Felons, jobs and Deferred Adjudication  Please help! I found your blog online.

I'm currently serving 5yrs of probation for deferred adjudication (for felony case). I feel that I should contact the attorney that handled my case - because I recall my attorney saying that I either pay off my debt and be done with everything or pay while serving the whole 5 yrs of probation. I am still having a hard time finding a job. The majority of my work experience is in an office environment, with that in mind - no one will hire me! I have had tons of interviews, and I've been let down. I have some production/warehouse experience, but that's still not helping. I was told by my PO that I have the right to choose "No" when it comes to the question on any application asking "Have you ever been convicted of a felony?" And, I choose "Yes" when it asks me "Have you ever been convicted and/or deferred adjudication." My background check comes up showing my felony. I'm still serving this probation until 2014, and my PO told me I have to wait until 2014 to try to remove this thing off my record. Now there was an increase in my probation fees from the original judgement. I could barely afford it much less paying more. I'm still not working. I moved back to Texas recently and started working for a small business (attorney's office) that didn't do background checks. So, I was with that office shortly while looking for another job, and then I had an excellent opportunity through an agency that paid more money, and I was guaranteed the pay rate increase and filled out the paperwork and I went through the interview. Everything went through and I was chosen for the position. And, the day I was going to start was the same day I received a call that my background disqualifies me from the job offer. I have not been convicted of any offense. I have already been to the Texas Workforce Center, and applied through them. Had more interviews, and continued to be rejected for numerous positions that I would qualify for - but it's the background check that hurts my job search. Please advise!

Hello Bess,

For those unfamiliar with Deferred Adjudication, in most cases, adjudication is withheld pending some other action, usually successful completion of the terms ( usually a fine and probation,) dismisses the case. If you successfully complete the terms, in most cases the charges are dismissed. When you complete the terms you will be given a document declaring the charges dismissed. In your case, the probation period is five years and that may present a problem until probation is complete. This will appear on background checks as a pending charge that sometimes will turn an employer off.

As I often suggest to ex-offenders and felons looking for jobs to consider working as a temporary employee as a way of getting a permanent job. Temporary agencies are a great way to quickly get back into the working world. Many employers use agencies to try out new employees before hiring them. Good workers are hard to find. If an employer sees that you are hard working, punctual and fit in well, he may offer the job permanently.

The key to applying for temporary jobs for ex-offenders and felons is to apply at smaller independent agencies rather than large national companies. Small independent agencies have fewer hiring restrictions than larger national companies and are free to hire anyone they feel that can help them. You can get a list of these agencies in your local phone directory.

Once your probation is finished I suggest that you apply for expungement. This may help when it comes to background checks. Since expungement is a legal process, I strongly urge you to get professional assistance.

My name is Sue. I live in Maryland. While working for a cleaning company I was pulled over in my personal car while with a coworker on the way to the next job (had been asked by the company owner to use my personal car for the day due to the company car being in the shop). She started getting antsy as soon as the officer walked up, he asked her to step out and searched her. He found over 20k in gold jewelry in her possession. I later found out she had stolen from every house we had been in. None was found on me, but some had fallen out of her apron, in between her seat and the door. I was charged along with her, and later convicted of felony grand theft. I had been facing eviction and had money troubles (single mom of two working 40 hours and barely making enough to pay bills) plus I had pawned jewelry a couple weeks earlier. With this and my co worker saying I knew what she was doing was apparently enough to convict me. I was given probation while she received jail time. I was working at a bank when I got convicted and was fired as soon as they found out. My problem is, I can't find a job now, and having never been in prison I don't qualify for most of the reentry programs. I'm still a single mother and am close to losing everything. Is there anything that may be able to help me? I feel like I got a life sentence. I'm going to lose everything if I don't find a job quickly, but I can't find a job because of the felony. How am I supposed to keep going when there is no where to go?

Hello Sue,

That's quite a story. It is my experience that ex-offenders and felons convicted of any kind of theft are usually not considered for positions where valuables are at risk. You may have to concentrate your efforts toward jobs that do not include the exchange of money or goods. You may have to think about doing work you have never done before. This may even be an opportunity to get training for a new career.

I suggest you try your local One-stop Career Center. Each state has a network of centers that offer a variety of free services that can get you ready for work and assist you in finding employment. In addition, these centers offer training programs that may prepare you for a career. Some services available are:

Career planning and counseling

Workshops (Resume Writing, Interviewing Skills, and related topics.)

Computers with internet access and word processing

Daily access to thousands of job listings

Job-related magazines and local newspapers

Job postings and referrals

Printers, fax machines, phones, and copiers for job search use

There are counselors there whose function is helping citizens gain employment. Many of them have experience working with ex-offenders and felons looking for jobs.

I suggest you try Workforce Solutions in El Paso. One-stop Career Centers are underutilized but valuable resources that can help get felons jobs.  There you will find a variety of service that can help you find a job and perhaps a new career. Some services can help you:

Find out about job openings

Learn about strategies for finding a job

Get help in preparing for job interviews

Get help preparing your resume

Post your resume for employers to see

Of course there is no simple solution that will cure your problem, but you will get help so you can help yourself. There may also be counselors there that have experience assisting ex-offenders and felons.

Hello,

I'm sorry to bother but I saw your address on a web page and I had to ask you a question. I hope you can help. I was arrested in 2008 and given 2 years of probation. After successfully completing my probation, I was placed on deferred adjudication. The problem is that I really need a job and I a worried I could be affected for the rest of my life.

My questions are: If an employer checks my record will it show? How can I possibly fix this situation? Can an expungement help? How can I obtain a job? I would really appreciate your response.

Hello Andres,

 Do felons list “Deferred Probation” on Job Applications?In reference to your deferred adjudication, you must consider the conditions of your deferment. In most instances, once the conditions are met (typically a fine and probation,) the charges are dismissed. They will however appear on background checks as charges but not convictions. Anybody doing a background check (other than law enforcement,the court system, and government agencies) will only see the charges. Employers typically are only concerned about convictions. With that being said, I'm not sure what effect it is having on your ability to find a job. Expungement maybe an option in your state. If it is, then employers won't be able to see even the charges. As I often suggest to ex-offenders and felons looking for jobs, legal assistance may help them clean up their records. You may find low-cost or even no-cost legal help at your local legal aid office.

 Female felon in MD needs job assistanceHello my name is Heather and I have a felony conviction for Theft. This happened in 2008 but charges did not get filed until Dec. 2009 and my conviction date was not until March 2010. The job I was working at had to let me go because the felony made me ineligible to work at the assisted living home. They are currently paying me unemployment because this charge had nothing to do with my job. My unemployment is about to run out and I have not been able to get passed the interview once they ask about my background. I live in Maryland and there are not many places to assist women with felonies to find work. My probation office definitely was no help at all.

I have experience in customer service, data entry, elderly caregiving, driving 15-passenger buses and a bachelor's degree in business. What do you suggest I do to try to find employment? I am willing to start fresh with a new career option if need be.

Hello. My name is Mikee and I am 21 years old. I was recently charged with felony possession of methamphetamine for drugs that my (now) ex-husband left in my car. I did not know he was on drugs and now it has ruined my life and future.

I'm having a terrible time finding a job. My biggest problem is that I am not qualified to do anything, really. I only have one year of experience in retail sales. I do not have a college degree, but I did graduate from high school and complete a year in community college. I have many skills: computers, customer relations, fluency in Spanish; my town (Columbus, GA) is just not a good place to find a job, even with a clean record. I have tried Goodwill with little success. They look at me without much hope when I tell them I have a felony, but I have tried to keep my spirits up regardless and keep searching.

I would very much appreciate if you could help me with some resources for felons without much experience. I am not picky about jobs, I cannot afford to be. I just want someone to give me a chance, let me get my foot in the door. I spent two months in jail. The crime has been paid for, even if I was not the one to commit it. Please, I live with my parents again now and they are threatening to put me out. They do not understand how hard it can be for felons. Thank you for providing such a wonderful resource for felons. You are doing good work here.

I have a friend who is currently serving time for a involuntary vehicular manslaughter dui without negligence... the sentence is part of a plea bargain. He was told that if anyone was worthy of a probational offer it would be him. Things didn't exactly work out accordingly in the end. In any case, he is highly educated. He has a bachelors and mba both from top universities. Do you think it will be possible for him to get back into the corporate world? It seems that once a person has a felony, they are incapable of holding certain licenses and jobs. Thank you very much for your time.

Hello,

The first thing that your friend can do is to check to see if any certifications he held were affected by his conviction. If so, what does he need to do to have them reinstated if possible. Often ex-offenders and felons looking for jobs need a little legal assistance. He should speak with an attorney to see if expungement is an option in your state. He should also look into a Certificate of Rehabilitation. A Certificate of Rehabilitation is a court order, which declares that a person who has been convicted of a felony is rehabilitated. If a petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the granting court and constitutes an application for a pardon.

I have just been offered a position to teach in the Palm Beach County School District. On the Security Form they have asked me to fill out the first question is, "Has your driver's license EVER been suspended or revoked?" Farther down, there is a question, "Have you EVER plead no contest in a criminal proceeding?"


When I was 16 yrs old (2001), I was arrested for underage drinking, and I plead no contest and with the disposition that my license was suspended for 6 months. I did a background check on myself to figure out the dates, but there was no record of it. Do I answer yes to these questions? My concern is that I have to have my fingerprints taken to verify my background, and I remember having my fingerprints taken after the arrest; I am worried that there might be a hit in the system for my fingerprints, and if I answer "No" now I will have lied on my application and be fired. What is your advice?

juvenile offenses are only visible to the court system, government agencies and law enforcement.  You can legally deny a juvenile conviction on a job application.   You may encounter a problem if you ever apply for a job that require any type of certification or licensing.


Often felon job searches begin with some legal assistance. To be sure, contact your local legal aid office. You will be able to get free legal information about how your juvenile record may affect future employment opportunities.

I worked in a retail store in Oklahoma in 2008. after working there for about 6 months, I asked management about training to be a team lead. while I was in training. I was accused of stealing 700 dollars. I told my lawyer I wasn't a thief and that I loved my job. He asked me if I was willing to take a lie detector test and I said absolutely. then he decided against it for whatever reason. Anyways, he convinced me to waive my right to a preliminary hearing and to take a plea bargain. I wanted to prove my innocence but I didn't have the money and I was scared that I would lose somehow. I plead no contest and received a 3 year deferred sentence and I'm due back in court in 2012 to have my record expunged. But for now its making it very difficult to find a job. All my work experience involves cash handling and it seems no one wants to hire someone without previous experience. I don't know where to look or how to start. I don't have a very stable work history, and this pending felony is really making it hard.... any suggestions?

Hello,

Because you have a deferred sentence, you do not have a conviction. Usually a deferred sentence is an agreement which probation and a fine are given. Once you complete the terms of your agreement, the charges are usually dropped. You will however still have an arrest record involving theft. As I often advise ex-offenders and felons with this type of charge, perhaps you should look for different jobs since your charge involved theft.  

Another option is to see if expungement is an option in your state.  Expungement will help to hide the charge from public view.

These are often overlooked and underutilized resources.  There are many services as well as counselors that can help ex-offenders and felons get jobs. Educated felon in N.C. in search of jobOn June 3, 2010 accepted a plea bargain and I now have a c felony and an e felony on my record (c felony: attempting to manufacture schedule I / e felony manufacturing schedule VI ) I have been put on probation for eight years and I assume I am not eligible for expungement until after the probation. I am 56 years old, I have a PhD in psychology. Since almost all employers do criminal background checks, I also assume that my former career as a college professor is over. I am pursuing a Masters degree in addiction counseling but I can't live on just my student loans with court fines and probation fees added to my cost of living.

The one-stop center in Asheville, NC has not been helpful. they referred me to Goodwill who only help ex-convicts coming out of prison. The probation office is not very helpful - they consider it my responsibility to be gainfully employed - which is extremely hard to do under the circumstances. The federal bonding program sounds good, but the Fidelity Bond Certificate requires an employer - so you have to be employed or offered employment before the bond is issued! - I would appreciate any advice you can give me.

Hello M.T.,

Please don't give up on the One-stop. Just because they were not able to help you that one time, doesn't mean they won't be able to help you in the future. Don't forget they have access to the bank of available jobs in your state.  As far the Federal Bonding Program being useless, it is always a powerful selling point on interviews.  It may make an employer more at ease about hiring a felon if he knows you can be bonded.

Hi,

I am a convicted felon with several charges I received with in a 5 month period between Dec '02 to April '03 . These were mostly all drug trafficking charges. There were several, and I was arrested two 3 times in total between these 5 months. I was 22 at the time. I did 3 yrs in prison and got out in 8/2006. I then moved from Florida where I lived my entire life to Texas and hopes of starting a new life. Till now I was very successful in do this. I currently work for a Wireless Provider as a Store Manager over two stores with an excellent track record.

When hired for this company start up company they only did background checks in Texas. All my charges were in Florida. Now because of the companies success we being bought out, or merging with a bigger wireless provider. The merger will take place by the end of September 2010.

Since we are merging the new company is asking us all to fill out applications, and sign off on National background checks. I'm very concern with this and I don't what the outcome will be.

I guess my question were can someone with my get find a career. And in your opinion what do you think will happened to me?

Hello Steven,

As I always advise ex-offenders and felons looking for jobs is to Always be Honest! Never take the risk of non-disclosure only to found out later. Most employers won't fault you for being a felon but will for being a liar.

In your case, you are a valued employee, which are hard to come by. What you do have in your favor is that your past convictions have nothing to do with theft which is important in retail and they had nothing to do with a former employer.

Tell the truth, which is your part and hope that your new employer will do the right thing

Hello, my name is Stacie and back in 2002 I was convicted of Felony Theft (long story short, I was with my abusive ex and I took the blame for it) Thank God I was eventually able to move & get far away from him before he could kill me. I was recently approved for an expungement. I also received the paper work from the attorney general office stating that "this section has initiated the necessary action to remove the information from the files of the Indentification Divison, Federal Bureau of Investigation." I'm kinda confused when it comes to expungements. Am I able to join the military or work as a civilian on a military base? I just wanted to make sure it wouldn't come up on a background check since I'd be working for the government. I would more than APPRECIATE it if You could answer this question for me because I'm a single mom trying to find a good job so I can provide for my child.

Hello Stacie,

Generally speaking, expunged records are not simply erased. They will usually be visible to the court system, law enforcement and government agencies. I am going to say it will show up on a government background check. Of course this is not legal advice.  You should speak to a qualified professional who has experience in this area for a greater understanding of expungement as it relates to the statutes in your state.  I suggest contacting you local legal aid office.  As for joining the military, there are ex-offenders and felons accepted into the military everyday. The Army seems to be the most accepting branch for ex-offenders and felons.  Contact you nearest Army recruiter.  That person will certainly look into your eligibility.

Felon in NJ needs Job Search AdviceI was convicted of a felony about a year ago for a theft that took place when I was 19 years old. I am now 21 years old in desperate need of gainful employment. I have a great work history, however the mistake that I made as an unwise young man is preventing me from attaining employment. When I go to interviewers usually love me and WANT TO HIRE ME, but once the background check is administered I don't hear from them. I am extremely remorseful for the mistakes that I have made and it grieves me everyday to know that I can't turn back the hands of time. Since my conviction I've gone back to school. Two weeks after my release I landed a job at Banana Republic of Short Hills Mall . However I was terminated a few weeks before Christmas for the record.

I received my diploma in January and I'm looking forward to college next semester. I have a two year old son that looks up to me so much and i want to be the BEST that I can be for him. I just got hired at the airport on Friday . They want me to come in for a drug test and finger printing on Monday. Should I go In knowing I have a record? Do I Even Qualify? It would change my life it you could help in any way to get this baggage handling position.

Hello Rayon,

My guess is when you apply for jobs, you are not completely honest on applications. Often it is tempting not to list a conviction. Even if you get hired, once the background check is done you will probably get fired - not for having a conviction, but for being dishonest. I always encourage ex-offenders and felons looking for jobs is to always be honest.

In regards to your upcoming opportunity, you have to take it. You have a theft conviction which will often make you an unlikely candidate for positions where anything of value is at risk. A position as a baggage handler doesn't require a great amount of trust so you have a decent shot. In the future, honesty is always the best policy.  I would also look into the federal bonding program. Check out the video below:
