Ex-offenders and felons,  know how difficult it is to get a job interview.  After properly filling out application after application including the dreaded "Have you ever been convicted of a crime.....?" question and you got an interview.  There are too many people who blow the opportunity to get jobs by making costly mistakes.  Make the most out your next opportunity by avoiding these top five mistakes made by ex-offenders and felons.


1.  Being Late - There is absolutely no excuse for being late to an interview.  To the interviewer, if you are late to the interview, you'll be late for work.  Everyone know that things happen.  Murphy's law is always in effect.  Sometimes thing go wrong.  Being organized is the best way to keep on schedule.  Find out where your interview is and know exactly how long it will take you to get there.  If you have never been there, I strongly suggest you go there a day or so before the interview just to see how long it will take to get there.  Once you know how long it will take, plan to get there at least 15 minutes early.

2.  Dress Inappropriately - An interview is a business meeting.  Does your clothing make you look more like an ex-offender or a businessman?  Proper clothing will be the difference between being hired and not being hired.  Whatever you have to do, get the right clothing.  Remember, you will never get a second chance to make a first impression.

3.  Talking Too Much - Employment interviews should not be used to tell your life story or ramble on about mistakes you have made in the past.  Just remember "TMI," too much information. Too often when folks are nervous, and interviews do make people nervous, they talk too much.  Never talk about personal situations, habits, or relationships.  Be friendly but never tell more than anyone needs to know.  Particularly avoid conversations about religious beliefs, politics, or sex.  If questioned about your convictions, briefly answer questions without going into detail.  Make reference to the amount of time that has gone by and what you have learned from your experience.  Also talk about the progress you have made and the things you have done to make yourself better.

4.  Using Slang or Profanity - As stated before, the interview is a business meeting between two professionals.  You must be professional at all times. There is absolutely no place for slang or profanity here.

5.  Not Turning off Your Cell Phone - Cell phones are a great convenience but they have no place on an interview.  Turning off your phone allows you to focus on your interview and will eliminate the possibility of the rude interruption of  it ringing.

Ex-offenders and felons have a difficult time finding employers who will consider them for jobs.  When interviews do come, avoid ruining these opportunities with these critical mistakes and get hired.

Felon hoping a pardon will help get jobs



Dear Mr. Mayo,

I enjoyed the new clip of those 13 in Illinois that have taken the next set with working towards showing society that people can change.  I am in the process of working towards writing a pardon letter to the governor of North Carolina.  For a long time I thought that I was not able to vote cause of my felony and in the last few days that I found out that I'm able to vote even as an ex-felon.  Which made me happy.  But the deli ma that I'm running into regularly is my background for employment.  Even though my Felony is over 16years old I'm still faced with the statement of felon.  I have put it on application no to the ones that have stipulated a year limitation of 5, 7, or 10 years; those that have no limitation  I have to answer yes too.

When I have applied for Government and State jobs even Hospitals and Security jobs. For example I applied to a Security Company in Virginia and I was told by the officer that interview me that if it was up to him it would not matter that I had a felon cause it was 16years ago.  But the company that they were contracting for didn't want any of there candidates to have a record period.  Yet I have not heard anything back from that company for any work at all.  Or when I have applied for a Government contract company CGI they set a formal letter to me stating that due to my background I was not selected.  Even when I
applied for UPS when I was asked that question face to face; I was told by the interview that if it was up to her she would overlook my background but it would be in my best interest to not so willfully give out that information when she herself was only the middle man and someone over her would be the one to make the decision of yes or no.  It makes me feel like my application is just thrown in the trash.   I downloaded your book and the steps were very helpful.  When it came to finding work, which I did but trying to find something better than minimum wage is like a needle in a hay stack.

Currently I will be re-enrolling back in to school online for my Associates Degree in Health Information Technician (Medical Billing and Encoding).  With a degree I think that I would have a better chance as far as the skill the employer could be looking for.  The one thing that hangs over my head is the background check.  I think this Pardon will at least allow me a better chance of being employed with the Government and State level.  With documentation of the Pardon they would at least have to give me a fighting chance.  Which is something that I'm not finding even here in the Washington, DC Maryland area.

I would greatly appreciate any advice that you might have or some suggestions that you could provide to me in the pursuit of my pardon.

This is something new to me and I would like to make sure that I'm taking the right steps in this matter.

Hello Ms. Tracie,

Even though you are pursuing a pardon, don't abandon your job search.  You should stay on your plan.  Bear in mind, no matter how old your conviction is, it will always be visible to the court system, law enforcement and government agencies.  This may the reason you are having trouble obtaining a government opportunity or getting a job with a company with a government contract.

I first suggest contacting your local United Way office.  The United Way supports may social service agencies, some of which assist ex-offenders and felons.  As I stated in my book (From Jail to a Job,) one of the most underutilized resources in many of our communities is the local One-stop Career Center.  The center has resources that can help ex-offenders and felons get jobs.  You can get help preparing a resume, find a list of open positions in your area and even assistance finding and paying for career training.  You can even get information on getting a federal bond that could help you get hired.  There are also counselors that provide one-on-one assistance.  Many counselors have experience working with ex-offenders and felons.

Finding jobs for  ex-offenders and felons is a very difficult task. I know, I have been helping ex-offenders and felons get jobs for many years. I wish there was one thing I can tell them that would make this job easier, but the fact is, it will take a plan and a lot of hard work. Unfortunately, too many felons consider themselves victims of society that are constantly discriminated against for things they have done in the past. When a felon is released, the sooner he or she finds gainful employment the lower the risk of re-offending.


As I tell my students, don't expect anyone to feel sorry for you. Don't look for any sort of favors. There are few to be found. There are ex-offenders and felons hired everyday. You have the right skills and attitude you could be a big asset to the right company. Jobs are not going to come to you. You will have to get out and compete for them. Anytime someone else wants the same thing you want, you have to compete for it. Unfortunately, the playing field is not level. You have a criminal record which will put you at a disadvantage when it comes to competing for jobs. This does not make things impossible, just a little more difficult. The only way to overcome this disadvantage is to work harder and smarter. My question is, do you have what it takes to get a job? Filling out a few applications a week and spending the rest of your time hanging out or playing video games won't get you a job. You must plan to put in 40 hours per week, finding job openings, writing letters, making phone calls, filling out applications and working on your interviewing skills. There are ex-offenders and felons hired everyday. If you have the right skills and attitude you could be a big asset to the right company. Let's look at some things you will need to increase you chances of getting a job.


A Resume

Everyone looking for a job should have a resume. A resume is an individual summary of your background, experience, training and skills that helps you to present your best qualities to an employer. If you have a resume, have a professional person look at it to judge it's quality. If you do not have a well written resume, I suggest you get some help putting one together.

Proper Interview Clothing

Do you have appropriate interview clothing? A well fitting suit with a nice shirt and tie would be Ideal. That may not be possible for someone just getting back into society but I suggest that men at least have dress slacks, a light colored shirt and a coordinated tie. You should also have a pair of shoes that you can shine. No boots, no sneakers…shoes! Many of my students buy their interview clothing at thrift stores. They find quality clothes at very low prices, clean and press them and they are ready to interview. No matter how you get them, the right clothes makes all the difference. You should also have a neat haircut be clean shaven. If you wear a beard, it should be neat and trimmed. How do you look? Do you look like an ex-offender or a businessman? Do you look like you are going to a business meeting? You should - an interview is a business meeting. You should always look like a professional who is there to conduct business! Always dress like you have an interview even to fill out applications. You also want to leave the employer with the impression that you have class. You will never get a second chance to make a first impression.

Interviewing Skills

Many companies hire ex-offenders and felonsWhile your resume may get you an interview, it’s your performance on the interview that will get you the job. Remember you are going to a business meeting so be personable and friendly but keep it businesslike. Do not reveal too much information. give full responses to the interviewer's questions but never volunteer information that is not asked for. If the question of your record comes up, briefly acknowledge it but do not spend too much time talking about it. Focus on what has happened since your conviction and what you have done to make yourself a better person. Develop a friendly smile and a good handshake. You have to make the interviewer forget that you are an ex-offender. Get a friend or family member to help you by playing the part of the interviewer. Practice will pay off.

Finding Job Leads

Many companies hire ex-offenders and felonsThe most effective method of finding job leads is by networking. Networking is simply talking to people you
already know and asking if the know of any job openings. Believe it or not, this how most people get their jobs. Employers save time and energy by hiring people that are referred to them.

Many companies hire ex-offenders and felonsAnother great source of good opportunities is to apply for temporary employment. A lot of employers need temporary help. Many temporary employees are hired permanently if they prove to be good workers.
Smaller independent agencies are a better choice than larger, nationally known ones. Independent agencies do not have the same hiring restrictions that may exclude ex-offenders are free to hire anyone they choose. They are more likely to hire a person with a criminal record. You may find some in your local telephone directory. Apply to them as you would any other employer.

Many companies hire ex-offenders and felonsI encourage everyone looking for jobs to go to their local One-stop Career Center. You will find a long list of services that can help you find work. You will also find lists of available jobs in your area. There are also
counselors who can provide one-on-one assistance. Often the counselors have experience helping people with criminal records and know of employers who may hire them. The counselors can also help you find opportunities for vocational training that could lead to a new career.

Many companies hire ex-offenders and felonsThere are also government programs that can help ex-offenders and felons get jobs. The first is the Federal Bonding Program. Some employers are fearful of hiring ex-offenders or felons since they feel their criminal histories make them more likely to steal, commit fraud or be dishonest in other ways. A bond is an insurance policy that protects an employer against money or property loss due to employee dishonesty. Most felons cannot be bonded by private insurance companies. The Federal Bonding Program is sponsored by the government through the Department of Labor. This program was created to help high-risk, but otherwise qualified, job seekers who have offers of employment. The Federal Bonding Program offers insurance policies that protect employers against any possible losses incurred due to actions by high-risk employees. The program is designed to help ex-offenders and felons who need a second chance. These bonds are free of charge to both the applicant and the employer and can be issued for any job at any employer in any state. Any full or part-time employee paid wages (with Federal taxes automatically withheld) can be bonded, including persons hired by temporary employment agencies.

Always remind interviewers that you can be bonded. Finally, a great incentive for employers to hire ex-offenders and felons is the Work Opportunity Tax Credit or WOTC. The Work Opportunity Tax Credit (WOTC) is a federal income tax benefit administered by the U.S. Department of Labor for private employers who hire individuals from specified target populations. One of the target populations are ex-offenders who have completed their sentences within the past year. The WOTC reduces a business’s federal tax liability, serving as an incentive to hire otherwise difficult to employ people. Eligible employers can receive a federal tax credit up to $4,800 for each qualified employee.

Ex-offenders, Felons, Jobs and Drug TestsI have been helping Ex-offenders and Felons get jobs for many years and I have helped thousands get jobs. One of the biggest barriers that some ex-offenders place in front of themselves is not being able to pass drug tests.


Drug testing has become an important safety issue for many employers. Many companies now have some form of drug testing for prospective employees. Drug testing serves to lower the instance and issues associated with drug abuse in the workplace, including lateness, absenteeism, turnover rate, crime, violence, theft and other side effects.  Too many of my students believe  that they can use illegal drugs and still pass drug tests. With my experience in human resources, management and employment training, I will attempt to expose the myths and give the facts on drug tests.

The typical methods that employers use for detecting illegal drugs are:

Urine Testing:

Urine testing is the most common of the screenings used for illegal substances. Drug users would sometimes use outlandish methods like using fake urine that is sold in some places or using a sample taken from someone else in place of their own. To avoid the applicant using urine not his own, I would always have a sample given in the presence of a staff member. Others believe that drinking large amounts of water will dilute the sample and the drugs will not be detected. Water passes through the body much too quickly to be effective. I have even heard of using ridiculous home remedies to beat urine tests. These remedies include aspirin, eye drops, ammonia, vinegar, bleach and even commercial drain cleaners! There are commercial products that claim to mask the traces of drugs making them undetectable.  many of these products use nitrates which will mask the drug to an extent, but laboratories have gotten more savvy and also test for the nitrate compounds that these products contain. In many cases the presence of nitrates will result in a failed test.


A single use of marijuana can be detected up to seven days in the urine, while extended use can be detected up to 100 days

Amphetimines, cocaine, heroin, opiates and PCP can be detected accurately up to seven days after use.

Saliva Testing

Saliva tests are the least popular because it can only detect toxins used three or four days prior. Saliva tests can detect fresh elements of alcohol and drugs in the mouth.

Hair follicle Testing

My experience is that hair follicle testing is the most effective method of narcotics screening.  A hair test is an examination that uses a small sample of hair to identify specific drugs used by the person being tested. Typically, the sample is taken from the head, but can be collected from several other body locations such as arms, legs and back and may be combined to obtain the required amount of hair.  Drugs can be detected with high accuracy for a six month period after use. Chemical compounds of drugs are circulated in the blood stream and become part of the cells of the body including the hair root where they are easily detected.

There are hundreds of detoxifying products on the market that claim that with their use, drugs will not be able to be detected. There products that claim that they can wash toxins out of the hair. Most of these are absolute scams. The rest have a very low success rate. An experienced screener would pull the hair out intact, exposing the root where the compounds collect.

A one time use of marijuana will likely not show up in the hair while extended use can be detected for three to five months after use depending on the test used.


Amphetamines, cocaine, heroin, opiates and PCP can be detected accurately up to five months after use.

Certain non-prescription medications can interfere with accurate results. These common medications include ibuprofen and ephedrine-based products. Most drug testing companies will ask the applicant in advance if they have taken any prescription or non-prescription medication prior to the screen.

In most cases if any drugs are detected, the applicant will have the opportunity to provide a doctor's prescription or choose to be retested.


Jobs for felons and "ex-offenders" are hard enough to get, so why blow an opportunity to get hired by using drugs?

I have a criminal record and I can't find a job. I have been filling out applications everywhere. Do you have any advice for someone who has made some mistakes?

I hear this from felons all the time. Please don’t quit. You get nothing when you give up. You may just have to change your strategy. If I am an employer, I probably want to hire someone without a record before I hire someone without one. Most applications will ask about criminal convictions. If you are honest, as I recommend, an employer may not want to hire you.


Felons Should Try Smaller Companies to get JobsA good strategy for finding job openings is to apply to employers directly. Once you have decided on the type of work you would like to do, the next step is to choose employers that could use your services. Felons stand a better chance of being hired by smaller companies rather than larger ones. The owners or managers of smaller companies usually make the hiring decisions. Make a list of employers in your chosen field. Contact each one of them to see if there are positions available and how to apply. The telephone is the best method of contacting employers. You may even get job leads from people you know. Another advantage to applying to small companies is they are less likely to run background checks because they can be expensive.

If you get an interview, make a point to mention the Work Opportunity Tax Credit. To a small business, this may be an incentive to hire a person with a criminal record. The Work Opportunity Tax Credit is offered to employers as an incentive to hire any one of nine targeted groups with barriers to employment, felons included. An employer may receive a credit of as much as $2,400 for hiring a felon. You can find more information here:

Hi, My name is Jamie. I recently read your blog on ''felons-turn-to-military-to-find-jobs''. I have been extremely interested in joining the Army ever since I was a kid. My father spent 22 years in the Army, fought in the Gulf War, traveled the world and retired a Sergeant Major in the end. I have never looked up to anyone more than him. Joining the Army has been my one and only interest, even to this day.

 In 2011 (14 years old) I was charged with 1st degree assault with sexual motivation and it was dropped to 3rd degree. A felony none-the-less. My hopes at joining the Army were dashed and ever more so when I even tried applying in person. It's been over seven years now and I haven't had any trouble with the law and never plan to. I was young and stupid and regret what I did every day. I'm 21 now and am still trying to look ahead and see what I should do with my life, I literally never had any interest in my future except to join the Army and now I'm struggling.

I recently just heard about the Moral Waivers that were introduced in 2009 and was hoping you could shed some light on the matter. I would appreciate anything you have to offer. I want to serve my country and I want to follow in the footsteps of my father. Thank you.

Can a felon get a moral waiver to join the military?There are military personnel serving today with sexual assault convictions. In fact I have students who have joined the military. It is a growing trend that ex-offenders and felons having difficulty finding jobs are turning to serving in the military. It is my understanding that you are more likely to get a moral waiver from the Army or Navy than the other branches.

I suggest talking to a recruiter. A recruiter will tell you what type of waiver you will need and exactly how to apply.  Bear in mind that no one has the right to serve in the military and the granting of waivers is totally up to discretion of the Army.

More and more employers are paying attention to references when trying to decide who to hire.  Ex-offenders and felons looking for jobs should have good references that will help them make a good impression on employers.  There are employers that will hire a felon.  A strong set of references from the right people can help you get hired.

In short, references are upstanding members of the community who could attest to your character and/or abilities. A  set of great references could help an employer look past your background.  Ideal people to have as references would be religious leaders, former teachers, former classmates, former employers and local political leaders. 

Good References help Ex-offenders and Felons get Jobs
Most applications ask for three references.  You should always have at least four just in case.  Be prepared to list a name, title, and contact information for each one.  Make sure you have good contact information and keep it updated because over time, phone numbers, titles and addresses change.  Always be sure your information is current.

It is always a good idea to get permission from anyone you wish to use a reference. No one wants to be caught off guard and get a call out of the blue from a prospective employer.  Once you have your set of references and contact information, keep your list in your job search folder for easy access when it is time to fill out an application.

One thing to remember is, only offer references when they are requested.  They are far too valuable to be used as casual information.  When putting a resume together, never put them in the resume itself.  Include a line that may say "References will be furnished on demand.

Ex-offenders and felons can increase their chances to get jobs by getting some great references.

Hello,

I have been trying to get a job with an insurance company or large law firms and no one is calling me back. I assume it is because I was arrested in 2002 and plead out to probation. I am not a convicted felon, but that is still on my record. Also, I have an arrest for battery on my record, but the case got thrown out. Can you really help? I received an email from Allstate that they want to set up an interview with me next week. Will this mess me up once they look up my background?

Hello Mattie,

Can I get a Professional Job with a Criminal Record?Let's start at the beginning.  You state that you plead to probation, which means that you were convicted.  I don't know what your conviction was for, but if you were convicted of any type of theft, fraud or robbery, some jobs may not be available to you. 

In case of any other arrests, employers are more concerned with convictions rather that arrests.  That is why the question on applications typically begin with. "Have you been convicted of a crime..."  I encourage all ex-offenders and felons looking for jobs to get a copy of their criminal records so that they can answer this question honestly and accurately.  The best place to get this is from your probation officer.  I'm sure he/she can get a copy for you.

When your interview comes, as I advise everyone with a criminal record, answer every question honestly, but never volunteer information.  If the question does come up on the interview like this, "I'm glad you are asking this question, because I want you to feel comfortable hiring me....."  Then briefly explain the circumstance surrounding the infraction.  Spend more time talking about the steps you have taken to overcome that situation.

Don't assume that your legal issues are the reason you are getting few call backs.  Continue to apply for every job you qualify for for.  Don't assume that because you have a record, you won't be considered.

I would also try to find out if expungement in your state.  Expungement essentially means that your criminal record would be hidden from public view.  Once that is done, you may claim not to have a record when responding to the "Have you ever been convicted....." question.  Expungement is a legal process that you should not try alone.  You should contact your local legal aid office to see if your state offers the opportunity for expungement.  You may also qualify for free legal services.

Thank you for this blog.  I live in San Francisco, California.  I have multiple convictions for a few things.  I was talking to someone here and they told me that because I have a record in California, I should move to another state.  My record will not show up in another state.  I have relatives in Illinois.  Will moving to Illinois help me get a job?

I am glad you are seeking another opinion and not relying on information from that person.  Totally false!  Your record will follow you wherever you go.  In this age of computers and extensive data banks,  you can find out just about anything on anyone.  There are companies that exist just to sell information to anyone who will pay for it.

Will moving to another state help a felon get a job?A history of criminal record would include an individual's personal identifiers (descriptive information and fingerprints), arrests and subsequent dispositions (final outcome of a charge.)  Dispositions are posted to the
National Criminal History Record File by the FBI's Criminal Justice Information Services (CJIS) Division. Not only convictions but each criminal arrest for which the CJIS Division has a fingerprint submission would be on file.  So you see, your record is fairly easy to get.

There are organizations in your area that can help an ex-offender or felon looking for jobs.

 Arriba Juntos, a community-based organization in San Francisco. This organization has an employment program for ex-offenders and felons.  They even offer , direct job placement for clients who have job skills. Also available in career training in computer technology, including MS Office Suite, and certified nursing assistance with the ability to obtain California licensing. The center will assist clients in obtaining licensing from the State of California. In cooperation with the San Francisco Municipal Railway they offer a driver training course. Clients may obtain their Commercial Driving License and consideration for employment with MUNI as bus drivers. These training programs include a Life Skills component, job interview techniques and resume writing in addition to daily survival skills. There may be paid on job training program that is used as an incentive to employers to hire felons and ex-offenders.

I get a lot of questions from ex-offenders and felons regarding expungement.  It is a common belief that getting an expungement is the answer to their employment woes.  Some believe that if they can only get one, they can have their criminal record erased and they can get jobs to move on with their
Ex-offenders, Felons, Expungement and Jobs lives.  There are lawyers who make lots of money from felons and their families hoping to have some miracle worked and their records will gone forever.  Since most employers do background checks, having a clean record will make getting a job easier.  Having certain convictions on your record may be the difference between getting hired for a job or not.  Lets explore some common myths and uncover the facts about expungement.


Myth #1:  Criminal Records are Automatically Erased After a Certain Number of Years


I am not aware of any state that erases records after automatically.  In fact no records are ever removed, they may be made inaccessible to the public.  There must be legal action taken if there any sealing of records.  There is an application process that completed for any type of action to be considered.  Nothing happens automatically.

Myth #2:  Any Records can be Expunged


Expungement is a legal process that not available in all states.  These processes will vary from state to state as to which records can be sealed or expunged.  For example, in NJ where I am, only one felony can be expunged and the waiting period is ten years from the completion of the sentence.  In some states no records can expunged and in others only arrests not convictions can be sealed.

Myth #3:  An Attorney is not Needed 


Never attempt any legal procedure by yourself.  To be certain that any legal  process is done properly, You should always seek the help of a qualified  professional with experience in this field.

Myth #4:  Federal Convictions can be Expunged


Federal convictions can in no way shape or form be expunged or sealed.  The only action that can be taken is to seek a presidential pardon and very few are granted. 


Myth #5:  Expungement Erases Criminal Records


With expungement, sealing or any other process, records will never be erased or destroyed.  Even though certain records will be hidden from the public, they will always be visible to the court system, government agencies and law enforcement.

This a brief list of common myths associated with the the expungement or sealing of recordsBear in mind that these processes are not available in every state.  Every state has its own statutes regarding the treatment of criminal records.  If you are interested in finding out if you are a candidate for expungement, I suggest speaking to an attorney about availability in your state.  I also suggest that you contact your local legal aid office where you may qualify for free advice about this or even help getting it done.  Most legal aid offices are staffed by young attorneys who are anxious to help and gain valuable experience.  To find your local legal aid office, check your telephone directory or contact the bar association in your state.
