Will a juvenile record keep me out of a job?

Hello sir,

I have a question. I am currently in the process of applying to work for the New York City Board of Education but I am worried that I may not get the job because I have a juvenile conviction. I was arrested on grounds for felony for reckless endangerment but I took a plea bargain and opted out for a misdemeanor instead. I was arrested back 91/2 years ago.

I have to get my fingerprints taken and have a background check done on me so I am nervous that my conviction will pop up. And I have a sealed record but I am wondering will that also affect anything in my applying to work for the New York City board of Education.



I get a lot of questions like this from juvenile ex-offenders and felons looking for jobs.

Let me understand. You are afraid that a 9 1/2 yr. old juvenile misdemeanor conviction will stop the New York City Board of Education from hiring you.

It is my understanding that juvenile records are sealed and can only be seen by the court system, law enforcement and government agencies. Even if it were public, I doubt anyone would hold a 9 1/2 yr. old juvenile misdemeanor charge against you.

Here in NJ where I am, job applicants are not even bound to include juvenile convictions. I'm not sure about NY state. To be absolutely sure, I would contact someone in your local legal aid office for clarification.

Can a Juvenile Felon get Jobs in Healthcare?

 

I was 16 years old,  I got arrested. I was put in the wrong situation which involved my mother and her boyfriend. I was told they took a plea and allowed the felony to be put on me. I went and got certified in nursing was working for 12 years and now it is haunting me. I love healthcare and want to try to stay in the field. I feel that I belong helping others. I just want a good paying job that I love to go to everyday. Is there anything out there I can work or go to school for?

I get this often from ex-offenders and felons with juvenile records who are looking for jobs. Contrary to what many people believe, juvenile records do not disappear when on reaches the age of adult. In many states, juvenile records are sealed. Sealed meaning they are hidden from the public. They will always be available, however, to the court system, law enforcement and government agencies. Since many jobs in health care require licensing or certifications there will be the question of can you be certified.

You will have contact the medical licensing board in your state to see if your conviction will keep you from being certified or licensed.

I got into trouble when I was a teenager. I am now in college and trying to decide on a career. I am interested in becoming an Elementary Education Teacher. Even though I have a juvenile record, will it stop me from having a career in the field I choose?

Hello Chris,

That is a very good question. Contrary to what many people believe, your juvenile record does not disappear when you become an adult. My advice to you is apply to have your record sealed by the court. Often felon job searches begin with a little legal assistance.

Once a case is “sealed” and can only be examined by order of the court. To seal a criminal record means that a court clerk is ordered by a judge to hide a court record of criminal proceedings from public view. Originally records were actually placed in an envelope which was secured with a wax seal. The records are not destroyed because under certain circumstances, a court can order that sealed records be reopened. Generally, however, the effect of sealing is the court acts as if the information in the record never existed. Even a juvenile record can be sealed through the juvenile court. Once this has been done, the offense shall be deemed never to have occurred. There are no exceptions to this type of sealing; offenses are treated as though they never happened. A court not only seals its records, but also orders that records containing information about the charges held by others be sealed as well. Once a criminal record is sealed, all of the proceedings in it are treated as if they never occurred. Persons may then properly and lawfully answer any questions about the arrest, acquittal, conviction etc., as if they never happened. For example, it is OK in a job interview or even under oath to deny a sealed conviction. Once a record has been sealed it is not gone. I will be visible to law enforcement, government agencies and the court system.

When I was younger, I got into some trouble. Looking back, I'm really sorry for the things I've done. I am hoping that the stupid things I did as a kid won't keep me from having a good future. I want to go to college.  How can I move forward now?

Loosely speaking, the effect of sealing is the court treats the information in the record as if never existed.

 A court not only seals its records, but also orders that records with information about the charges held by others be sealed as well. Persons may then by rights and legally respond to any inquiries about the arrest, acquittal, conviction etc., as if they never happened. For instance, you may by rights in a job interview or even under oath to deny a sealed conviction. Once a record has been sealed it is not gone. It will be visible to law enforcement, government agencies and the courts. This may impact you eligibility for civil service jobs or jobs that require a license or certification.

In some states, juvenile records are automatically sealed. You can find out if your juvenile record was automatically sealed or if you have to apply to have it sealed. An Attorney can help you with this. You may be able to get free legal advice regarding this at your local legal aid office.

Hello,

I have just been offered a position to teach in the Palm Beach County School District. On the Security Form they have asked me to fill out the first question is, "Has your driver's license EVER been suspended or revoked?" Farther down, there is a question, "Have you EVER plead no contest in a criminal proceeding?"

When I was 16 yrs old (2001), I was arrested for underage drinking, and I plead no contest and with the disposition that my license was suspended for 6 months. I did a background check on myself to figure out the dates, but there was no record of it. Do I answer yes to these questions? My concern is that I have to have my fingerprints taken to verify my background, and I remember having my fingerprints taken after the arrest; I am worried that there might be a hit in the system for my fingerprints, and if I answer "No" now I will have lied on my application and be fired. What is your advice?

I’m not sure which state you live in, but in NJ, juvenile offenses are only visible to the court system, government agencies and law enforcement.  You can legally deny a juvenile conviction on a job application.   You may encounter a problem if you ever apply for a job that require any type of certification or licensing.
