobs may be more a symptom of the present economy rather that you being a felon. Ex-offenders and felons looking for jobs are particularly hit hard by this tough job market.

As far as sealing your conviction, you may have to seek legal assistance to see if this is a viable option in your state. May I suggest your local legal aid office. There you will find low-cost or even no-cost assistance as well as advice on you options in your state, Check you local telephone directory for the nearest legal aid office.  Bear in mind that sealing your record does have its limitations.  It will always be visible to the court system, law enforcement and government agencies.

Tight job market is good for felons, people with disabilities

and others who are hard to employ

I was arrested in May of 2008 for the charge of burglary. I took a plea agreement that lessened the conviction to Felony Trespassing (3rd degree) in New Jersey. My question is if potential employers will see something like Trespassing as just as bad as any other felony or if I am worrying too much and thinking I will be constantly passed over for jobs because I am grouped in the same "Felony" category as people who have committed violent crimes, robbery, and etc. I have a college degree and 2 years work experience in a media-related field but keep applying to jobs with the notion that my charges are always going to hold me back from getting a job within the field of media, marketing, and promotion. With so many employers conducting background checks, I just want to see how a Felony Trespassing charge looks to them and if I am still hireable. Thank you so much for taking the time to help a person in need.

Felons should always be honest applying for jobsI encourage all ex-offenders and felons to always be honest when applying for jobs.  Your situation isn't as bad as it seems. Trespassing is a relatively minor offense and there are no integrity questions surrounding it. Whenever the question comes up on an application or on an interview, be honest. Typically on an application, the question will be, "Have you been convicted of a crime other than a traffic violation?" You will answer honestly.

In reference to convictions, it is necessary to list all relative information. Include the name of
the conviction, date, location, and the disposition (time served, fine and/or probation.)

Example:


Trespassing (isolated incident) 8/12/08 Newark, NJ Probation 6 mos

I used the notation "isolated incident." It gives the impression that you are not a criminal, but a person that just found himself in a bad situation...something that can happen to anyone. If the question comes up, don't go into detail, just give an answer just like that.

The most important thing I suggest to all ex-offenders and felons looking for jobs is to be honest. there no sense in being dishonest only to lose a job when a background check is done.

Ex-Felon needs information on the Federal Bonding ProgramHello, my name is Michael and I am an ex felon. I served 2 years for manufacturing with intent and theft of under $20,000. I was curious as to if I can apply for this bond and if so how do I go about doing it?

A bond is an insurance policy issued by an agency that protects an employer against money or property loss due to employee dishonesty. Certain convictions make many ex-felons ineligible for private bonding.




The Federal Bonding Program is sponsored by the Department of Labor and issued for those who are unable to be bonded privately. The bond is issued at no cost to the employer and may be an incentive to hire an applicant. Criminal records become less of a concern to employers if they know that they are protected from loss of money or property due to theft. An applicant can be bonded the same day the job offer is made. Federal Bonding Program can help felon get a job
I was convicted of 2nd degree felony securities fraud in Salt Lake City Utah. My background is in financial services (mortgage lending specifically). My felony conviction obviously limits me greatly as far as my ability to license etc. and provide for myself and my family.

Is there a fidelity bond or some other type of program that I could participate in that would allow me to work in financial services again? A fidelity bond would need to be for a higher dollar amount than the 25k currently offered.

I have contacts at a bank who are willing to consider me if I can provide some sort of fidelity bond to mitigate the risks. Any suggestions would be greatly appreciated?

A bond is an insurance policy issued by an agency that protects an employer against money or property loss due to employee dishonesty. Certain convictions make many ex-felons ineligible for private bonding.

The Federal Bonding Program is sponsored by the Department of Labor and issued for those who are unable to be bonded privately. The bond is issued at no cost to the employer and may be an incentive to hire an applicant. Criminal records become less of a concern to employers if they know that they are protected from loss of money or property due to theft. An applicant can be bonded the same day the job offer is made.

Either you or your employer can apply for the federal bond. For you to apply, you must have the application form. You can find it here:

Fidelity Bond Certification Form

Take the completed form to your local One-stop Career Center. Ask for the person that handles requests for federal bonding. That person will be able to explain the bonding process in further detail.

Frequently I get questions from ex-offenders and felons looking for jobs and job search assistance. From time to time I get mail form ex-offenders and felons just wanting to be heard. Take a few minutes and read something I received from a reader of this blog. Feel free to comment.

Dear Eric,

I’m writing in hopes of letting my story be known to help and encourage women of all ethnicities, cultures, socioeconomic status, and the alike. I was watching Mo’Nique's documentary entitled, “Women Behind Bars,” and saw myself. I don’t believe I’ve cried with such intensity in years and absolutely hate to see women placed in such testing predicaments. Having experienced adversity and can understand how simple it is to be caught within certain circumstances. But now I have a question I’d like to ask the world, a felon serving time, paying back debts to society or whatever discipline is necessary, I concur, but what else is expected of a felon when seen as a title and society won’t assist these human beings (felons) back into what is called a “forgiving world.” Living in Colorado, I have come to experience racism from many aspects, African American, female (educated), epileptic (disability), and a felon. With these characteristics defining me as a person, employment, or to suggest a second chance in the state of Colorado is almost non- existent. Employers in Colorado do not assist felons with employment necessary to pay back debts, live efficiently and evade recidivism, where most felons eventually return to a life of crime for a means of survival.

I for example, unemployed and being a convicted felon am ineligible for assistance. I’m curious to know what services, options, choices and the alike are available for cultured felons? To give a brief synopsis of my conviction; I plead guilty to and was convicted of a misprision of a felony in 2006 a crime committed by a young man in 2002. Misprison of a felony was an offense under the common law of England and was classified as a misdemeanor. It consisted of failing to report knowledge of a felony to the appropriate authorities. After the 9/11 tragedy, the United States, reinstated the Patriot Act, adopted and revised England's law of a misdemeanor "misprison of a felony" making it a felony and terrorist act to protect the country against further terrorists or terrorist acts (basically ourselves). Having knowledge of a crime or criminal, placed me in the category of being a terrorist threat to my country. Though it is documented a witness came forward in 2003 stating money was offered in exchange for my life, instead of providing protection for a US citizen, the government chose to convict and sentence a U.S. citizen for essentially not “snitching” and protecting the lives of her and her family. When we have no one in the country we can trust, who do we turn to? When families are afraid and fear for their lives added with the lives of their children (i.e. domestic violence homicides) and the government deems the victim(s) as a terrorist or their actions a terrorist act, where do we go and what do we do to protect our own?

Having no prior criminal history, I was sentenced to one year in a woman’s federal facility in Fort Worth, Texas (released October 2007) and one year probation (completed 2008). Since my release in 2007, I completed and received a B.S., in Criminal Justice with an emphasis in Domestic Violence and Juvenile Delinquency. Wanting to increase my awareness and familiarity of family, I directed my career objective to counsel women and children; and enrolled in Argosy University where (passing the necessary exams) I will receive an MBA, LPC in Clinical Mental Health Counseling in September of 2012. While attending school full-time, I volunteered with Bridges of Silence; an after school tutoring program for children and youth; ages 6-18. But ineligible for hire due to a felony back ground. At the same time, I completed training to obtain certification for CPR, Standard First Aid, and Blood Pathogens.

Now having a criminal history, I will use my story as an example for others to follow when making what could be life changing choices. I was what most considered “The All American Girl” born in the United States, first job at the Mall, age sixteen, honor roll, track star, peer counselor, comedian, prom queen, and later registered to vote, age eighteen. I like to think I was a model citizen until my choices lead me to a path of devastation. I made a mistake in my choice of friends, relationships, life in general and feel I owe it to society, in particular, the younger generation to emphasize the importance of where our choices, positive and or negative, could eventually lead us. Working with and empowering children is a difficult task, and is not encouraged when one has a felony record. I do discourage convictions involving children, but rather, use a conviction such as my own, to dissuade children from following the same path. I am often discouraged from many job openings with children for discrimination purposes as all of the applications clearly specify, “a felony conviction does not automatically disqualify employment,” however, having that title automatically places a negative stigma amongst employers, volunteers, and society as a whole.

Seeing the displacement of children and adolescents due to their wrong or bad choices isn’t the example I want to lead by. Rather, be that example to demonstrate that “yes” I made a bad choice, but a bad choice does not make me a bad person. If I had put some thought into my decisions, then I would not have made those mistakes. But, it’s too late, “I am unable to take it back,” however, I can grow from it. My purpose in life now is to give back, and help deter others from making the same mistakes I did.

The state of Colorado seems to be the least forgiving state of felons; the entire realm of felonies should be classified separately, but are grouped and stigmatized as all being a nuisance to society. These stigmas may be the foundation to many felons either falsifying the fact of having a conviction or falsifying their credentials, where even “I” have been informed of being, “over qualified.” Whom do felons go to for help or work? No one wants to hear our side; they look at the title and automatically make assumptions as to who you are as a person!

President Barack Obama signed into law on April 9, 2008, the Second Chance Act (P.L. 110-199) which was designed to improve outcomes for people returning to communities from prisons and jails. We as citizens were lead to believe it was intended to authorize federal grants to government agencies and nonprofit organizations to provide employment assistance, substance abuse treatment, housing, family programming, mentoring, victims support, and other services that can help reduce recidivism. However, this Second Chance Act is nonexistent in the state of Colorado, evident on every application as emphasis is placed on “a felony conviction does not automatically disqualify an applicant,” but, very well guarantees the likelihood of your application not being viewed.

I’ve accepted responsibility for the crime I committed, and owe it to future generations to help deter them from possibly making the same mistake in their lives. I want to be of assistance to my country, not be on assistance. I have been told being a convicted felon makes me ineligible for assistance in the state of Colorado. Does it help or hinder the situation, single, without children, and refusing to claim epilepsy as a disability? I’m asking for assistance in finding employment in the state of Colorado, and for a second chance that will allow me to go forward and give the necessary message to our children. Though my crime had nothing to do with children, I was recently informed that my felony conviction will not allow me to be eligible to counsel children.

Confused, as a felon I am an excellent candidate for a volunteer and or mentor for children, but the title felon suggests I also pose a threat to children and society as a whole. Once again, felon is a title, it is not who I am. Thank you for taking the time to read and absorb my story. The moral of the story is felons are people to, and we should be treated as such. The only difference between me and others without the title of “felon” is I was wedged between a rock and a hard place. A movie I recommend for all Americans is “Loose Change.” Then when it comes to you having to make that choice for your family, what choice will you make? Will your government (country) be there for you as you are expected to be for your government (country)?

Felon with experience needs a Job

Are employers finally giving felons a second chance?
I'm a felon, convicted of mortgage fraud in 2005. My charge stems from a 1998 business deal and resulted in 5 years probation. I've accepted my situation and remained gainfully employed through my small business until 2009. Now, small business owners are subject to background checks before being awarded government contract. All small business certifications require background checks on the owner before the certification is granted.

Needless to say, my contracting career is over even though I have 13 years of outstanding references from government agencies. Every contact I have will say their hands are tied when it comes to hiring a company whose owner has a felony conviction. I had to shut down my business (53 employees) and look for work. I hold a master of science in technology management and a master of business administration and I have over 20 years of IT experience.

I have been looking for a job since February 2009. After posting my resume online, I get 4 to 5 responses a week. I disclose my situation during the telephone interview and it goes not further. Most companies will say it's their policy not to hire anyone with a felony conviction. Unfortunately, in the Washington DC area, every job now requires a background check - even McDonalds.

 
After much research, I found the Second Chance Act of 2007. The Second Chance Act is designed to improve outcomes for felons returning to communities from prisons and jails via employment assistance, housing, mentoring, etc. Well, the Second Chance Act does not apply to felons that received probation. As a felon that has paid my debt, improved myself through education, and function as a law abiding citizen, I am not given a second chance. I currently receive unemployment compensation, which is 1/3 of what I need to cover mortgage, electricity, water, phone and food. I am absolutely one step from homeless and hungry (with 2 masters degrees). Any suggestions?

Hello Homeless,

Ex-offenders and felons with skills and experience are in far better shape than those without. You simply have to be more creative about how to employ your skills.

Firstly, I suggest contacting smaller independent IT contractors. You could subcontract through them and not be subject to the same scrutiny as primary contractors. Get the telephone book and get to work. There has to be at least a few that could have a job for you.


Companies are given a $2400 tax credit for hiring felons and there is a Federal Bonding Program for at-risk (felon) employees.  See the link below for information about the Work Opportunity Tax Credit

Secondly, I suggest considering starting a small business setting up home computers and networks. In this day and age, people buy computers (often more than one,) but don't how to set them up or connect them to each other. you could start with just a few flyers. Just a 

suggestion.
