Does sealing of records help felons get jobs?

State speeds sealing of criminal records

I had a deferred sentence. After completing probation, the guilty plea was withdrawn. I then sealed the record. This was twenty years ago. I then applied for a job as a corrections officer and was denied the position because my federal background said I had this on my record. Please help. Not sure if I was denied because of the deferred judgment or because I did not disclose my sealed record.

I am confused, so let me tell you what I know about deferred sentences.

Often first time offenders, depending on the severity of the crime, are offered adjudicated sentences as a means to keep the load on the court system down. The offender is given certain terms to abide by. In most cases, when the terms are met (usually a fine and probation,) the original charges are dropped but they remain as charges not convictions. Anyone accessing your record will not see the charges. The exception is that your deferment and its terms are always visible to the court system, law enforcement and government agencies. The same applies to expungement and sealing of records. Many ex-offenders and felons looking for jobs consider expungement to help the get jobs. Expungement and sealing will only hide the record from public view but it will still be visible to the court system, law enforcement and government agencies.

I always suggest that my students contact the nearest legal aid office.  Legal aid can give you answers about expungement and/or sealing of records as it relates to your state.  Legal aid may offer low-cost or no cost assistance in getting the process done.

Teacher gets second chance after felony conviction

I have a criminal record for credit card abuse when I was 18. Long story short, I was in the wrong place at the wrong time. My room mate used it at a grocery store and I was the driver, but did not know until after. When I found out, and the investigators talked to me, I told him everything. My options were receive probation and community service for $1500 or fight it for $10,000. Needless to say I was a kid and didn't have that kind of money so I had to do the probation. I want to teach and I'm 29 now, my question is will I be able to or am I wasting my time in school? I just need to know so I can change my major.

Hello jenny,

You may want to look into expungement. I'm not sure what state you are in so you better speak to a legal professional. Often felons and ex-offenders require some legal assistance before looking for jobs. I suggest contacting your local legal aid office. You may qualify for low-cost or no-cost legal assistance.

You can always contact the school board where you wish to teach to find out if your conviction would exclude you from employment consideration. If you find that it will, there are other teaching options.  You may try private schools, career schools and even community colleges. They usually have fewer restrictions than public schools.

Hello,

My name is Angel and I'm having a really hard time. I am a felon and I can't seem to get a job anywhere. Nobody wants to deal with me . My parent agreed to help me get back on my feet. Now my parent is going back on their word so I'm all alone in a rough city trying to make it but nobody wants to give me a second chance.

I'm the mother of 4 and I can't get any help. I never went to jail I got probation and house arrest. I have finished house arrest but I have another year of probation and nobody is trying to give me the time of day. I'm about to be in the street and I have nothing to fall back on. No money, no car, and no home. I feel like I can't go on but I can't give up. Is there somebody, anybody out there I can go to.

I'm in Chicago and wow its hard here if u aren't a felon. I committed a white collar crime, conspiracy to commit fraud that seems to be the worst crime. Nobody wants to give u another chance. I messed up and I know I did and I don't ever wanna do anything illegal ever again. I was trying to feed my family. Being a single mom is a very challenging job but I know I don't have to commit a crime to survive but nobody will even give me a chance to prove that or myself. What do I do?

My suggestion to you is to contact your local United Way office. The United Way could guide you to any number of services they support that may be able to help you and your family. You may also ask about services that assist ex-offenders and felons.

My husband just relocated here to Atlanta to be with his family. He is a convicted felon. It has been hard for him to find a job for many reasons. For one, I work two jobs to support us and he stays home with our two youngest children (we have 5) during the day. Secondly, we do not know a lot of people here in Atlanta,GA to network with. And of course....its hard to get a job period, add a felony to it and it is even harder!

We are searching for possible job search programs that will help us get childcare and help him be able to look for employment. I am on waiting list for assistance for childcare but I have been waiting for months. We can not afford childcare without him working. It is only by Gods grace that we have made it this far. Any advice or suggestions would be great!!!!

I'm sorry your husband is having so much trouble. First let me suggest that he try The One-stop Career Center in Atlanta. There he will find a variety of services that can not only help him find a job but perhaps training for a new career. These centers are underutilized resources for ex-offenders and felons looking for jobs.  Among the resources you will find are current lists of job openings in your area.

Another great resource for ex-offenders and felons is Goodwill of North Georgia. Goodwill operates a computerized training center that provides career alternatives for unemployed and underemployed people.  Your husband can get specialized training to be certified in the following trades:

EVOLVE (Educational and Vocational Opportunities Leading to Valuable Experience) provides counseling, case management, vocational training and employment placement to persons with criminal backgrounds. Services available include resume preparation, interview techniques and mentorship.

I suggest to all ex-offenders and felons looking for jobs, go to your local One-stop Career Center.  There you will find valuable resources that can help you get a job. The centers in Nevada are Nevada JobConnect.  Nevada Job Connect  provides workforce development services to employers and job seekers in Nevada. For job seekers, Nevada JobConnect offers career development information, job search resources, training programs, and, as appropriate, unemployment benefits. Targeted populations may be eligible to receive intensive assistance to overcome barriers to employment. Many of the counselors have experience assisting ex-offenders and felons.  Counselors may also guide job seekers to available training programs that could lead to a new career.

I committed a crime over 10 years ago, I pleaded guilty and go two years probation.  My church gave me a job after my conviction. I didn’t have to worry about seeking employment elsewhere.  I no longer work at the church for personal reasons.  I am currently looking for a job and it’s hard for me.   I was wondering if you could give me some advice on where to start or if there are programs out there for women.  I live in Virginia Beach

Lady Felon Seeks Job Search HelpUnfortunately, I don't know of any programs in the Virginia Beach area for women.  The first place I suggest for every ex-offender and felon looking for jobs is the nearest One-stop Career Center.  Your local One-stop can help you with some valuable services that help you get a job.  You can get help with your interviewing skills, a resume and there are computers and copiers you can use.  There are also state issued lists of open jobs in your area.  Each center has a staff of counselors that can help you in your job search.  Many counselor's regularly work with felons and ex-offenders and know of employers in the area that will give them a chance.  You can find the Center in your area here:

Another suggestion is to find your local United Way office.  The United Way supports a large number of social service agencies that may be able to help you.  They can direct you to resources that may help a female felon or felons in general.  There may be other services that can help you get back on track.  The United Way in your area can be found here:

Hello my name is Shantell and I'd REALLY appreciate any help at all that you can possibly provide me. My man is a felon he is currently in work release in Steelton, Pa. The rules there are extremely strict. It's hard for him to go out and look for a job. He is a good man even though he is a felon. His crimes are not violent they're mostly drug related. I have been trying so hard searching the net for jobs for him and I keep coming up with dead ends. So I was wondering if you could possibly help me in any way possible. Maybe you know some companies in Steelton, Pa. or Harrisburg, Pa. He is a very hard and devoted working man he has just made some mistakes but who hasn't you know. There are a lot of people without criminal records out of work. Found your website while searching "felon" info and thought I would take a chance.

When my son was 19, he had come home from college for the summer, earned his black belt in Tae kwon Do, and made the mistake of having a relationship with a 15 year old girl in his karate class. She was working on her black belt and had an immense crush on my son...and vice versa. They had known each other for several years--and were both very talented "karate kids."
Anyway, they broke it off when he went back to school--but remained friends.

The young lady went to counseling a year later for some unrelated family issues and revealed that she had a boyfriend a year ago and they had sex. Bingo...the therapist calls the state, the state arrests my son, who is now 20 almost 21, and presses charges...4 counts of sex with a minor. Neither girl nor her family pressed charges against my son. In addition, we were told that because he had recently earned his black belt degree that he was considered "someone of higher responsibility" and that is why the state decided to prosecute. I might add that he was in the process of applying for the Indiana State Trooper program--was almost there! BIG NIGHTMARE for our family since this son was the one who never drank, partied, smoked...just a good, sweet, loving kid and born again Christain... who did something really dumb based on emotion.

The deal was this, 6 months house arrest and 3 years probation which we have almost completed...without grumbling I might add. Felony reduced to misdemeanor as soon as probation ends actually on 9/16/10. He has been planning to join the military... to do good in the world and serve the country he loves. What are his chances? He talked to an recruiter (about 6 months ago) about Indiana air guard and was told not just no-- but never.

 I know quite a few young men in your son's same situation. The good news is that his charge will be downgraded to a misdemeanor.  From time to time the military grants waivers to recruits who have criminal records.  Most are moral waivers, which include some felonies and misdemeanors.

The only military branch offering waivers to ex-offenders is the Army. He may find more success there.  The Army recruiter will tell him exactly what to do to get the process started.  It is totally up to the Army to grant the waiver.

To Whom It May Concern,

I am a convicted felon. On March 13th, 2003 I was convicted of felony theft scheme in the state of Maryland. I was 20 years old at the time. I am not 27 soon to be 28 years old. I just finished my associate's degree in nursing. I applied to the Maryland Board of Nursing to sit for the NCLEX RN examination. Within the application I was honest about my conviction and included a cover letter explaining the nature of the incidence. I explained in the letter that since the conviction I have been an honest and trustworthy person and have worked hard at my job and had managed to start and finish a college degree in a very tough and competitive nursing program. I was given my authorization to test, I sat for the NCLEX RN exam and passed. I have yet to be granted a license number.

People in my class that have taken the NCLEX RN exam after me, have already received their license numbers. Would they have allowed me to sit for the exam even if I then were not going to be eligible for licensing? I'm worried that I have gotten this far through this and will then not be granted a license. Do I have any rights here? Why would they take my money and authorize me to test then to tell me "NO" you can't be an RN.
Also, if they do decide to finally give me a license number... Do you have any suggestions on how to go about getting a job?
