Will Pre-trial diversion hurt my job search?

Good Morning:

I received a misdemeanor public intoxication and felony obstruction of an officer over 2 and a half years ago. I am on my states pre-trial diversion program. I know this is going to show up on a criminal background check until I complete the program next February. Will a company not hire me even though I have never been convicted and just charged? My case is open until I complete the pre-trial program.

Will Pre-trial diversion hurt my job search?

Hello J,

Generally speaking, Pre-trial Diversion is usually used for first time offenders of lesser crimes. There are certain terms (usually probation and a fine) attached to pre-trial diversion that must be met. Once the terms are met, the charges are then dropped.

In most cases, employers only ask about convictions and not charges. Always pay attention to the wording on applications.  If the application asks for charges, list your charges.  If it asks for convictions, only list convictions.  Since the charges will be dropped, there is no conviction.  In my professional opinion, this will be a non-issue.  I wouldn't worry too much about it.

If it still bothers you, find out if expungement is an option in your state.  Expungement is a legal process that will hide your charges from public view.  To get more information, I suggest you contact your local legal aid office to see if this is an option for you.  If so, they may offer assistance getting it done.

I have a felony conviction for theft.  It's the only spot on my otherwise clean record. I am a compulsive gambler who is attending Gamblers Anonymous and getting treatment from a psychiatrist. I have been looking for work for a long, long time and can't even get a call back.

Previously I worked as an accountant but my addiction will keep me from that type of work.  I would like a shipping/receiving or an inside sales position or maybe a dispatch job. All these positions are ones that I worked before I started my accounting career.

First of all I wish you success on your recovery.  I'm not sure what state you live in but some states offer what is known as Certificate of Rehabilitation.  A Certificate of Rehabilitation is a court order, which declares that a person who has been convicted of a felony is rehabilitated.  If a petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the granting court and constitutes an application for a pardon.

A suggestion I make to all ex-offenders and felons looking for jobs is to go to your nearest One-stop Career Center.

One-stop Career Centers are very underutilized resources that ex-offenders and felons can use not only to gain employment, but to get vocational guidance and preparation. Also, these centers offer a long list of useful services. Some services available are:

Career planning and counseling

Workshops (Resume Writing, Interviewing Skills, and related topics.)

Computers with internet access and word processing

Daily access to thousands of job listings


Job-related magazines and local newspapers

Job postings and referrals

Printers, fax machines, phones, and copiers for job searching

Every center is staffed with trained counselors that provide one-on-one help for job seekers. Many of them have experience helping ex-offenders and felons looking for jobs.

My name is Eric Mayo.  Welcome to my blog.  I have helping ex-offenders and felons get jobs for many years.  Many people with criminal records feel they have no chance at getting jobs. That is far from the truth. Though it may be a bit more challenging to ex-offenders and felons, it is possible to to compete for jobs. To do this, felons must construct a plan to neutralize the effects of having a criminal record. It is definitely going to be more challenging, but the challenges can be overcome by hard work, planning and creativity. I started this blog to offer ex-offenders and felons practical advice and other useful information that can help them get jobs. 

What I want everyone to understand that jobs are not going to come to you.  You are going to have to go and get them.  Getting a job is tough.  Getting a job with a criminal record is even tougher.  You are have to work harder, smarter and longer than the average job seeker because your record has put you in somewhat of a handicapped position.  No one is going to feel sorry for you.  The only thing that is going to work is hard work.

I will be updating this blog often so make it a point to stop by from time to time to see what questions have been asked and answered here.  If after a while a questions similar to your situation has not been asked, feel free to send me an email with your question.  I may not be able to answer your question right away, so look through the available responses.  Maybe you will find some information that will help you.

Hello,

I have a police record. One charge is for domestic violence. It shows assault and battery. I was ordered to counseling, Which turned into grief counseling because of the reasons the fight happened. The other charge is a false charge that I am in the process of requesting expungement. There were no charges or a court hearing. I was having a drink with a friend. A known drug dealer was in the bar and asked to buy me a drink. I did not accept, we talked for about 5 minutes and he left. All of a sudden an undercover policeman shows me his badge and asked if we can talk outside. I go out with him and was questioned about the drug dealer. I said I didn't know him and had no information to offer. Before I knew it there were police cars, I was in handcuffs and put in jail for 3 days. 3 times a day I was taken from my cell and questioned. Every time I had no informational new charges kept getting added to my record.

After 3 days I was released and my record now shows dangerous drugs. Both of these happened 20 years ago. I have passed 3 tests to be a TSA screener my 4th test is Tuesday. When I pass this they will run a background check. At what point do I explain this to someone? I currently work at KMart and they ran a background check but hired me without asking questions. It was the same with Home Depot as well! Do you know if TSA is strict about 20 years ago? Do you know if they ask for an explanation of my background? I really need a job with a good paycheck and I've always wanted this particular job!

Hello Sally,

Generally speaking, when talking about records, employers are concerned with convictions and not charges. As I tell all ex-offenders and felons looking for jobs, answer honestly on both applications and interviews. If applications asks for convictions, only lists convictions, not charges. As far as interviews, nearly all of the questions will be related to information from your application. I encourage ex-offenders and felons not to volunteer information that is not asked for.

Expungement, or sealing does not erase records but hides them from public view. If an is granted the conviction will always be visible to government agencies, the court system and law enforcement. You mentioned that you have applied for a TSA position. Since this is a government position, all of your charges will be visible. Once again, if questioned, always answer honestly.

Felon with Many Skills Needs a Job

In 2004 I committed a Felony 4 Theft . I was convicted but no jail time, I was placed on probation which I have completed. In 2006, I was given another Felony for Unemployment Fraud again no jail time and amount paid back before court hearing. These two Felonies were huge mistakes in my life and very humiliating for me everyday of my life. I went from a $70,000 a year job in Dayton, Ohio with great benefits to a $40,000 a year job with little to no benefits and currently unemployed.

Through these past seven years I have lost my family of two wonderful children and a great wife who has been by my side through all of this humiliation. I lost my home and my dignity We all live from my mistakes and I keep trying to get back into the career I am very good at but can not get past the background checks that many companies require before they hire a person. Twice, I made it all the way to actually going to the new work place and working over 5 hours before the HR department came down with a delayed background report and the bad news that I can not work for this company due to background convictions.

I am so tired of having to live each day in humiliation, not being able to provide for my family and have a place to call my own home. I have learned many things these past seven years and have seen how less forfeit people survive on little to no income. I have an education and so many technical skills and can get hundreds of jobs at or around $80,000 a year and could provide for myself and my family and their futures for college and retirement. but I get shutdown with one question, “have you ever been convicted of a felony”.

I am asking you to please help me in any way you can to be able to get these two mistakes off my background. I am sincerely sorry for all my mistakes.

Please, any advice would be helpful. I am losing hope and faith!

Finding a job with a criminal record often isn't easy. Ex-offenders and felons stand a better chance at getting hired by applying at smaller businesses. Smaller businesses are less apt to spend money on expensive background checks. One out-of-the-box suggestion I have is, if the the application on paper, leave the question that relates to having a criminal record blank. It is often overlooked by being left blank and you won’t have to address the question at all. If it is noticed, and you are questioned, always answer truthfully. Hopefully you will get an interview where the employer will get a chance to meet the person behind the application and you can sell yourself.

I often suggest to ex-offenders and felons looking for employment is to apply for temporary employment. There are clerical or other jobs that would put you in an office environment. There was a time that going to a temporary agency was the last resort for many job seekers, but for ex-offenders and felons looking for jobs, it is a good place to begin a new career.  In the past five years, the demand for temporary employees has risen over 30%.  In these tough economic times, companies are searching for ways to keep their labor costs down so they can remain competitive.  More and more employers are utilizing temporary staffing agencies as a way to cost effectively fill vacancies.  Not only do companies save money by using temporary labor, they get an opportunity to try out new workers before hiring them on a full time basis.  Another interesting trend is the length of assignments.  It is not uncommon for an assignment to last up to six months, so a temporary assignment may not be so temporary.  Often companies end up hiring their temporary help if they prove to be good employees.  You may also pick up some new skills and even make new business contacts that may be valuable later.

There is a twist for ex-offenders and felons when it comes to applying for temporary assignments. They should apply at smaller independent temporary employment agencies. Independent agencies don't have to deal with restrictions larger agencies may have placed on them by their parent companies as they relate to hiring ex-offenders and felons. They are free to hire anyone they choose. You can find listing in your local telephone directory and make appointments for interviews and prepare yourself accordingly. Be professional and dress as if it's a 'real' interview, because it is.  You will be employed by the staffing agency and they will send you to assignments.  Make sure you have an up-to-date resume and work on your interviewing skills. While agencies unquestionably will look at your work history and skills to determine a proper fit, the interview is the key to getting a good placement.  The person conducting the interview is usually the same person who will decide what assignment you'll be offered. Your aim should always be to make a good first impression. Do not talk about your criminal history until you are directly asked about it.  If you are asked, be honest but brief.


Even if the assignment you get isn't in your field, hey, a bucks a buck and it will help tide you over until better opportunities present themselves.

I suggest you contact your local One-Stop Career Center. There you will find a list of services that can help ex-offenders and felons find new careers including training and job search services. Most Career centers have counselors who have experience assisting ex-offenders and felons looking for jobs. There are also contacts with other agencies that offer vocational rehabilitation and employment opportunities for those with disabilities.

I'm from Texas. I have a Felony/Theft charge on my background from 2008 and been on a 5yr probation about 3 years now. After about 3 weeks of job search, this past week I was hired on the spot as a sales associate at Academy. Then today, I was let go because of the felony charge, which i lied about on the application. Should I try talking to the manager and explain my situation? I know, i should just be upfront and put it down on the application, but not sure how to word it properly. What are some things to put on applications, when asked about criminal history? My degree is in Teaching and so have not tried those type of jobs. I also, have experience in, retail, food service, office. If you have other suggestions, please feel free to, share them. I'm glad I found your website. It helps having someone to share this with. Sometimes it gets very depressing. I just want to get my life moving in a positive direction. Anyway, thanks for your help. Felons must be honest when applying for jobs

That is a common mistake by ex-offenders and felons looking for jobs. Some believe by being honest they don’t have a chance at getting a job. The fact is an employer cannot legally refuse to hire you because you have a criminal record unless the conviction is directly related to the job for which you are applying. I have spoken with former inmates who have lied on applications and gotten jobs, only to lose them later when background checks were done. Some have been encouraged to use the response “Will discuss at interview.”  For ex-offenders and felons looking for jobs, applications present a dilemma. Lie or not to lie. I advise job seekers to always be honest. If you are dishonest about your past, you risk having the truth exposed later. You may get a job only to lose it after the employer finds out the truth through a background check. You will be fired for being deceitful, not because you have a criminal record.In my opinion, these are not good practices. The best advice I can give is BE HONEST! Employers have a responsibility to know as much as possible about prospective employees.

As for applying for other jobs, you should always apply for any job you feel you qualify for. Never talk yourself out of a job.

If you chosen profession is teaching, public schools aren't you only option. You may not be eligible to teach in public schools but there are other options. Community colleges, adult learning annexes, private and charter schools are great places to start. They usually have fewer regulatory restrictions than public school systems.

Can a Felon be a Licensed Counselor?

My name is Kerry and I came across a blog for felons. My boyfriend is currently in prison. He wants to go to school upon being released to be a counselor for inner city teens. Is it possible to obtain a license in counseling being a convicted felony? I'm currently applying for grad school to get my LPCC in mental health and we're looking to start our own private practice. Hello Kerry,

The best suggestion I can give you and your husband is to contact the medical licensing board in your state. I know of felons who have jobs as certified counselors so I guess it depends on the state and the nature of the felony.  If you find out that you can be licensed, speak to a counselor.  Learn what it takes to get started.  If possible, volunteer in a treatment center to get a feel for working with people who have substance issues.

 Can a Ex-offender get a job with Pre-trial Intervention?

Hello Kayla,

Pre-trial intervention is usually offered to first time offenders whose offenses are not that bad.  In different states it may have different names such as, Deferred Adjudication, Deferred Judgement or Deferred Sentence. There are terms associated with pre-trial intervention, usually a fine and probation.  In most cases when the terms of pre-tral intervention are met, the charges are essentially dropped. Because the charges were dropped, there is no conviction. Record of this can only be seen by the court system, law enforcement and certain government agencies. There will always be a record of the initial charge but it will show as dropped.  With pre-trial intervention, there is an initial plea of guilty. It is my understanding, at the end of the probationary period, if you have complied with all the conditions of probation and the fine is paid, the guilty plea is considered withdrawn, the case is dismissed and no conviction enters. This is because a conviction is not final until there has been both a guilty plea or finding of guilt and the imposition of sentence. Since sentencing does not occur before the end of the probationary term, there is no conviction.  Have you been convicted of a crime?  The answer is "no".  This is not legal advice.  If you want to get the details of your case, contact the probation officer assigned to you.


 Many ex-offenders and felons looking for jobs apply for expungement which means that you can apply to have your charge hidden from public view. Dear Sir,

My name is Anthony, and I’m currently 49 years old. I am having severe difficulties obtaining employment due to a crime (convicted of Attempted Robbery 1) I committed when I was 16. I was convicted at 18, and served 3 years in the N.Y. penal system. I’ve worked as a machinist for over 25 years, and since 2005, in industrial sales. I was just on a 2 1/2 hour job interview today, which looked extremely promising – until I was asked if I had ever been convicted of a crime. I was informed 40 min. ago that I would not be considered due to this. What are the costs? I will pay whatever is necessary to have this sealed and get my life on track.

Why, 31 years later, is this haunting me now more than ever? Thanks,

Felon with old conviction needs a job

Your difficulty finding jobs may be more a symptom of the present economy rather that you being a felon. Ex-offenders and felons looking for jobs are particularly hit hard by this tough job market.

As far as sealing your conviction, you may have to seek legal assistance to see if this is a viable option in your state. May I suggest your local legal aid office. There you will find low-cost or even no-cost assistance as well as advice on you options in your state, Check you local telephone directory for the nearest legal aid office.  Bear in mind that sealing your record does have its limitations.  It will always be visible to the court system, law enforcement and government agencies.

Next, I suggest to all ex-offenders and felons looking for jobs to visit their local One-stop Career center. One-stop Career Centers are underutilized resources that can provide a wide array of services that you help you find a job or start a new career.

Felons should always be honest applying for jobs

Tight job market is good for felons, people with disabilities

and others who are hard to employ

I was arrested in May of 2008 for the charge of burglary. I took a plea agreement that lessened the conviction to Felony Trespassing (3rd degree) in New Jersey. My question is if potential employers will see something like Trespassing as just as bad as any other felony or if I am worrying too much and thinking I will be constantly passed over for jobs because I am grouped in the same "Felony" category as people who have committed violent crimes, robbery, and etc. I have a college degree and 2 years work experience in a media-related field but keep applying to jobs with the notion that my charges are always going to hold me back from getting a job within the field of media, marketing, and promotion. With so many employers conducting background checks, I just want to see how a Felony Trespassing charge looks to them and if I am still hireable. Thank you so much for taking the time to help a person in need.

Hello A,

I encourage all ex-offenders and felons to always be honest when applying for jobs.  Your situation isn't as bad as it seems. Trespassing is a relatively minor offense and there are no integrity questions surrounding it. Whenever the question comes up on an application or on an interview, be honest. Typically on an application, the question will be, "Have you been convicted of a crime other than a traffic violation?" You will answer honestly.

In reference to convictions, it is necessary to list all relative information. Include the name of
the conviction, date, location, and the disposition (time served, fine and/or probation.)

Example:

Trespassing (isolated incident) 8/12/08 Newark, NJ Probation 6 mos

I used the notation "isolated incident." It gives the impression that you are not a criminal, but a person that just found himself in a bad situation...something that can happen to anyone. If the question comes up, don't go into detail, just give an answer just like that.

The most important thing I suggest to all ex-offenders and felons looking for jobs is to be honest. there no sense in being dishonest only to lose a job when a background check is done.
