Deferred adjudication, felons and jobs

Do felons list “Deferred Probation” on Job Applications?

Deferred adjudication, felons and jobs
Hello,

I'm sorry to bother but I saw your address on a web page and I had to ask you a question. I hope you can help. I was arrested in 2008 and given 2 years of probation. After successfully completing my probation, I was placed on deferred adjudication. The problem is that I really need a job and I a worried I could be affected for the rest of my life.

My questions are: If an employer checks my record will it show? How can I possibly fix this situation? Can an expungement help? How can I obtain a job? I would really appreciate your response.

Andres

Do felons list “Deferred Probation” on Job Applications?

Hello Andres,

Do felons list “Deferred Probation” on Job Applications? In reference to your deferred adjudication, you must consider the conditions of your deferment. In most instances, once the conditions are met (typically a fine and probation,) the charges are dismissed. They will however appear on background checks as charges but not convictions. Anybody doing a background check (other than law enforcement, the court system, and government agencies) will only see the charges. Employers typically are only concerned about convictions. With that being said, I'm not sure what effect it is having on your ability to find a job. Expungement maybe an option in your state. If it is, then employers won't be able to see even the charges. As I often suggest to ex-offenders and felons looking for jobs, legal assistance may help them clean up their records. You may find low-cost or even no-cost legal help at your local legal aid office.

In reference to getting jobs, Take a look at the video below.

I hope this helps.

Female felon in MD needs job assistance

Female felon in MD needs job assistance

Female felon in MD needs job assistanceHello my name is Heather and I have a felony conviction for Theft. This happened in 2008 but charges did not get filed until Dec. 2009 and my conviction date was not until March 2010. The job I was working at had to let me go because the felony made me ineligible to work at the assisted living home. They are currently paying me unemployment because this charge had nothing to do with my job. My unemployment is about to run out and I have not been able to get passed the interview once they ask about my background. I live in Maryland and there are not many places to assist women with felonies to find work. My probation office definitely was no help at all.

I have experience in customer service, data entry, elderly caregiving, driving 15-passenger buses and a bachelor's degree in business. What do you suggest I do to try to find employment? I am willing to start fresh with a new career option if need be.

Female felon in MD needs job assistance

Hello Heather,

The only organization in Maryland that I know of that provide services specifically for female ex-offenders and felons is the National Women's Prison Project.

Felon in Ohio needs help finding Jobs

Felon in Ohio needs help finding Jobs

Felon in Ohio needs help finding Jobs
Hello. My name is Mikee and I am 21 years old. I was recently charged with felony possession of methamphetamine for drugs that my (now) ex-husband left in my car. I did not know he was on drugs and now it has ruined my life and future.

I'm having a terrible time finding a job. My biggest problem is that I am not qualified to do anything, really. I only have one year of experience in retail sales. I do not have a college degree, but I did graduate from high school and complete a year in community college. I have many skills: computers, customer relations, fluency in Spanish; my town (Columbus, GA) is just not a good place to find a job, even with a clean record. I have tried Goodwill with little success. They look at me without much hope when I tell them I have a felony, but I have tried to keep my spirits up regardless and keep searching.

I would very much appreciate if you could help me with some resources for felons without much experience. I am not picky about jobs, I cannot afford to be. I just want someone to give me a chance, let me get my foot in the door. I spent two months in jail. The crime has been paid for, even if I was not the one to commit it. Please, I live with my parents again now and they are threatening to put me out. They do not understand how hard it can be for felons. Thank you for providing such a wonderful resource for felons. You are doing good work here.

Mikee.

NC mom with a NJ felony charge needs job

NC mom with a NJ felony charge needs job

NC mom with a NJ felony charge needs job
Hi,

My name is Courtney. I received a charge in 2005 for signing checks. The total was either $400 or $600. I cannot remember without looking at the paperwork which is currently filed away. I spent about 4 1/2 months in the county jail waiting for a court date. Finally when my court date arrived, I was released and sentenced to 1 yr probation w/ fines which was all taken care of. My probation officer allowed me to complete the program early. I believe it was 10 months when I was done. I am really not sure of what the charge is, so I need to know how I can find out what the exact charge is, if it could be expunged and how I can get a job.

Please help.

Hello Courtney,

The easiest way to get a copy of your criminal record is from your probation officer. If that is not possible,

NC mom with a NJ felony charge needs jobI encourage anyone looking for expungement to seek legal assistance.  My suggestion is to contact the legal aid office in your area.  Legal aid will be able to offer advice and even assistance applying for expungement.

An Educated Felon needs Job Search Advice

An Educated Felon needs Job Search Advice

An Educated Felon needs Job Search Advice
I have a friend who is currently serving time for a involuntary vehicular manslaughter dui without negligence... the sentence is part of a plea bargain. He was told that if anyone was worthy of a probational offer it would be him. Things didn't exactly work out accordingly in the end. In any case, he is highly educated. He has a bachelors and mba both from top universities. Do you think it will be possible for him to get back into the corporate world? It seems that once a person has a felony, they are incapable of holding certain licenses and jobs. Thank you very much for your time.

An Educated Felon needs Job Search Advice

Hello,

The first thing that your friend can do is to check to see if any certifications he held were affected by his conviction. If so, what does he need to do to have them reinstated if possible. Often ex-offenders and felons looking for jobs need a little legal assistance. He should speak with an attorney to see if expungement is an option in your state. He should also look into a Certificate of Rehabilitation. A Certificate of Rehabilitation is a court order, which declares that a person who has been convicted of a felony is rehabilitated. If a petition for a Certificate of Rehabilitation is granted, it is forwarded to the Governor by the granting court and constitutes an application for a pardon.

I hope this helps.

An Educated Felon needs a Job

An Educated Felon needs a Job

An Educated Felon needs a JobIn response to your postings regarding 'help for felons pursuing employment,' questions emerge regarding my status. I appreciate any information you can supply. All of my convictions are ‘drug or controlled substances' felonies but none are for 'Sale of.' Briefly, I spent a year incarcerated by Ohio at their Mansfield Reformatory and Lebanon Correctional Institute. Upon release, I remained clean and sober for eight years. A relapse lasted for over a year and netted me two low-level felonies for which I spent three months in the county jail in northern Kentucky. Over twenty years passed before I committed two felonies of the lowest order i.e., intent to posses and possession of paraphernalia. Adjudication resulted in one-year probation, which ended six years ago. Currently, I am 58 years old and receiving a modest disability payment for an incurable disease. However, I am feeling better and my physicians informed me a cure becomes available in one or two years at the latest. I do want to work or operate my own business. I earned a BA. In 1984 and completed over 60 hours of graduate work before two family deaths sent me into a deep, clinical depression. Some people refer to this educational situation as an ABD (all but dissertation). I did my graduate work at the University of Cincinnati and the Union Graduate School in professional psychology, while working as the administrator of an out patient drug, alcohol, and mental health department of a large health care system in Cincinnati. In 1991 -1992, I worked in a private practice as a Psychology Resident according to provisions of the Ohio State Psychology Board.

Apparently, background checks are performed routinely now and I am concerned about my criminal background even though it is all non-violent and drug related. I am considering returning to university studies to gain an entry into a new line of work or self-employment. Can you provide me with any assistance? Currently, the depression in almost overwhelming when I see how I allowed my life to be ruined by addiction. I know I am capable - I am a member of the American Mensa High IQ Society and earned many academic awards and honors during my life. I come from a successful family with a father who was a chemical engineer and my mother is a retired schoolteacher. I have one daughter from four marriages and two wonderful grandchildren; one of whom is a rising film star. I want to work and I need to work. I feel like it just isn't worth it all at times. This is why I write to you and feel a guarded new sense of hope.

An Educated Felon needs a Job

That is quite a background. Self-employment is always an option for ex-offenders and felons having difficulty finding jobs. You may get some guidance from and organization called S.C.O.R.E (Service Corps of Retired Executives.) They offer free business advice to entrepreneurs. you can get more information here:

http://www.score.org

With your background, you may also want to contact your local United Way. The United Way supports a number of non-profit social service organizations that may be able to use someone with your extensive qualifications as well as agencies that help ex-offenders and felons.

I hope this helps.

Felon in Cali wants job as Paralegal
I am a convicted felon and want to know if I am able to get a Paralegal degree and practice in the state of California? My conviction was for Bank Robbery. Thank you for your time.

Felon in Cali wants job as Paralegal

Surely you can pursue a paralegal degree. The question is will you be allowed to practice in the state of California. Contact the school where the program you want is offered. Career schools usually have job placement departments that assist their graduates in finding employment.  The school will be able to tell you based on your conviction if you will be eligible to be licensed.

I hope this helps.

Juvenile Felon needs Job Search Advice

Juvenile Felon needs Job Search Advice

Juvenile Felon needs Job Search AdviceHello,

I have just been offered a position to teach in the Palm Beach County School District. On the Security Form they have asked me to fill out the first question is, "Has your driver's license EVER been suspended or revoked?" Farther down, there is a question, "Have you EVER plead no contest in a criminal proceeding?"

When I was 16 yrs old (2001), I was arrested for underage drinking, and I plead no contest and with the disposition that my license was suspended for 6 months. I did a background check on myself to figure out the dates, but there was no record of it. Do I answer yes to these questions? My concern is that I have to have my fingerprints taken to verify my background, and I remember having my fingerprints taken after the arrest; I am worried that there might be a hit in the system for my fingerprints, and if I answer "No" now I will have lied on my application and be fired. What is your advice?

Thank you for your time.

Juvenile Felon needs Job Search Advice

I’m not sure which state you live in, but in NJ,
juvenile offenses are only visible to the court system, government agencies and law enforcement.  You can legally deny a juvenile conviction on a job application.   You may encounter a problem if you ever apply for a job that require any type of certification or licensing.

Often felon job searches begin with some legal assistance. To be sure, contact your local legal aid office. You will be able to get free legal information about how your juvenile record may affect future employment opportunities.

A felon with deferred sentence looking for jobs

A felon with deferred sentence looking for jobs

A felon with deferred sentence looking for jobsHello,

I worked in a retail store in Oklahoma in 2008. after working there for about 6 months, I asked management about training to be a team lead. while I was in training. I was accused of stealing 700 dollars. I told my lawyer I wasn't a thief and that I loved my job. He asked me if I was willing to take a lie detector test and I said absolutely. then he decided against it for whatever reason. Anyways, he convinced me to waive my right to a preliminary hearing and to take a plea bargain. I wanted to prove my innocence but I didn't have the money and I was scared that I would lose somehow. I plead no contest and received a 3 year deferred sentence and I'm due back in court in 2012 to have my record expunged. But for now its making it very difficult to find a job. All my work experience involves cash handling and it seems no one wants to hire someone without previous experience. I don't know where to look or how to start. I don't have a very stable work history, and this pending felony is really making it hard.... any suggestions?

A felon with deferred sentence looking for jobs

Hello,

Because you have a deferred sentence, you do not have a conviction. Usually a deferred sentence is an agreement which probation and a fine are given. Once you complete the terms of your agreement, the charges are usually dropped. You will however still have an arrest record involving theft. As I often advise ex-offenders and felons with this type of charge, perhaps you should look for different jobs since your charge involved theft.

Another option is to see if expungement is an option in your state.  Expungement will help to hide the charge from public view.

Felon in TX Needs Help Finding a Job

Felon in TX Needs Help Finding a Job
Hello!

My name is Brittani. I am located in Richardson, TX. I got a felony back in 2003 for a theft charge and since this has happened I have been very unsuccessful on finding a employer to give me a chance. Is there anyway you could please help me out with this???

Thanks,

Brittani

Felon in TX Needs Help Finding a Job

Hello Bittani,

If you have a parole or probation officer, you could ask about others on his/her client list to see if and where they were able to get jobs. Probation and parole officers usually know of employers who have been known to hire ex-offenders and felons.

Since you have a theft charge, you may be more successful apply for jobs that do not involve the handling of money or valuables.

Another option is to apply for jobs at temporary employment agencies.  Temporary employment is a great way for felons to get jobs that may turn into more permanent employment.

I would also go to your local One-stop career center. Felons job searching can find a variety of services that could help them prepare for employment. Check out the video below:

I suggest you go to your local One-stop Career center. These are often overlooked and underutilized resources.  There are many services as well as counselors that can help ex-offenders and felons get jobs. Often the counselors are experienced at assisting those with criminal backgrounds. The counselors also have access to the bank of open positions in your state.

In support of a felon

Hi Eric,

I just happened on your blog today. I am in a committed relationship with a guy and things are progressing in the serious direction. However, he has recently told me he is a felon. He served 2 years in prison for robbery. All this occurred approx. 10 years ago. My question is how does this potentially effect our relationship long therm if I was to decide to settle down/marry him? Will this effect our ability to buy a home (i.e. Condo or Co-OP ), gainful employment etc. I apologize in advance if my questions sound ignorant.

Nina

 In support of a felon

Hello Nina,

In support of a felonI'm happy to hear that your relationship is working well. The fact that your significant other is a felon may test your commitment a little. I don't foresee his past being a barrier to owning a home etc., but it may impact his ability to readily get the type of job he wants right away.  Of course I am not a relationship expert, but if he has not decided on a life without crime, you may have a tough time of it.  Even a person with the best of intentions cannot change someone who has not made his mind that he wants something else in life.

Being a felon may make getting a good job a little tougher that those who are not so he may need your total support. Help him stay focused on your mutual goals and all will work out.

Best of luck to you.

Illinois felon wants job in Tennessee
I received a felony dui in the state of Illinois. I wanted to relocate to the south but it is plagued with the Old Jim Crow Laws. In the state of Illinois, 3 dui's are considered a felony. In the state of Tennessee, it is 4. If I relocate to the state of Tennessee, can this 13 year old felony conviction from Illinois stop me from gaining employment in Tn. or any other state.

Ann

Illinois felon wants job in Tennessee

Hello Ann,

Illinois felon wants job in Tennessee
A felony conviction in one state may not be a felony in another state but will still show up on a background check as a felony. Often felon job searches begin with legal assistance. You may want to consider applying for expungement in Illinois. You can get more information here:

http://www.illinoislegalaid.org/index.cfm?fuseaction=home.dsp_content&contentid=4646#a=questions

Bear in mind, if you are granted an expungement, your conviction will always be visible to law enforcement, the court system and government agencies.

Best of luck to you.

A felon with deferred judgement looking for jobs

A felon with deferred judgement  looking for jobs

A felon with deferred judgement looking for jobsHello there,

I am hoping to get this question answered correctly, I currently live in Colorado Springs and in January of 2009 I picked up a felony menacing charge and 5 counts of child abuse without injury, after 26 days in county jail I finally accepted a plea for the felony menacing charge and 1 count of child abuse without injury, I was offered a 3-year deferred judgement, and told by my public defendant that this charge would never show up once the 3-year deferred was done, I learned that was untrue from my probation officer, I was also told I do not have to tell a potential employer about the felony unless it they specifically ask if it resulted in probation or a deferred adjudication, I hold a degree in Computer Technology and have been unable to obtain any work in my field since this charge, so my questions are:

1. Am I legally bound to disclose any of this to a potential employer?
2. Will I ever be able to work for the federal government or obtain a security clearance?
3. When doing a pre-employment background check, how will this charge appear to a potential employer, is it a conviction, or do they see it is deferred, or does it not appear at all (I was told by my probation officer that it does not appear).

If you can help me with these questions I would deeply appreciate it.

Thank You.

A felon with deferred judgement  looking for jobs

Hello,

A felon with deferred judgement looking for jobs
In most cases when the terms of deferred judgement are met, the charges are dropped. Since the charges were dropped, there is no conviction. Record of this can only be seen by the court system, law enforcement and certain government agencies. In deferred judgement, there is an initial plea of guilty. It is my understanding, at the end of the probationary period, if you have complied with all the conditions of probation, the guilty plea is considered withdrawn, the case is dismissed and no conviction enters. This is because a conviction is not final until there has been both a guilty plea or finding of guilt and the imposition of sentence. Since sentencing does not occur before the end of the probationary term, there is no conviction.

You can answer that question "no" on your employment application. However, be very careful to read the question correctly. As I encourage all ex-offenders and felons job searching, pay careful attention to the wording of the application. If it asks for convictions, you only have to list convictions. If it asks for arrests, you must list all arrests.

To get an absolute understanding, contact your local legal aid office. An attorney there can explain this better than I can.

I hope this helps.
