My son is 29 yrs old and has two theft felonies in his background. But thanks to a good woman and two wonderful sons age 7 and 4 he has turned his life around. For 2 1/2 yrs he has gone to the methadone clinic, no longer hangs with any of the drug friends, went to Kaplan college and got his electrical technician certificate, has 6 years experience   framing/roofing/plumbing/remodeling/tree trimming but just can't find work that lasts for more than a few days at a time. All he wants is a chance to earn enough money to feed his children and pay his electric bill. We have put out applications everywhere but the minute he is truthful and tells the employer of his criminal record (which is has a written copy he can show them) they just treat him like he is dirt.

Where can we turn? He is a hard worker.

Hello Nancy,

Your son is ahead of most ex-offenders and felons looking for jobs. Even though things might seem tough, people with criminal record might have to thing outside-the-box when it comes to looking for work. He has skills in electrical work and carpentry. He could start a home handyman business the he can can use to build a good income. If he is willing to put in a little work, he could turn odd jobs into a full time home handyman business. You'd be amazed how many people can't put in a light switch or fix a leaky faucet. You could offer to do small jobs at a fraction of what big time contractors charge while guaranteeing quality work.

Starting his own business will be a lot of work. He would have to be prepared to work long hours finding customers and promoting his business. The least costly way to start is to print up flyers with tear off tags, and post them on community bulletin boards. Post them in grocery stores, laundry rooms, community recreation centers, bus stops, and churches. Highlight the quality of his service and his dependability. He should always include phone number tear off tags on the flyer, so interested people can just take one phone number.

Another interesting option is to make a list of local contractors and offer to himself out as a day laborer. There are probably quite a few contractors in your area looking for day laborers as a way to keep their own costs down. He could get a list of contractors that have recently been issued building permits at your local municipal building. This is public record so he should have no trouble getting that information.

Still another option is to find landlord with multiple rental properties. Landlords need dependable people to keep the properties up and do repairs that tenants need done.  If he finds one with enough rentals, it could be a full time job that would pay well.  One great way to find a long list of property owners is contacting your local office of Housing and Urban Development.  HUD pays subsidies to landlords on behalf of tenants.  In order to get payments, the properties must meet HUD standards and are inspected frequently. 

If his dream is finding regular employment, he shouldn't give up and he could earn a living in the meantime.

Ex-offenders, Felons, Jobs and Drug Tests

I have been helping Ex-offenders and Felons get jobs for many years and I have helped thousands get jobs. One of the biggest barriers that some ex-offenders place in front of themselves is not being able to pass drug tests.


Drug testing has become an important safety issue for many employers. Many companies now have some form of drug testing for prospective employees. Drug testing serves to lower the instance and issues associated with drug abuse in the workplace, including lateness, absenteeism, turnover rate, crime, violence, theft and other side effects.  Too many of my students believe  that they can use illegal drugs and still pass drug tests. With my experience in human resources, management and employment training, I will attempt to expose the myths and give the facts on drug tests.

The typical methods that employers use for detecting illegal drugs are:

Urine Testing:

Urine testing is the most common of the screenings used for illegal substances. Drug users would sometimes use outlandish methods like using fake urine that is sold in some places or using a sample taken from someone else in place of their own. To avoid the applicant using urine not his own, I would always have a sample given in the presence of a staff member. Others believe that drinking large amounts of water will dilute the sample and the drugs will not be detected. Water passes through the body much too quickly to be effective. I have even heard of using ridiculous home remedies to beat urine tests. These remedies include aspirin, eye drops, ammonia, vinegar, bleach and even commercial drain cleaners! There are commercial products that claim to mask the traces of drugs making them undetectable.  many of these products use nitrates which will mask the drug to an extent, but laboratories have gotten more savvy and also test for the nitrate compounds that these products contain. In many cases the presence of nitrates will result in a failed test.


A single use of marijuana can be detected up to seven days in the urine, while extended use can be detected up to 100 days

Amphetimines, cocaine, heroin, opiates and PCP can be detected accurately up to seven days after use.

Saliva Testing

Saliva tests are the least popular because it can only detect toxins used three or four days prior. Saliva tests can detect fresh elements of alcohol and drugs in the mouth.

Hair follicle Testing

My experience is that hair follicle testing is the most effective method of narcotics screening.  A hair test is an examination that uses a small sample of hair to identify specific drugs used by the person being tested. Typically, the sample is taken from the head, but can be collected from several other body locations such as arms, legs and back and may be combined to obtain the required amount of hair.  Drugs can be detected with high accuracy for a six month period after use. Chemical compounds of drugs are circulated in the blood stream and become part of the cells of the body including the hair root where they are easily detected.

There are hundreds of detoxifying products on the market that claim that with their use, drugs will not be able to be detected. There products that claim that they can wash toxins out of the hair. Most of these are absolute scams. The rest have a very low success rate. An experienced screener would pull the hair out intact, exposing the root where the compounds collect.

A one time use of marijuana will likely not show up in the hair while extended use can be detected for three to five months after use depending on the test used.


Amphetamines, cocaine, heroin, opiates and PCP can be detected accurately up to five months after use.

Certain non-prescription medications can interfere with accurate results. These common medications include ibuprofen and ephedrine-based products. Most drug testing companies will ask the applicant in advance if they have taken any prescription or non-prescription medication prior to the screen.

In most cases if any drugs are detected, the applicant will have the opportunity to provide a doctor's prescription or choose to be retested.


Jobs for felons and "ex-offenders" are hard enough to get, so why blow an opportunity to get hired by using drugs?

Will a juvenile record keep me out of a job?

Hello sir,

I have a question. I am currently in the process of applying to work for the New York City Board of Education but I am worried that I may not get the job because I have a juvenile conviction. I was arrested on grounds for felony for reckless endangerment but I took a plea bargain and opted out for a misdemeanor instead. I was arrested back 91/2 years ago.

I have to get my fingerprints taken and have a background check done on me so I am nervous that my conviction will pop up. And I have a sealed record but I am wondering will that also affect anything in my applying to work for the New York City board of Education.



I get a lot of questions like this from juvenile ex-offenders and felons looking for jobs.

Let me understand. You are afraid that a 9 1/2 yr. old juvenile misdemeanor conviction will stop the New York City Board of Education from hiring you.

It is my understanding that juvenile records are sealed and can only be seen by the court system, law enforcement and government agencies. Even if it were public, I doubt anyone would hold a 9 1/2 yr. old juvenile misdemeanor charge against you.

Here in NJ where I am, job applicants are not even bound to include juvenile convictions. I'm not sure about NY state. To be absolutely sure, I would contact someone in your local legal aid office for clarification.

Can I Join the Army with a Felony?

Hello I hope you can help......

Well I was charged with failure to stop after having an accident involving personal injury and I'm a little misunderstanding of what it means for it being a class four felony. I want to get into the military cuz lets face it at this point in time the chances of me getting a decent job to support me and family is really really low with this charge on me.

 I don't see any other options cuz from what I have been gathering with web browsing you can't get certain certificates and degrees to work and money is not real good at the moment to just lolly gag so my questions are as follows

1. Can I get it expunged?

2. Is it a felony misdemeanor

3. How would I go about tryin to get in the military with this?

4. What states would this not count as a felony....... and I'm sorry if its a lot or jus very scrambled. I want the best for my child and wife so I'm a little everywhere with this but I'm looking forward to this response thank you.

Hello Ernesto,

Questions 1, 2 and 4 are best answered by an attorney. Often ex-offenders and felons looking for jobs need legal assistance. I suggest contacting your local legal aid office. There you will probably be able to get low-cost or low-cost legal advice. They may be also be able to answer questions about ex-offenders and felons getting professional certifications. 

Just a note on expungement, it is not an option in every state.  Even in states which allow them, often they are limited.  For example, in New Jersey, where I am, one is allowed only one felony expungement.  It cannot even be applied for until ten years after the termination of the sentence.  Expungement is not a cure all.  Even if one is granted, the conviction will always be visible to the court system, government agencies and law enforcement.

Don't give up on a military career. The military often accepts ex-offenders and felons and there are many career options. Your best option is the Army. The Army seems to be the most liberal as it relates to accepting ex-offenders and felons. Contact you local Army recruiter to inquire about your eligibility.

Cosmetology Jobs for Felons

I am an LPN and have first offender charges of prescription fraud (doctor shopping) on my record. Due to injuries sustained in an auto accident and medications needed and prescribed by my neurologist, I can no longer practice as a nurse. I have undergone extensive counseling and am still paying fines. I wanted to contest the charges due to my medical records supporting my prescriptions. I instead was advised to take these charges to avoid another more severe charge.

My question is, can my charges on my record affect my application and testing to be a licensed cosmetologist? I want to be a productive citizen of society and support my son and myself. I want to try something else and I think I can and will enjoy this field but want to know these things before I invest the money in training.

Unfortunately you are forced to change careers.  Barbering/Cosmetology is a great field to get into not only for employment but there are are opportunities for self-employment down the line.  I know of felons who have good careers in that field.  I would suggest that you contact the Cosmetology Licensing Board in your state. They will be able to tell you if you are eligible.  If you are unemployed, you may even be eligible for for free training through your state's department of labor

Thanks for creating your blog on information for ex-offenders. I am a first time offender who was convicted in 2007 and is having a hard time with gainful employment. I have approximately 17 years of human resources experience in the federal government service and 2.5 years of retail service. My felony is one of moral turpitude (forgery/utter forged check/obtaining money by false pretenses) which makes it difficult because of the trust factor. I would like to know if you have any recommendations for me to seeking gainful employment. I am currently on indefinite supervised probation for the payment of my restitution. Any recommendations would be greatly appreciated.

Often convictions involving integrity or any type of theft conviction are often some of the toughest to overcome. I would suggest you contact the United Way in your office. The United Way supports a number of social services some of which offer assistance to ex-offenders and felons in need of jobs and other forms ex-offender / felon advocacy groups that know of companies that hire people with criminal backgrounds.

In the meantime, since you have clerical experience, I suggest you try temporary employment.  In many cases, temporary jobs turn into permanent jobs.  For ex-offenders and felons looking to get temp jobs, I suggest applying to small independent agencies rather the nationally known ones.  Smaller agencies can hire whomever they feel will be good.  The larger companies are more likely to have restrictions regarding the hiring of people with criminal records.  Take a look at the link below:

Hi, My name is Jamie. I recently read your blog on ''felons-turn-to-military-to-find-jobs''. I have been extremely interested in joining the Army ever since I was a kid. My father spent 22 years in the Army, fought in the Gulf War, traveled the world and retired a Sergeant Major in the end. I have never looked up to anyone more than him. Joining the Army has been my one and only interest, even to this day.

 In 2011 (14 years old) I was charged with 1st degree assault with sexual motivation and it was dropped to 3rd degree. A felony none-the-less. My hopes at joining the Army were dashed and ever more so when I even tried applying in person. It's been over seven years now and I haven't had any trouble with the law and never plan to. I was young and stupid and regret what I did every day. I'm 21 now and am still trying to look ahead and see what I should do with my life, I literally never had any interest in my future except to join the Army and now I'm struggling.

I recently just heard about the Moral Waivers that were introduced in 2009 and was hoping you could shed some light on the matter. I would appreciate anything you have to offer. I want to serve my country and I want to follow in the footsteps of my father. Thank you.

There are military personnel serving today with sexual assault convictions. In fact I have students who have joined the military. It is a growing trend that ex-offenders and felons having difficulty finding jobs are turning to serving in the military. It is my understanding that you are more likely to get a moral waiver from the Army or Navy than the other branches.

I suggest talking to a recruiter. A recruiter will tell you what type of waiver you will need and exactly how to apply.  Bear in mind that no one has the right to serve in the military and the granting of waivers is totally up to discretion of the Army.

I was reading your blogspot about who women who was having difficulties finding employment because of felonies on her record in North Carolina . I do not have any felonies, but I occurred 2 misdemeanors in one night. Disorderly Conduct, and Resisting Arrest. I am talking with lawyers and hopefully these charges will be removed. The frustrating thing is I was fired today from my job because the charges are "pending". The reason I sent this email is to ask you are there any jobs that will hire me with misdemeanors on my record until I go to court Oct. 5. This was really a blow to my self esteem, and if you know anywhere I could seek employment in Raleigh, NC I would greatly appreciate it. Have a great day.

Not to minimize your troubles but your charges could be considered minor. Not many employers would hold those against you. You may just have to find the right situation. The suggestion I offer to many ex-offenders and felons looking for jobs is the local One-stop Career Center. There are many services as well as counselors that can help ex-offenders and felons get jobs. Often the counselors are experienced at assisting those with criminal backgrounds. The counselors also have access to the bank of open positions in your state.

Too many ex-offenders and felons looking for jobs make the assumption that they cannot get jobs because of their records.  I suggest that he contact the local school board to find out for sure if his conviction would keep him from being certified and hired as a teacher.  If it indeed does, there are other options for and felons wanting careers as teachers.

Community colleges, adult learning annexes, charter schools and private schools are great places to start. They usually have fewer regulatory restrictions than public school systems.  There is also a growing trend toward career schools that are always looking for trained instructors.  Don't assume that because you have a criminal record, you cannot become a teacher.

I am a 25-year old graduate student and I am currently engaged to a good man who helps me take care of my daughter. However, times are really hard for us right now, as my fiance is 31-years old and has been out of work for 2 years. In 2007, he please guilty to conspiracy to commit robbery or carjacking (which is how it is listed on his record). This actual even happened in 2003. Since then, he secured one job in 2007, and lost it in 2009 when the store went out of business. In addition, he went to Lincoln Tech Institute and obtained a certificate for Diesel Technology and Technician. Next, he went and got his forklift license.


He has submitted over 200 hundred applications in the past year and he has still not gotten a job. He even walks into companies wearing a suit and tie just to fill out applications, hoping that this will help increase his chances at securing a job. Every time it seems his chances are looking good in the interviews, he either tells about his conviction, or the companies conduct a background check, and he does not get a call back after that. We have been to the One Stop Career Center seeking help, and the most they gave him was a list of employers who have hired ex-felons in the PAST. We have been to church organizations and have contacted Trenton, and still he has not received any help.


He would like to drive trucks, fix on them, or get a forklift job, but we just don't know what to do anymore. I'm trying not to give up on this man, but it's becoming so overwhelming. Please help us!

Hello Karen,

Firstly, your fiance may have to get a Commercial Drivers License if he wants to drive trucks. If he attended Lincoln Tech, there are placement services there that assist graduates. If that doesn't work, I suggest grabbing the yellow pages and making a list of all the garages in your area that service diesel engines. He can call each one to inquire about open positions. Because he has training but not much experience, he may have to start as a mechanic's helper. A third option would me to contact trucking companies in your area to see if they service their own trucks. He could apply as a mechanic's helper at those places. Usually smaller independent companies will offer a better chance to ex-offenders and felons.

Ex-offenders and felons looking for jobs must understand that they may not get what they want right away. A little out-of -the-box thinking and lots of hard work will pay off.

I am an ex offender who was convicted in 1977, and 1978 for 2 separate offenses. 

1977 robbery- this was a teenage indiscretion of joyriding in a stolen car with someone who lifted a set of keys from a key hook on the wall in a home where we attended a party and then, staying silent after we were caught. The robbery charge is because the keys were stolen from inside the home, making it a point of law 1978 for possession of a controlled substance. The reason I give that summary is to articulate the injustice of this practice of culling ex-offenders from the workforce. 

Particularly someone who has not been in trouble for over 33 years. Especially when, for decades, I have been employed successfully. In fact, I have a B.A. and an Associates in Applied Science degree- both with honors. I am currently unemployed, and unable to get past the background requirements for employment, and have been eliminated from numerous jobs that I would otherwise have gotten.

 My questions are these:

1.) How is it not a violation of our constitutional rights for a potential employer to data mine our info. without standing? And, have us self incriminate as a pre-employment requirement? Isn't the Constitutional protections for minority rights?

2.) What are the statistics of ex- offenders currently in USA? In other words how many millions of people are affected by this practice? Has this been challenged in the courts?

My belief is that our Constitution is piece of paper that becomes animated by the people who stand up for their own rights. After all, it is the minority that needs the protections, not majority opinion. That is the purpose of the document. Furthermore, without class action, the ACLU will not challenge this practice. How could we mount a class action challenge to this practice? I could go on ad infinitum, but I will just close with a sincere thank you for the work you are doing to help others get through this.

“Ban the Box” and Background Checks

Hello Pablo,

It is the responsibility of every employer to hire the best person they can find for any job. Having a criminal record does not necessarily eliminate you from consideration from any job. An employer is trying to get some idea of the type of people that are applying.

Too often with ex-offenders and felons looking for jobs assume that they were maligned because because they have criminal convictions. In many cases the may be correct but that is difficult or nearly impossible to prove. I am of African descent. I have often thought that was the reason that I didn't get many jobs that I know I was more than qualified for. Rather that wallow in anger and self-pity, my other choice was to keep applying for each and every job I felt I fit.

When speaking of the laws and the constitution, being a child of the sixties, I can tell you that laws do not change attitudes. Laws may say that I am equal but until individual prejudices go away, I will always have a difficult time.

My advice is to not give in to your frustrations but let them motivate you.
