I am Shaun. I was convicted of assault with a deadly weapon inflicting serious injury about 6-7 
yrs ago. I am a barber now, however I have an injury now that has put me out of work. I desire a new career but have much concern as to what I should go into because of my past. Do you have any advice for me or maybe people that would like to help me.

I suggest you contact your local One-Stop Career Center. There you will find a list of services that can help ex-offenders and felons find new careers including training and job search services. Most Career centers have counselors who have experience assisting ex-offenders and felons looking for jobs. There are also contacts with other agencies that offer vocational rehabilitation and employment opportunities for those with disabilities.

In Search of the Felon-Friendly Workplace

When inmates are released, most hope they will never face incarceration again.  One sure way to increase the odds of success is to find stable employment as soon as possible.  I have been helping ex-offenders and felons get jobs for many years and I have found some really good ways that people with criminal records can get hired.  I am sharing the top five ways here:







Temporary Agencies - Temporary employment agencies are one the best ways for a felon to get a job.  Many companies turn to temp agencies as a way to keep their businesses running.  Often when an employer finds that a temporary employer has a good work ethic and fits well the job is offered permanently.  The key for ex-offenders and felons applying for temporary work is to apply to local independent agencies rather than large corporate agencies.  The larger companies often have policies that are set in their corporate offices that prohibit the hiring of those with criminal records.  Local independent agencies can employ anyone they feel they can place regardless of whether they have a record or not.  Grab you local telephone book and make of list of temp agencies to visit and fill out applications just like you would any other employer.

Moving Companies, Furniture and Appliance Retailers - Moving companies and stores that sell large appliances and furniture often are looking for strong capable people who can move large items.  Often criminal records are of little importance if they can find a dependable person who can get the job done by delivering goods safe and sound to customers.

Large Retail Stores - When you think of large retail stores like Target, Wal-Mart or you local supermarket you think of cashiers and department salespeople.  What few people think about are the unseen people who help to keep the store running.  There are people who clean the floors, stock the shelves and unload trucks.  The reason we rarely see these people is because they work overnight.  Not everyone is cut out to work the overnight shift.  Often it is hard for people to work that shift.  Because of this, there are often openings for people who can do a good job on the overnight crew.  Contact your local large retail store or supermarket to find out if there are any openings on the overnight shift.

Property Managers - Many apartment and condominium communities are manage by property mangers who keep everything looking nice for the residents. Every property manager has a staff at every property who does the work necessary to maintain these communities.  There are often openings for people who can do minor repairs, painting and general cleaning.  Many of these communities have the property manger's name on the signs at the entrances.  Contact them to inquire about any open positions

Restaurants - Every restaurant is in need of people who are dependable and can do a variety of jobs. Dish washing, filling ice stations, and helping the kitchen, bar and wait staff are just a few of the duties of the kitchen utility person.  If you can get to work on time and have a passion for serving guests, there are many jobs available.  Make a list of restaurants in your area and call each one to see if there are positions available.  You can cover a lot more ground on the telephone than you can on foot.


Ex-offenders and felons are hired everyday.  There are jobs to be had if you are willing to put in the work to find them and prepare yourself to show employers that you will be a great employee.  Best of luck!

Uber corporate policy offer felons a second chanceThe operator behind the wheel of a self-driving Uber vehicle that hit and killed a 49-year-old woman in Tempe Sunday night had served almost four years in an Arizona prison in the early 2000s on an attempted armed robbery conviction.

Uber issued a statement Tuesday saying the operator met its hiring requirements in Arizona. The company directed questions to Uber's public hiring policy that states, "Everyone deserves a fair chance."

However, requirements differ across states for those who provide transportation to the public. Uber recently came under fire for hiring felons in Colorado.

"Vehicle operators in Arizona undergo a screening process that checks local, state and national databases and meets local requirements by law," an Uber spokeswoman said. "The vehicle operator met these requirements."

The San Francisco-based company's policy for hiring drivers in California states that potential Uber drivers are disqualified if they have convictions on felonies, sexual offenses, violent crimes, DUI or drug-related driving offenses, speeding more than 100 mph or child abuse or endangerment in the past seven years. The company set lower standards for lesser violations such as speeding and non-fatal accidents.

A fatal crash in the dark

Elaine Herzberg was walking a bike across Mill Avenue outside the crosswalk near the Marquee Theatre about 10 p.m. Sunday when she was hit, police said.

Police said the vehicle was in autonomous mode with an operator, who has been identified as 44-year-old Rafaela Vasquez, behind the wheel.

Tempe police spokesman Sgt. Ronald Elcock said impairment did not initially appear to be a factor for either Vasquez or Herzberg. He added it was not apparent that the vehicle attempted to slow down while it approached Herzberg.

Autonomous vehicles have been used to shuttle Uber passengers in parts of Tempe and Scottsdale. Riders who are picked up by self-driving cars likely would recognize them from the presence of the exterior sensors.

$8.9 million fine in Colorado

The Colorado Public Utilities Commission company fined Uber's parent company $8.9 million in November 2017 after an investigation determined the ride-hailing service had hired nearly 60 drivers with previous felony convictions.

Colorado state law prevents individuals with felony convictions, alcohol or drug-related driving offenses, unlawful sexual offenses and major traffic violations from working for rideshare companies.

Uber attributed the unlawful hirings to a "process area" inconsistent with Colorado's ridesharing regulations. The company said all drivers must undergo a third-party background screening "per Uber safety policies and Colorado state regulations."

A second-chance policy

Uber proudly touts its corporate policy to offer convicts a second chance.

"One mistake shouldn’t have to lead to a lifetime of punishment," the company website says. "At Uber, we are committed to working within our communities to help provide opportunities to those who need them most."

Close to 300 people worked in the self-driving operations in Tempe as of November 2017. Uber has more than 18,000 contract drivers and 1,000 employees in Arizona, with most of those staffers at the downtown Phoenix operations center.

Court records show Vasquez has a criminal record in Arizona under a different legal name.

Records from the Arizona Department of Corrections show Vasquez served three years and 10 months in prison for attempted armed robbery and unsworn falsification, the latter from when she provided false information while applying government benefits. She was released from prison in 2005.

The attempted armed robbery was in July 2000, when police say Vasquez and an accomplice conspired to rob one of her co-workers and her employer, Blockbuster Video, of a work deposit of $2,782.98, court records show.

A probation officer wrote in court records that Vasquez recognized she had surrounded herself with people who encouraged “ill-advised” actions, leading her to get in trouble. She said she needed to change who she allowed into her life and make better decisions, the officer wrote.

It appears she followed through. Vasquez has had a clean record since.

SAN FRANCISCO—Thousands of people convicted of marijuana offenses in this city going back to 1975 will have their convictions dismissed or reduced, San Francisco’s district attorney announced Wednesday.





It marks one of the most aggressive moves to wipe away old convictions in the face of new laws legalizing marijuana in California and other states.

San Francisco District Attorney George Gascón said that his office would dismiss and seal 3,038 misdemeanor marijuana convictions, and review and possibly resentence 4,940 felonies—all of which were adjudicated before California voters legalized marijuana in 2016.

Under the state legalization measure, Californians can petition the courts to get old marijuana possession and other convictions dismissed. Mr. Gascón  said his office is taking the extra step of doing it for people in order to lift the burden of past convictions that can make it difficult for people to get jobs.

“A criminal conviction can be a barrier to employment, housing and other benefits, so instead of waiting for the community to take action, we’re taking action for the community,” said Mr. Gascón

Nine states and Washington, D.C., have legalized recreational marijuana use, and a debate has arisen over what to do with past pot convictions in these states.

In Nevada, where recreational marijuana was legalized, Gov. Brian Sandoval vetoed a bill last year that would have required certain offenses to be dismissed and sealed. Mr. Sandoval, a Republican, said in his veto message that such issues were better handled on a case-by-case basis.

In Colorado, prosecutors have raised concerns over bills making wiping away old pot convictions easier, said Arnold Hanuman of the Colorado District Attorneys’ Council.

“Many times convictions are plea bargained down from more serious conduct,” said Mr. Hanuman. “Our concern is that the original conduct involved in the incident is oftentimes more egregious.”

More states are including provisions in legalization measures for expunging past convictions, said Chris Lindsey, senior legislative counsel at the Marijuana Policy Project, which advocates for ending pot prohibitions. “This move by San Francisco is remarkable,” said Mr. Lindsey. “It’s not only do we allow people to repair their criminal histories, the local jurisdiction is just going to do it for them.”

Hello,

I was convicted of a criminal offense here in Florida for theft back in 2010. I am currently attending school and in my senior year at Saint Leo University and am majoring in criminal justice with a minor in homeland security.

Adjudication was withheld from the case, but I'm scared that when I graduate, and get off probation I won't be able to find a job in my degree field. Do you have any recommendations on what to do. I am also currently unemployed and finding a problem find a job as well.

Will a withheld adjudication keep me from jobs?I get a lot of questions about withheld adjudication / deferred judgement. Lets understand what it means to ex-offenders and felons looking for jobs. Withheld adjudication generally refers to a decision by a judge to put a person on probation without an adjudication of guilt. There will be terms set by the court usually a fine and a period of probation. Once the terms are met, the charges are typically dropped. There will be no conviction associated with that offense. If the person does not complete the terms of probation, a finding of guilty may be entered and the person may be sentenced according to the punishments defined for the offense.

So when completing an application that asks if you "Have you ever been convicted of a crime, you can answer "no" and rightly so because you haven't. Bear in mind that the charge will appear on a background check as a charge and not a conviction. You should have no problem with this. To absolutely certain of the status, you should check with the prosecutor or your probation officer associated with your case.

Hello,

I'm from Texas. I have a Felony/Theft charge on my background from 2008 and been on a 5yr probation about 3 years now. After about 3 weeks of job search, this past week I was hired on the spot as a sales associate at Academy. Then today, I was let go because of the felony charge, which i lied about on the application. Should I try talking to the manager and explain my situation? I know, i should just be upfront and put it down on the application, but not sure how to word it properly. What are some things to put on applications, when asked about criminal history? My degree is in Teaching and so have not tried those type of jobs. I also, have experience in, retail, food service, office. If you have other suggestions, please feel free to, share them. I'm glad I found your website. It helps having someone to share this with. Sometimes it gets very depressing. I just want to get my life moving in a positive direction. Anyway, thanks for your help. I look forward to hearing back from you.

That is a common mistake by ex-offenders and felons looking for jobs. Some believe by being honest they don’t have a chance at getting a job. The fact is an employer cannot legally refuse to hire you because you have a criminal record unless the conviction is directly related to the job for which you are applying. I have spoken with former inmates who have lied on applications and gotten jobs, only to lose them later when background checks were done. Some have been encouraged to use the response “Will discuss at interview.”  For ex-offenders and felons looking for jobs, applications present a dilemma. Lie or not to lie. I advise job seekers to always be honest. If you are dishonest about your past, you risk having the truth exposed later. You may get a job only to lose it after the employer finds out the truth through a background check. You will be fired for being deceitful, not because you have a criminal record.In my opinion, these are not good practices. The best advice I can give is BE HONEST! Employers have a responsibility to know as much as possible about prospective employees.

As for applying for other jobs, you should always apply for any job you feel you qualify for. Never talk yourself out of a job.

If you chosen profession is teaching, public schools aren't you only option. You may not be eligible to teach in public schools but there are other options. Community colleges, adult learning annexes, private and charter schools are great places to start. They usually have fewer regulatory restrictions than public school systems.

Walmart is closing 63 Sam's Club stores across the US, the company told Business Insider.

Several stores were abruptly closed Thursday. In some cases, employees were not informed of the closures prior to showing up to work on Thursday.

Instead, they learned that their store would be closing when they found the store's doors locked and a notice announcing the closure, according to reports.


Ten of the affected stores will be turned into ecommerce distribution centers, and employees of those stores will have the opportunity to reapply for positions at those locations, a Walmart official said.

The remaining stores will stay open for several weeks before closing permanently. All of the affected stores were scrubbed from Sam's Club's website Thursday morning.

Sam's Club offered an explanation for the closures on Twitter, saying,

"After a thorough review of our existing portfolio, we’ve decided to close a series of clubs and better align our locations with our strategy. Closing clubs is never easy and we’re committed to working with impacted members and associates through this transition."



The closures come on the same day that Walmart announced it was raising starting hourly wages to $11, expanding employee benefits, and offering workers bonuses of up to $1,000.

   Occupational licensing locks too many Americans out of the job market
Nearly one out of three Americans has a record in the criminal justice system and, as a result, faces a difficult road to becoming employed. Adding to their woes is the fact that many jobs — including interior designer, barber, pest control applicator and fire alarm installer — require some kind of occupational license.

Unfortunately, many states still deny licenses for individuals with criminal convictions, even when those convictions are decades old or relatively minor. The good news? Several states and cities across the country are poised to become leaders in reforming the law.

The number of jobs requiring occupational licenses has ballooned in the last 50 years. Occupational licensing has expanded from covering five percent of the workforce in the 1950s to 30 percent today. In recent years, occupational licenses have come under fire for creating unnecessary barriers to work without any measurable gains in safety or quality of services provided to the public.

Counter to what many believe, locking released individuals out of job opportunities is bad policy — it hurts returning citizens, our economy and public safety. Employment upon release is one of the key indicators in predicting whether individuals will commit another crime, and the sooner ex-offenders are employed, the less likely they will be to commit future crimes. States that consider license applications from returning citizens are demonstrably safer. In states willing to consider applications from ex-felons, the recidivism rate declined by 4.2 percent; in the 29 states where licensing boards outright reject applications from ex-felons, the recidivism rate actually rose by 9.4 percent.


Other states — such as Georgia, Illinois and Kentucky — have already passed measures to limit the consideration of criminal records in the licensing process. In Illinois, for instance, State Rep. Marcus Evans Jr. sponsored a law last year that forbade the state licensing department from disqualifying potential funeral directors, roofers, barbers, cosmetologists, hair braiders and nail technicians solely because of a criminal conviction — unless the conviction directly relates to the job.

Similarly, the D.C. Committee is currently considering an amendment to permit licensing boards to consider only convictions directly related to the job. The Removing Barriers to Occupational Licenses Amendment Act Of 2017 would also give the returning citizen an opportunity to provide mitigating evidence.

 The current language in D.C. guiding licensing boards is vague, denying any applicant whose offense “bears directly on the fitness of the person to be licensed.” As Councilman Charles Allen, one of the sponsors of the bill, pointed out at the Nov. 28 committee hearing that the law provides “no explanation of what fitness means, or how it should be determined.” Society would be better served with a narrowly tailored law that provides clarity to applicants and licensing boards alike.

Not surprisingly, professional associations are uncomfortable with licensing reforms. The Boards of Chiropractic, Medicine, Nursing, Respiratory Care and Dentistry all opposed the D.C. bill. The main argument supplied was that, without a review of an individual’s entire record, public safety would be harmed.

However, the proposed amendment would not prevent licensing boards from considering convictions directly relevant to the occupation in question. None of the professional associations opposed to the bill explained why considering irrelevant information would protect the public.

Additionally, all of the professional associations argued that very few applicants, even those who have had contact with the criminal justice system, are denied licenses. However, many individuals with criminal records do not even apply for licensure because they believe their past conviction is an immediate disqualification. This is why a key component of a law removing barriers to licensing should be education and publication — provisions that are not currently contained in the bill’s language.

The current laws are not conducive to public safety and deny returning citizens the dignity of work — the pride in making a living and providing for their family. Preventing a large swath of individuals from obtaining occupational licenses simply because of prior contact with the criminal justice system is bad policy. Those who have paid their debts to society deserve at least a fighting chance to obtain occupational licenses.

Nursing Careers for Felons
Good morning and to whomever it may concern.

My name is Lucien, I'm 40 yrs old and I'm a felon. In the year 2008 I was charge with corporal injury spouse and another person. I sadly walked into a moment of infidelity occurring in my home late night after a long week gone from home over the road truck driving. You can imagine what transpired after. Served 3.5 years, 1.5 yr parole and I obtained a divorce and left California.

I've been trouble free since my release in 2010 and kept working as a truck driver but I'm exhausted of this career. I'm interested in becoming a Nurse but I see and read so many stories of rejection that I become discouraged and continue my miserable unhappy life of truck driving. Websites are just so full of misleading information and discriminatory rejection.

What can I do and how do i go about pursuing the Nurse career In Nebraska and what steps should I take in becoming accepted and certified without the discriminatory rejection I normally encounter?

Please share some ideas, I sincerely appreciate your time and effort in reading this.....

Hello Lucien,

That's quite a story.  I have students who are truck drivers and I know from them that drive long haul is difficult work.  As far as becoming a nurse,  I would first contact the the medical board in your state to see if you can be licensed with your conviction.

Secondly, if you cannot be licensed as a nurse, but you may be able to be licensed or certified as a Nurses Assistant or Medical Assistant.

Thirdly, if you can get licensed or certified with your conviction you will require training.  There are many career schools out there that train for medical careers.  Before you decide on a career school, ask to see their placement record.  Find out how many of their graduates get placed from every class and where.

Hi,

My name is Kerry and I came across a blog for felons. My boyfriend is currently in prison. He wants to go to school upon being released to be a counselor for inner city teens. Is it possible to obtain a license in counseling being a convicted felony? I'm currently applying for grad school to get my LPCC in mental health and we're looking to start our own private practice. Hello Kerry,

The best suggestion I can give you and your husband is to contact the medical licensing board in your state. I know of felons who have jobs as certified counselors so I guess it depends on the state and the nature of the felony.  If you find out that you can be licensed, speak to a counselor.  Learn what it takes to get started.  If possible, volunteer in a treatment center to get a feel for working with people who have substance issues.
