Surely you can pursue a paralegal degree. The question is will you be allowed to practice in the state of California. Contact the school where the program you want is offered. Career schools usually have job placement departments that assist their graduates in finding employment.  The school will be able to tell you based on your conviction if you will be eligible to be licensed.

I am hoping to get this question answered correctly, I currently live in Colorado Springs and in January of 2009 I picked up a felony menacing charge and 5 counts of child abuse without injury, after 26 days in county jail I finally accepted a plea for the felony menacing charge and 1 count of child abuse without injury, I was offered a 3-year deferred judgement, and told by my public defendant that this charge would never show up once the 3-year deferred was done, I learned that was untrue from my probation officer, I was also told I do not have to tell a potential employer about the felony unless it they specifically ask if it resulted in probation or a deferred adjudication, I hold a degree in Computer Technology and have been unable to obtain any work in my field since this charge, so my questions are:

1. Am I legally bound to disclose any of this to a potential employer?
2. Will I ever be able to work for the federal government or obtain a security clearance?
3. When doing a pre-employment background check, how will this charge appear to a potential employer, is it a conviction, or do they see it is deferred, or does it not appear at all (I was told by my probation officer that it does not appear).

If you can help me with these questions I would deeply appreciate it.

In most cases when the terms of deferred judgement are met, the charges are dropped. Since the charges were dropped, there is no conviction. Record of this can only be seen by the court system, law enforcement and certain government agencies. In deferred judgement, there is an initial plea of guilty. It is my understanding, at the end of the probationary period, if you have complied with all the conditions of probation, the guilty plea is considered withdrawn, the case is dismissed and no conviction enters. This is because a conviction is not final until there has been both a guilty plea or finding of guilt and the imposition of sentence. Since sentencing does not occur before the end of the probationary term, there is no conviction.

You can answer that question "no" on your employment application. However, be very careful to read the question correctly. As I encourage all ex-offenders and felons job searching, pay careful attention to the wording of the application. If it asks for convictions, you only have to list convictions. If it asks for arrests, you must list all arrests.


To get an absolute understanding, contact your local legal aid office. An attorney there can explain this better than I can.

My brother just got out of jail after serving for 8 months for marriage fraud, he is an honorably discharged veteran of Afghanistan war and is planning to go to school now under 9/11 GI Bill program.

I was wondering if you could help and tell us where to find the info about what jobs are restricted for felons and most important what licenses they absolutely can't obtain here in NYC.

For example real estate salesperson license, or physical trainer, or any securities licensees, like Series 7 and etc....

Felon in New York needs Job InfoI don't know how serious Marriage Fraud is.  I'm not sure if is a felony in the state of New York or how it is viewed by employers.  There is no list per se but certain jobs may require licensing or certifications that may be restricted to ex-offenders and felons based on their individual convictions. Your brother would have to contact each entity separately to find if he is eligible to be licensed or certified. Hello, my name is Stacie and back in 2002 I was convicted of Felony Theft (long story short, I was with my abusive ex and I took the blame for it) Thank God I was eventually able to move & get far away from him before he could kill me. I was recently approved for an expungement. I also received the paper work from the attorney general office stating that "this section has initiated the necessary action to remove the information from the files of the Indentification Divison, Federal Bureau of Investigation." I'm kinda confused when it comes to expungements. Am I able to join the military or work as a civilian on a military base? I just wanted to make sure it wouldn't come up on a background check since I'd be working for the government. I would more than APPRECIATE it if You could answer this question for me because I'm a single mom trying to find a good job so I can provide for my child.

Hello Stacie,

Generally speaking, expunged records are not simply erased. They will usually be visible to the court system, law enforcement and government agencies. I am going to say it will show up on a government background check. Of course this is not legal advice.  You should speak to a qualified professional who has experience in this area for a greater understanding of expungement as it relates to the statutes in your state.  I suggest contacting you local legal aid office.  As for joining the military, there are ex-offenders and felons accepted into the military everyday. The Army seems to be the most accepting branch for ex-offenders and felons.  Contact you nearest Army recruiter.  That person will certainly look into your eligibility.

I've applied to over 45 different places and its always "Sorry but our insurance won't allow us to hire an ex-offender," or simply no response at all! I'm sorry you are having so much trouble. My first suggestion to every felon I meet is to contact your local One-stop Career Center. Each state has a network of centers that offer a variety of free services that can get you ready for work and assist you in finding employment. In addition, these centers offer training programs that may prepare you for a career. Some services available are:


Career planning and counseling

Workshops (Resume Writing, Interviewing Skills, and related topics.)

Computers with internet access and word processing
Felon
Daily access to thousands of job listings

Job-related magazines and local newspapers

Job postings and referrals

Printers, fax machines, phones, and copiers for job search use

The One-Stop Career Center in Hudson County is located at 438 Summit Avenue, 2nd Floor
Jersey City, NJ . Many of the counselors have experience working with ex-offenders and felons.

A misdemeanor bad check charge is not the worst charge in the world. First of all are you licensed or can you be licensed in the state of Florida? You can find out here:

Ex-offender needs help finding a job in the medical fieldSecondly it is possible that the place where you applied has a policy of not hiring ex-offenders or felons? That may simply be the policy of that one organization.

I suggest you contact the school where you were trained and speak to someone in their placement department. They often have contacts that hire their graduates. Often they know the hiring practices of the organizations they work with.  Another suggestion I have for ex-offenders and felons who have medical training, is to apply to temporary employment.  Often permanent jobs are found by those who start as temporary employees.  There are also temporary employment agencies that serve the medical field.

I also suggest going to the One-stop career center in your area. They have counselors who can assist you in finding a job. There will be other services that could be helpful to you such as employment leads from the state job bank, resume writing assistance and other helpful services. Often the counselors are experienced in finding jobs for felons and ex-offenders. You can find your local One-stop career center here:

I have been offered many positions and then after the criminal background check told they were looking for someone else. Is there anything you know of in Illinois that might help me?

Hello Ryan,

First of all, like I tell all ex-offenders and felons applying for jobs - always be honest! If the the question is asked on the application, answer honestly.  If you are less than honest on the application and a background check is done, you have no chance at the job.  Even if you are hired in the interim, you will probably be fired for being dishonest, rather than having a record.

Many felons opt to apply for jobs at smaller companies. Smaller companies often don't do extensive background checks as a means to save money.

Secondly I would seek legal counsel to have this conviction downgraded possibly to a misdemeanor. This will make it easier to work with. Often felon job searches begin with legal assistance. Contact your local legal aid office. You may qualify for low cost or no cost assistance to get this done. You may find more information here:

Felon Looking for Job in NCI ran across your name on line. I was hoping you could help me. my son is 22. He did 2 years DOC time in Fl and is on Probation here in Raleigh, NC for three years now. He is on interstate compact probation. He has been home since May and has been perfect. As I know you hear so much he can not find a job anywhere. He is a hard worker and has worked as a commercial fisherman and my ex-husband had a tire and wheel shop that Josh, my son, worked at from 10-16.   He was employed with a hardscaping contractor for the last six months and they were paying him 7.50 dollars to dig trenches and build patios and pools and fire pits and sort. The hours were by the weather and sometimes he only got 8 hours a week. Jay would work 60 if he could get the hours. His boss laid everyone off and is going under due to economy and so now Jay is completely unemployed again. Can you help me by telling me anywhere that might hire him in Raleigh? He does have a reliable vehicle and a current drivers license.

He did try Walmart, Ross, kmart, hilton, Marriott, Lowes, Foodlion, merchants tire, jiffy lube, verizon and even burger King and ups and they were all a no go when it got to the background part. Several of these he had two or three interviews at and then was dropped due to background. Is there anywhere of that you know for sure will? he is getting so discouraged. He is very dependable and does not drink or do drugs and has a great family life and is a great people person and laborer.

Felon Looking for Job in NCI'm sorry your son is having so much trouble.  There is a concern I have.  You say he gets an interview but is turned away when the background issue comes up.  Is it possible he is not being totally honest when filling out the application.  If he answers the questions honestly, there are no surprises when background checks are done.  I encourage a every felon and ex-offender I work with to always be honest in all phases of the job search process.  Never volunteer information but if the question comes up on either on an application or interview, always answer honestly.  I know of too many people who have been less than honest when completing applications and gotten hired, only to be fired when background checks were done.  They were not fired for having criminal backgrounds, they were fired for falsifying the application.

Don't give up on the JobLink.  There are new employment listing added all the time.  Once he is registered as a JobLink client, he can check openings online.  If he hasn't already, he should speak to a counselor there so he can get one-on-one assistance. He should tell the counselor about his prior experience so he can browse available jobs by interest.  The JobLink in Raleigh is:

In the meantime, I suggest he contact Goodwill Industries of Eastern North Carolina. Goodwill offers ex-offenders employment opportunities in their retail locations.  This may help until he able to a find more suitable job.

Expungement would hide the conviction from public view meaning that if it is granted, it would only be visible to the court system, law enforcement and the court system.

Felon needs help finding a job in ArkansasI live in Rogers, Arkansas but would be willing to travel anywhere in the region for work. My conviction is for possession of a controlled substance (meth).

My "friend" wore a wire on me. This happened in 2003. I was never in trouble before that, nor have I been since. Please help me find an employer that believes ex cons have paid their debt to society. Or at least want to give a good person a chance.
