Hello, I came across your site and thought I'd ask for advice. I have a petit theft charge from 2008, ever since then I have not been able to find a job. Went into a huge depression for 2 years because my relationship was heading south and I was unable to find work. I actively searched, landed a few jobs, lost them due to my charge. Since 2007 I have been in a serious relationship. I'm in love but it's affected us. In order for us to be together I chose to live in his mom's house where I felt ostracized. She had an abusive relationship with her partner and I wanted us out. I landed a job and we saved our money for an apartment (which was also hard to find because of my record), and we moved out. two weeks later I lost my job. I am unable to find another job and I don't know what to do, I can't receive unemployment I haven't worked. I am ineligible for assistance. We have no car. I don't have money to take the bus to look for a job. I am lost and I will lose everything if I don't fix this fast. I am lost.

I'm sorry you are having so much trouble. It seems to me that you are in need of social services as well as a job. Often ex-offenders and felons need other forms of assistance as much as they need jobs. My suggestion is for you to contact your local Salvation Army office. You may find services that can help you until you get on your feet. You can get more information here:

I would also contact the United Way office in your area. The United Way supports a number of community services. Ex-offenders and felons may receive direct assistance or referral for jobs.

I have a 5 1/2 year old felony for selling marijuana. I had no jail time. I will complete a bachelors degree this summer in Human services. I would like to work as a case manager. I applied for a non paid internship as part of my school requirements and was turned down flat. I am freaked out. I have supported myself in the past 5 years by bartending and working for a family member. I have never worked manual labor and have no particular skills in that area. I am very computer proficient and had been thinking about getting a masters in social work. But now I am wondering if I have wasted all of my efforts by going to college when I can't even work as a free intern. Also...what is "expungement" and how do you look into it? Thank you for any advice.

Hello,

First of all, getting a degree is by no means a waste of time. You are in a much better position than most ex-offenders and felons looking for jobs. I always suggest applying for jobs by sending resumes with well written cover letters. Often this may help to get around the application process.

Expungement may be a good option for you depending on your state. Expungement amounts to a court order effectively sealing a court proceeding and its affects from public view. This would appear that your conviction does not exist. It does, but will only be visible to the court system, law enforcement and government agencies. Often ex-offender and felon job searches begin with some legal assistance. Contact your local legal aid office to inquire if expungement is an option for you. Legal aid offices often provide low-cost or even no-cost assistance.

Sex offenses are among the most difficult convictions to overcome.  It is my experience. Sex offenders have a higher success rate when they apply for jobs that have limited contact with other employees or the public.  Truck driving is ideal for felons looking for a situation like this. Driving trucks is an option for many ex-offenders and felons looking for jobs.   I know many registered sex-offenders who are driving trucks. The challenge is to find a company that will offer you an opportunity. Here is a list of companies, some of which will hire ex-offenders.

In most cases I would not attempt an answer for a question of this nature because I am not a legal professional. I believe there are other ex-offenders and felons looking for jobs that are in similar situations, I will offer a suggestion. My understanding of deferred adjudication is, there is an initial plea of guilty. It is my understanding, once the conditions of the deferment are met (typically a fine and probation,) the charges are formally dropped. Since there is no conviction, you may legally answer “no” when the questions asked “Have you been convicted….” The charges although formally dropped, they will still remain as a charge and will appear on background checks as a charge and not a conviction.

Here is the tricky part. Even though the charges are dropped the deferment will always be visible to law enforcement the court system and government agencies. Since a state agency certifies teachers, it will be visible. Too many ex-offenders and felons looking for jobs assume that their convictions make them ineligible for hire. My suggestion is that you contact the State Board for Educator Certification to find out if your conviction will keep you from being certified in Texas. You can reach them here:
